72R-129 RESOLUTION NO. 72R-129 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING VARIANCE NO. 2333, IN PART. ~iHEREAS, after a request for variance by CLARENCE WAGNER, Owner; ANN T. MADISON, Agent, was received, a public hearing before the Planning Co~mission of the City of Anaheim was held upon due and proper notice as a result of which Variance No. 2333 was granted in part, covering the following described property: Parcel 2 in the City of Anaheim, County of Orange, State of California, as shown on a Parcel Map filed in Book 23, page 7, of Parcel Maps in the Office of the County Recorder of said County. r^7HEREAS, thereafter, wi thin the time prescribed by law an interested party or the City Council on its own motion caused the review of said Planning Commission action at a public hearing noticed and held as prescribed by law and as a result thereof the City Council does hereby make the following findings: 1. That there are special circumstances applicable to the property, including size, shape, topography, location or surroundings, which do not apply to other property under identical zoning classification in the vicinity. 2. That, because of special circumstances shown in (1) above, strict application of the zoning code deprives the property of privileges enjoyed by other property under identical zoning classification in the vicinity. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim, that conditional zoning variance be granted, in part, permitting the establishment of a 33 Lot R-l subdivision on the property hereinbefore described with waivers of the follo- wing sections of the Anaheim Municipal Code: a. SECTION 18.04.090(1-h) ~aximum fence height (~~ee~ permitted; ~ feet proposed) Minimum front setback (25% of the lot depth required - need not exceed 25 feet) "-- b. SECTION 18.24.030(1-a) (granted conditionally) c. SECTION 18.08.550 Minimum cul-de-sac width (60 feet -required; 53 to 45 feet proposed - all cul-de-sac lots) d. SECTION 18.24.030(4) Minimum lot width (70 feet required; 55"to 65 feet proposed for ~_ lots)- --- That said variance be granted, in part, subject to the following conditions: 1.
