RESOLUTI ©N GRANTING A VARIANCE WHEREAS, VIRGINIA WATTS, as owner of certain real property situated at 703 South Helena Street in the City of Anaheim, County of Orange, State of California, described as Lot 16 of Tract No. 416 Palomar Tract, recorded in Book 15, page 40 of Miscellaneous Maps, Records of Orange County, has filed with the City Planning Commission of the City of Anaheim, a petition recuesting that a variance be granted permitting the remodeling of the second story of her residence on said real property into apartments; and WHEREAS, the City Council finds from consideration and investigation of the facts and the report and recommendation of the City Planning Commission that: (1) Special circumstances and exceptional conditions do exist as to the above described real property that do not apply generally to the property or classes of uses in the same zone or district; (2) That a variance is necessary for the preservation and enjoyment of a substantial property right of said petitioner; (3) That the granting of such conditional variance will not be detrimental to the public welfare or injurious to the property or improvements in the district wherein said property is located, provided the conditions hereinafter set forth are complied with: NOW, THEREFORE, BE IT REOLVED BY THE CITY COUNCIL O THE CITY OF ANAHEIM, that a conditional variance be, and the same is hereby granted to Virginia Watts whereby the second story of her residence at 703 South Helena Street, Anaheim, California, may be remodeled into apartments, upon the following conditions: 1. That the appearance of said real property, including all buildings and improvements thereon shall be kept and maintained with a satisfactory appearance in keeping with the uses herein permitted. 3. That the maintenance and operation of said apartments shall comply with all requirements of the Chief of the Fire Department of the City of Anaheim as to safety and fire prevention. 4. That the City Council hereby reserves the right to revoke said variance permit for good cause. THE FOREGOING RESOLUTION is signed and approved by me this day of October, 1948.
