WHEREAS, the City Council finds from consideration and in- vestigation of the facts and the report and recommendations of the City Planning Commission that: (1) Special circumstances and exceptional conditions 6o exist as to the above described real nroperty that do not arnly generally to the property or classes of uses in the same zone or district. (2) That a variance is necessary for the nreservstion and enjoyment of a substantial nronerty right of said petitioner. (3) That the granting of such conditional variance will not be detrimental to the public welfare or injurious to the nronerty or improvements in the district wherein said property is located, nrovided the conditions hereinafter set forth are comnlied with. TREHEFOnE, 3E IT R BY TH CITY COUNCIL CF THE CITY OF ANAHEI, that a conditional variance is hereby granted where by the business of dealing in, selling, buying, exchanging, repair- and servicing automobiles may be maintained and operated upon said real property upon the following conditions: 1. That no repairing of bodies or fenders of automobiles ever be done or Performed, and no business commonly known as "body and fender works" shall ever be maintained, operated or conducted on sai5 real pronerty. 2. That any building erected upon said real property shall be of the tyne shown upon the nlen accomnanying said petition and that the exterior thereof shall be constructed of stucco, brick or con- crete. That in the event that any business is conducted upon said 5 real nrorerty contrary to the terms and conditions of this variance 6 and/or in violation of any ordinance of the City of Anaheim or law 7 of the State of California, or any lawful revulation of any agency 8 or officer thereof, then the City of Anaheim, through its City Counc 9 may revoke this variance and all nrivileges and rights conferred by 10 this Resolution, which revocrtion, however, shall not be done, with- 11 out 2 public hearing before said City Council at which hearing the 12 owner of said real nronerty may be present, be renresented by lerel 13 counsel, and permitted. to produce testimony and withesses on his or 14 her own behalf. Written notice of any such hearing shell be Fiven 15 by said City Council at least Ten days before such hearing. For the 16 purpose of riving such notice the owner of said real nronerty shall 17 be deemed to be the person whose name appears upon the Tax Collector s 18 books of said City Ps the owner thereof. Such notice may be served 19 personally or by mail. If served by mail it shall be sent to the 20 aVress of the owner as appears upon such Tax Collector' books or 21 if none arrears then to the address of said real property itself. 22 Service by mail shall be deemed complete one day after said notice 23 has been deposited in the United States Post Office in Anaheim, 24 California.
