RESOLUTION NO. 1251
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM, CALIFORNIA.
On motion of Councilman Van Wagoner, duly seconded and carried,
the following Resolution was adopted:
WHEREAS, the County of Orange now owns, maintains and operates a
Police Broadcasting Station KGHX in the City of Santa Ana, California, and
WHEREAS, the City of Anaheim has under a prior agreement a remote
control station established in said City of Anaheim and is desirous of having
same maintained under a licensed supervising technician of the County of
Orange,
NOW, THEREFORE, BE IT RESOLVED AND ORDERED by the City Council of
the City of Anaheim, in regular session duly assembled, that the City of
Anaheim enter into an agreement with the County of Orange, for the establish-
ment, maintenance and operation of a Police Broadcasting Remote Control
Station, upon the following terms and conditions, to -wit:
1. The County of Orange agrees to install any charges or replace-
ments and maintain the Police Broadcasting Remote Control Station heretofore
installed in said City of Anaheim, to be operated by a telephone line
connection between said Remote Control Station and Police Broadcasting
Station KGHX, under the rules and regulations of the Federal Communications
`Commission. All work and expense of installation and maintenance, except
expense and cost of equipment, materials, apparatus and parts, shall be
born by the County of Orange, All equipment, material, apparatus and parts
required for installation, maintenance, replacements and repairs shall be
furnished by and at the expense of the said City of Anaheim, and in accord-
ance with the specifications of the County of Orange.
2. The County of Orange agrees to furnish a licensed supervising
techniciap, and said Remote Control Station shall be under the supervision
off said licensed technician, who shall be a radio telephone Operator first
class.

at a telephone line connecting Remote Control Station with
the Police Broadcasting Station KGHX shall Lt, rented by the County, and it
is further understood and agreed that the rental charge for sazitelephone
line shall be borne by the County of Orange.
4. Said Remote Control Station or point shall be in continuous
connection with the Broadcasting room of Station KGHX and the City Police
;Officers of the said City of Anaheim shall be permitted to broadcast over
the air at any time the Station or lines are not actually being used for
other police agencies of Orange County utilizing said Station.
5. It is further agreed and understood that any message of local
origin or importance shall have preference over "A11 Point Messages and
the facilities for broadcasting shall be immediately surrendered to such
use upon demand. Emergency calls shall always have preference. In case of
la dispute over priority of emergency messages originating in two departments,'
operator of Station KGHX shall be the final authority in deciding which
(emergency message shall have priority.
6. The said City of Anaheim proposes to use said Station for
such purposes as may be permitted by the Federal Communications Commission.
The operator on duty at Station KGHX shall monitor all broadcasting and
shall have the authority to take said Remote Control Station off the air
should any rule or regulation of the Federal Communications Commission or
Federal Commissions Act be violated. The operator of Station KGHX shall have
no control over the broadcast from the Police Department of the said City
of Anaheim except as explicitly set forth herein.
7. The said City of Anaheim agrees that so long as this agreemen'i
remains in effect said City of Anaheim will not apply to the Federal
Communications Commission for a license or individual authority to operate
a municipal Police Radio Transmitting Station, and the said City of Anaheim
hereby agrees to accept Radio Police Service over and through Radio Police
Station KGHX, as herein agreed upon.
8. All radio equipment on mobile equipment shall be installed and
maintained by the County. Said City shall furnish all material and supplies
for installation and maintenance on said mobile equipment.
9. This agreement may be cancelled by either party upon twelve
months notice given to the other party hereof.
AND BE IT FURTHER RESOLVED AND ORDERED that the Mayor and the
City Clerk and ex- officio Clerk of the City Council be and they are hereby
authorized and directed to enter into and execute for and on behalf of the
City of Anaheim, an Agreement with the said County of Orange, upon the terms
and conditions herein specified.
On roll call the foregoing resolution was passed and adopted by
the following vote:•

None.
ABSENT AND NOT VOTING: COUNCILMEN,
The Mayor of the City of Anaheim declared the foregoing resolution
duly passed and adopted.
