RESOLUTION NOo 72R-127
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM DENYING CONDITIONAL USE
PERMIT NOo 1283
WHEREAS, the City Pla~ning Commission of the City of
Anaheim did receive a request for a Conditional Use Permit from
Henry and Josephine Schinhofen, Owners, Michael and Jeri Garen,
Agents, to establish a baseball batting facility with incidental
rental of bicycles and sale of food; with waiver of the maximum
permitted structural height on the following described property
situated in the City of Anaheim, County of Orange, State of
California, to wit:
All that certain land situated in the Rancho San Juan
Cajon de Santa Ana, in the City of Anaheim, County of
Orange, State of California, described as follows:
Beginning at the intersection of the center line of the
Anaheim-Olive Road with the west line of the east half
of the southwest quarter of Section 7, Township 4 South,
Range 9 West, S.B.B. & M.; thence south along said west
line 307.72 feet; thence east parallel with the south
line of said Section 7, 153.11 feet; thence north paral-
lel with said west line of the east half of the south-
west quarter of said Section 7, 261.29 feet, more or
less, to the center line of the said Anaheim-Olive Road;
thence north 730 7' 50" west along said center line of
Anaheim-Olive Road, 160 feet to the point of beginning,
containing one acre, more or less.
AND WHEREAS, the City Planning Commission did hold a
public hearing at the City Hall in the City of Anaheim upon
said request on February 7, 1972 . notices of which
said public hearing were duly given as required by law and the
provisions of Title 18, Chapter 18.76 of the Anaheim Municipal
Code; and
WHEREAS, said Commission, after due inspection, in-
vestigation and studies made by itself and in its behalf and
after due consideration of all evidence and reports offered at
said hearing, did adopt its Resolution No. PC 72-15
denying Conditional Use Permit No. 1283
and
WHEREAS, thereafter, within twenty-two (22) days from
the date of the adoption of said resolution, a written appeal
was filed with the City Council protesting the action of the
City Planning Commission in denying said Conditional
Use Permit and said appeal was set for public hearing on

March 14, 1972, and continued to April 11, 1972, at the City
Hall in the City of Anaheim, and notices of such public hearing
were duly given as required by law and the provisions of Title
18, Chapter 18.76 of the Anaheim Municipal Code; and
NHEREAS, at the time and place fixed for said public
hearing, the City Council did duly hold and conduct such hearing
and did give all persons interested therein an opportunity to
be heard and did receive evidence and reports; and
WHEREAS, the City Council does find, after careful
consideration of the recommendations of the City Planning
Commission and all evidence and reports offered at said hearing,
that Conditional Use Permit No. 1283 should be denied.
NOW, THEREFORE: BE IT RESOLVED by the City Council of
the City of Anaheim that the action of the City Planning Com-
mission denying Conditional Use Permit No. 1283 be, and the
same is hereby affirmed, and that the request of Henry and
Josephine SChinhofen, Owners, Michael and Jeri Garen: Agents,
to establish a baseball batting facility with incidental rental
of bicycles and sale of food; with waiver of the maximum
structural height is hereby denied.
THE FOREGOING ORDINANCE is approved and signed by me
this 11th day of April, 1972.
