RESOLUTION ORDERING IMPROVEMENT

WHEREAS, the City Council of the City of Ana-
heim on the 36th day of September, 1939 passed its Resolution
of Intention No. 1140 to order the hereinafter described im-
provement to be made and public work to be done in the City of
Anaheim; and
WHEREAS, after the passage and adoption of
Resolution of Intention No. 1140 the Street Superintendent of
the City of Anaheim conspicuously posted along the line of the
contemplated work and improvement, at not more than three hun-
dred (300) feet in distance apart, and forty in all, notices
of the passage of said Resolution of Intention, headed, NOTICE
OF PUBLIC !CORK, in the manner, form and substance as required
by law, and said Street Superintendent also caused a notice
similar in substance to be published for a period of ten (10)
days in the Anaheim Bulletin, a daily newspaper published and
circulated in the City of Anaheim, and named by said City
Council in said Resolution of Intention as the paper in which
said notice should appear, all as appears from the affidavit
of Richard Fischle, the printer and publisher of said daily
newspaper, and which affidavit was filed in the Office of the
Clerk of the City of Anaheim on the /D 26 � day of October, 1939
and is now on file therein; and
WHEREAS, the Street Superintendent of the City
of Anaheim commenced the posting of the notices hereinbef€ire�
referred to on the 2nd day of October, 1939, and fully completed
the posting thereof on the 2nd day of October, 1939, as appears
from the affidavit of Hiram Bowen, Street Superintendent of
the City of Anaheim, and more than ten (10) days having ex-
pired after the expiration of the time of the publication of

said notice within which protests or objections to the proposed
work or improvement might be made by any person interested ob-
jecting to said work or improvement, or to the extent of the
district or lands to be affected or benefited by said work or
improvement and to be assessed to pay the costs and expenses
thereof; and
"dHEREAS, at the next meeting of the City Council
after the expiration of said ten (10) days after the expiration
of the time of the publication of said notice, and no objection
to said work or improvement having been made or on file, why
said proposed improvement should not be carried out in accord-
ance with said Resolution of Intention, the City Council of
the City of Anaheim having now acquired jurisdiction to order
the proposed improvement;
IT IS HEREBY RESOLVED AND ORDERED: That the
public interest and convenience requires the work hereinafter
described and the City Council of the City of Anaheim hereby
orders the following work to be done and improvement made in
the City of Anaheim as follows:
That certain private roads, hereinafter de-
scribed, in the City of Anaheim, be closed up and abandoned,
to -wit:
All of the Private Roads shown on the map of
Anaheim Investment Company's Tract recorded in
Book 7 pages 33 & 34 of Miscellaneous Maps, records
of Orange County, California, lying within the
area bounded on the North by Crone Avenue, bounded
on the South by Ball Road, bounded on the East
by Walnut Street, and bounded on the Test by Sou
Pac R R, reserving and excepting to the said
City of Anaheim the right of way for a sewer
pipe as conveyed to said City, by deed recorded
March 8, 1911 in Book 196 page 21 of Deeds,
Records of Orange County, California;
all of which is more clearly shown on a certain map approved
and adopted by the City Council of the City of Anaheim for the
said abandonment by Resolution No. 1139 on the 26th day of
September, 1939.

That the public work ordered and the improve-
ment to be made is for the purpose of closing up and abandoning;
those certain private roads in the City of Anaheim as herein-
before described, and for that reason no district is chargeable
therewith.
All of the herein proposed work shall be done
in pursuance of an Act of the Legislature of the State of
California, designated "Street Opening Act of 1889", and amend-
ments thereto.
For further particulars reference is hereby
made to said Resolution of Intention No. 1140, which is dated
the 26th day of September, 1939, and on file with the Clerk of
the City of Anaheim.
The Clerk of the City of Anaheim is herewith
instructed to record a copy of this Resolution Ordering Im-
provement in the Office of the County Recorder of the County of
Orange, State of California.
The foregoing Resolution was signed and ap-
