RESOLUTION NO. 12610
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM, RESCINDIN
RESOLUTION NO. 1259 AND FIXING CERTAIN RATES FOR WATER CONSUMPTION
FOR DOMESTIC PURPOSES DURING A CERTAIN TWO MONTH PERIOD.
WHEREAS, the City Council of the City of Anaheim on
July 15, 1941, adopted its Resolution No. 1259 fixing a certain
rate for domestic water consumption for certain consumers for a
certain two -month period, and
WHEREAS, at the time of the adoption of such resolution
no information was available as to the exact time when water from
the Metropolitan Water District could be obtained, and
WHEREAS, said Resolution did not fix any special rate
for domestic water consumers outside the limits of the City of
Anaheim, and did not fix a special rate for domestic consumers
where more than one family was served through the same meter, and
WHEREAS, water from the Metropolitan Water District
is now available subject to favorable report from the Orange
County Health Department,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF ANAHEIM that said Resolution No. 1259 be, and the
same is hereby rescinded and declared to be of no further force
and effect, and
BE IT FURTHER RESOLVED that commencing upon the day
following the receipt by the Department of Light, Power and Water
of a report from the Orange County Health Department to the effect
that water available to said City from the Metropolitan Water
District is safe for human consumption, that the Public Service
Department of the City of Anaheim shall mail to each domestic
water consumer with his statement for the previous month's service
a notice stating that commencing with the latest reading of said
consumer's domestic water meter he shall be charged a certain
rate, hereafter set forth, per month for the two months immediatei
succeeding said meter reading, and

BE IT FURTHER RESOLVED that for such two month period
immediately succeeding such meter reading that the water rate
to domestic consumers residing within the City of Anaheim, where
only one family is served by such meter, the rate shall be One
*i.00) Dollar per month, and
BE IT FURTHER RESOLVED that for such two month period
immediately succeeding such meter reading that the water rate to
domestic consumers residing within the City of Anaheim, where
more than one family is served by such meter, that the rate shall
be One 01.00) Dollar per month for the first family and twenty
five (25¢) cents per month for each additional family, and
BE IT FURTHER RESOLVED that for such two month period
immediately succeeding such meter reading that the water rate to
domestic consumers residing outside of the limits of the City of
Anaheim shall be the present minimum rate for such service as
fixed by Resolution No. 1132 of said City Council, and
BE IT FURTHER RESOLVED that such two month period shall
commence at the time of the first reading of such meters of
domestic water consumers after the receipt by the Department
of Light, Power and Water of the report of said Orange County
Health Department heretofore referred to, and
BE IT FURTHER RESOLVED that the above rate shall be
applicable only for the consumption of water for domestic purposes,
and
BE IT FURTHER RESOLVED that the term "water for domestic
purposes" shall not include any water used for manufacturing,
processing, packing, canning, commercial laundry or power purposes
and shall not include any water used for irrigation purposes
except for lawns, household gardens and ornamental trees, flowers
and shrubs; and
BE IT FURTHER RESOLVED that during said two month period
that the rates as fixed by Resolution No. 1132 of the City Council

of the City of Anaheim in conflict herewith shall be suspended, but
that in all other respects the rates set forth in said Resolution
No. 1132 shall prevail, and
BE IT FURTHER RESOLVED that immediately upon the termin-
ation of said two month period all of the rates set forth in said
Resolution No. 1132 shall be in full force and effect; and
BE IT FURTHER RESOLVED that in all cases where a dispute
may arise as to whether any consumer shall be entitled to the above
rate set forth, the decision of the City Council shall be final.
BE IT FURTHER RESOLVED, that the speoial rates herein set
forth are based upon the anticipation by the City of Anaheim of an
initial continuous two month's flow of water from the Metropolitan
Water District to the full capacity of the feeder line of said Dist-
rict to said City. In the event that such flow is, for any reason
interrupted or diminished, the City reserves the right to defer
furnishing water to any or all consumers at the rates herein provided
and in the event of such deferment, the present rates provided for in
said Resolution No. 1132 shall be in full force and effect. In the
event that such flow from the Metropolitan Water District is inter-
rupted or diminished after certain consumers have received the notice
from the Public Service Department, heretofore referred to, the City
of Anaheim reserves the right to discontinue the special rates herein
set forth to such consumers until such flow shall be resumed, pro-
vided, however, that such discontinuance shall not apply to the water
furnished during the first month of such two month period. Notice of
the discontinuance of such special rates shall be given by the Public
ervioe Department in the letters containing the statements for the
revious month's service. In the event that there is an interruption
or diminution of said flow, as herein contingently provided for, the
public service department shall give notice to the said domestic
consumers in the manner herein set forth in the letter containing the
eat statement mailed to the consumer following the resumption of
such flow.
Notwithstanding the contingency of such interruption or
diminution of flow the City Council declares its intention to furnish
all of said consumers of domestic water for a total of two months
at the rates herein provided.
Adopted this 22nd day of July, 1941.
