A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM GRANTING VARIANCE NO. 2337.
WHEREAS, after a request for variance by DAVID PRITCHARD,
owner; MAURICE M. LEBANOFF, agent, was received, a public hearing
before the Planning Commission of the City of Anaheim was held
upon due and proper notice as a result of which Variance No. 2337
was granted, covering the following described property:
PARCEL 1 OF 2:
The land referred to in this policy is described as
follows:
That portion of Lot 45 of Anaheim Extension, in the City
of Anaheim, County of Orange, State of California, as
shown on a map of survey by William Hamel, a copy of
which is shown in Book 3 pages 162 to 164 inclusive of
"Los Angeles County Maps" in the office of the County
Recorder of Orange County, California, described as
follows:
Beginning at the Northwest corner of the land described
in the deed to Thomas J. Whieldon recorded June 15,
1950 in book 2027 page 350 of Official Records said point
being distant South 740 50' 20" West 447.00 feet from
the Southeast corner of said Lot 45, and on the North
line of said Lot 45; thence South 150 06' 25" East along
the Westerly line of Whieldon to a line that is parallel
with and Northerly 115.00 feet from the South line of
said Lot 45; thence Southwesterly 146.53 feet along said
parallel line; thence North 150 06' 25" West 35.00 feet
to a line that is parallel with and Northerly 150.00 feet
from the Southerly line of said Lot 45; thence South-
westerly 325.00 feet along said parallel line to a line
that is parallel with and Southwesterly 471.53 feet from
said Westerly line of Whieldon; thence North 150 06' 25"
West along said parallel line to the Northerly line of
said Lot 45; thence Southeasterly along said Northerly
line to the point of beginning.
A portion of said land is shown on a map filed in book 19
page 32 of Record of Surveys in the Office of the County
Recorder of said County.
PARCEL 2 OF 2:
That portion of Lot 45 of "Anaheim Extension", in the City
of Anaheim, County of Orange, State of California, as per
Map of Survey made by William Hamel in 1868 and filed in
the Office of the County Recorder of Los Angeles County,
California, described as follows:

Beginning at a point in the Southerly line of said Lot
45 and in the Northerly line of North Street, distant
thereon South 740 50' 20" West 951.53 feet from the center
line of East Street and running thence North 150 09' 40"
West, at right angles to said Southerly line of Lot 45,

356.07 feet to the Southerly line of La Palma Avenue;
thence South 890 56' 15" West, along said Southerly
line, to the Easterly line of the right of way of the
Southern California Railway; thence South 150 09' 40"
East, along said Easterly line, 407.83 feet to the
Southerly line of said Lot 45; thence North 740 50' 20"
East, along said Southerly line, 180.00 feet to the
point of beginning.
WHEREAS, thereafter, within the time prescribed by
law an interested party or the City Council on its own motion
caused the review of said Planning Commission action at a
public hearing noticed and held as prescribed by law and as
a result thereof the City Council does hereby make the following
findings:
1. That there are special circumstances applicable
to the property, including size, shape, topography,
location or surroundings, which do not apply to
other property under identical zoning classification
in the vicinity.
2. That, because of special circumstances shown in (1)
above, strict application of the Zoning Code deprives
the property of privileges enjoyed by other proper-
ties under indentical zoning classification in the
vicinity.
NOW, THEREF~, BE IT RESOLVED by the City Council of
the City of Anaheim that a conditional zoning variance be, and
the same is hereby granted, permitting the construction of a
74-unit apartment complex on the property hereinbefore described
with waiver of the following sections of the Anaheim Municipal
Code:
SECTION 18.28.050(5-b)
Maximum height of a building within
150 feet of an R-l Zone (one storv
permitted, two story proposed)
SECTION 18.28.050(7-a)
Minimum distance between buildings
(22 feet to 8 feet proposed; 24 to
17 feet required)
SECTION 18.28.050(3-a)
Minimum floor area per dwelling unit
(700 square feet required; 520 square
feet proposed for 16 units)
That said variance be granted subject to the following conditions:

1. That this variance is granted subject to the com-
pletion of Reclassification No. 71-72-33.
2. That subject property shall be developed substan-
tially in accordance with plans and specifications on file with
the City of Anaheim marked Exhibit Nos. 1, 2, 3, 4, 5, 6, 7 and 8,
provided, however, that a 20-foot landscape buffer strip shall be
provided immediately adjacent to the west property line of the
westernmost R-l parcel on the north side of North Street and the
first two proposed apartment buildings west of said R-l parcel
shall be limtied to one story in height; and further provided that
any second story windows which may face the R-l parcels on the
north side of North Street shall be no less than four feet above
the floor as stipulated to by the petitioner.

The City Council hereby reserves the right to revoke
such variance permit for good cause or failure of said owner,
his heirs, successors or assigns to comply with the Anaheim Municipal
Code and regulations and the conditions herein. Said variance is
granted for the term prescribed by the Anaheim Municipal Code
unless otherwise specified herein.
THE FOREGOING RESOLUTION is approved and signed by me
this 18th day of April, 1972.
