2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM
PROVIDING FOR THE EXERCISE OF AN OPTION GRANTED BY
3 COMMUNITY INDUSTRIAL LAND CO., INC.
4 WHEREAS by an agreement entitled "Land Lease and Options"
5 dated MQ//e 30 1943, by and between Community Industrial

6 Land Co., Inc., a corporation, and City of Anaheim, said Community
7 Industrial Land Co., Inc. did grant unto the City of Anaheim the
8 option to purchase the hereinafter described real property for the
9
10 ,WHEREAS, said property is that real property situated in
11 the City of Anaheim, County of Orange, State of California, describe,
12 as:
13 All of that portion of the p roperty of said Community
.Industrial Land Co., Inc., lying south of the property of bouthern
14 California Citrus Foods and east of olive Street, In the West half
of the Southeast quarter of Section 3, Township 4 outh, Range 10
15 West, S. B. B. M., in the City of Anaheim, County of Orange, State
of California, and more particularly described as follows:
16 1 Beginning at the intersection of the east line of North
Olive Street and the north line of Schaffer-Oswald Subdivision, as
17 shown on a map recorded in Book 7, page 41, Miscellaneous Maps, re-
cords of Orange County; thence north 0° 02' 30" West along said east
18 line of North Olive street, 667,15 feet; thence East along the north
line of the property of Community Industrial Land Co., Inc.. 742.05
19 feet to a point on the Westerly right of way line of the Union Pac-
fic Railroad Company; thence southeasterly along said right of way
20 line, along a curve concave to the east and having a radius of
:5764.65 feet, a distance of 251.91 feet to a point tin the east line
21 of said west half of the boundary line; thence south 0° 05t East
along said boundary line 419.10 feet to a on the north line
22 of said Schaffer Oswald bubdivision; thence west along said north
line to the point of beginning, containing an area of 11.90 acres,
23 ,more or less,
and
24 WHEREAS, said agreement provided that in the event that
25 said Community Industrial Land Cm,, Inc. should be unable to convey
26 Clear title, as therein agreed, by reason of an adverse ruling of an*

sum of $5950.00, and
Court in certain litigation then pending between it and one N. W.
alker, that the City of Anaheim should have the right, under its

purchase price of $500 per acre for the portion so conveyed, and the
sum of $500 paid for the option should be included in such purchase

vision 785,10 feet to its intersection with the east line of North

1 WHEREAS, by reason of said litigation said Community In--
2 dustrial Land Co., Inc. is unable to convey all of said above de-
3 scribed real property ifflissimplisbigmaisew.by reason of be-
4 ing compelled to conveye to said N. W. Walker two acres thereof,
deliver unto Community Industrial "and Co., Inc., notice of exercise
of such option to purchase said portion for the said sum of $4950.
and that Chas. A. Pearson, as Mayor, and Charles E. Griffith, as
City Clerk, be and they are hereby authorized and directed to ex-
lecute and deliver said notice of opltion on behalf of the City of
Anaheim, in accordance with the terms of the aforedescribed agree-
ment,
3. That the City of Anaheim deliver unto Orange County

Title Company of Santa Ana, California, the sum of *4450,00 on

or before April 7, 1944, in payment of purchase price as provided

in said agreement; that on behalf of the City of Anaheim, that
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ANAHEIM:
1, 'hat it exercise its option to purchase that portion
f the property first described herein for the sum of $4950.00;
