RESOLUTION GRANTING A VARIANCE
WHEREAS, H. R. Peterson and Irene Peterson, as owners of cer-
tain real property situated at 323 South Clementine Street, in the
City of Anaheim, County of Orange, State of California, described
as Lot 8 Gade Subdivision, according to a map thereof recorded
in Book 8, page 23 of Maps, Records of Orange County, California,
have filed with the City Planning Commission of the City of Anaheim
a petition requesting that a variance be granted to provide two
additional apartment rentals with kitchenettes, resulting in a
three -unit apartment on said real property; and
WHEREAS, the City Council finds from consideration and
investigation of the facts and the report and recommendation of
the City Planning Commission that:
(1) Special circumstances and exceptional conditions do
exist as to the property or classes of uses in the same zone or
district;
(2) That a variance is necessary for the preservation and
enjoyment of a substantial property right of said petitioner;
(3) That the granting of such conditional variance will not
be detrimental to the public welfare or injurious to the property
or improvements in the district wherein said property is located,
provided the conditions hereinafter set forth are complied with:
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ANAHEIM, that a conditional variance be, and the same is
hereby granted to H. R. Peterson and R. Irene Peterson to remodel
their dwelling at 323 South Clementine Street to provide two
additional apartment rentals with kitchenettes, resulting in a
three -unit apartment, upon the following conditions:
1. That the remodeling of said dwelling be in accordance
with the plans submitted with the application for a variance.
1 2. That said business shall be operated in accordance with
2 all laws of the State of California and Ordinances and Regulations
3 cif the City of Anaheim.

3. That the appearance of said real property, including all
buildings thereon shall be kept and maintained with a satisfactory
appearance in keeping with the uses herein permitted.
4. That the maintenance and operation of said buildings
shall comply with all requirements of the Chief of the Fire
Department of the City of Anaheim as to safety and fire prevention.
5. That garage space be supplied for each unit in accordance
with the city building requirements.
6. That the City Council hereby reserves the right to revoke
said variance permit for good cause.
THE FOREGOING RESOLUTION is signed and approved by me this
25th day of January 1949.

Anaheim, held on the 25thday of January ,1949, by the following

NOES: COUNCILMEN: None.
ABSENT: COUNCILMEN: Boney
