RESOLUTION GRANTING A VARIANCE
WHEREAS, FRANK T. MORENO, the owner of certain real property
located at 900 No. Loara Street, Anaheim, California, being part
of Lot 3, described as the Northwest Quarter (NWW) of Section 9,
Township 4 South, Range 10 West, containing 2.48 acres, having
filed with the City Planning Commission of the City of Anaheim, a
petition requesting that a variance be granted permitting the
use of the rear of his property for a sand pit, with portable
elevator and small bunker, and
WHEREAS, the City Council finds frost consideration and
investigation of'the facts and the report and recommendation of
the City Planning Commission that:
(1) Special circumstances and exceptional conditions do
exist as to the above described real property that do not apply
generally to the property or classes of uses in the same zone or
district.
(2) That a variance is necessary for the preservation
and enjoyment of a substantial property right of said petitioner.
(3) That the granting of such conditional variance will
not be detrimental to the public welfare or injurious to the pro-
perty or improvements in the district wherein said property is
located, provided the conditions hereinafter set forth are
complied with.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ANAHEIM, that a conditional variance be, and the same
is hereby granted whereby the business of establishing and operat-
ing a sand pit may be maintained and operated upon said real
property upon the following conditions:
1. That said business shall be operated in accordance
with all laws of the State of California and ordinances and

regulations of the City of Anaheim."
2. That the appearance of said real property including
all buildings and improvements thereon shall be kept and main-
tained with a satisfactory appearance in keeping with the use
herein permitted.
The foregoing resolution is signed and approved by me
this llth day of March, 1947.
