1939-1140RESOLUTION OF INTENTION No. 11440 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DECLARING ITS INTENTION TO ORDER THE CLOSING UP AND ABANDONMENT OF ALL OF THE PRIVATE ROADS SH01W ON THE MAP OF ANAHEIM INVESTMENT COMPANY'S TRACT RECORDED IN BOOK 7 PAGES 33 & 34 OF MISCELLANEOUS MAPS, RECORDS OF ORANGE COUNTY, CALIFORNIA, LYING WITHIN THE AREA BOUNDED ON THE NORTH BY CRONE AVENUE, BOUNDED ON THE SOUTH BY BALL ROAD, BOUNDED ON THE EAST BY 'JALNUT STREET, AND BOUNDED ON THE ',ST BY SOU PAC R R, RESERVING AND EXCEPTING TO THE SAID CITY OF ANAHEIM THE RIGHT OF ? "dAY FOR A SE1 -qER PIPE AS CONVEYED TO SAID CITY, BY DEED RECORDED MARCH 8, 1911 IN BOOK 196 PAGE 21 OF DEEDS, RECORDS OF ORANGE COUNTY, CALIFORNIA; DECLARING IT TO BE REQUIRED BY THE PUBLIC INTEREST A1 /OR CONVENIENCE, AND FIXING THE TIME AND PLACE FOR HEARING OBJECTION TO SAID PROPOSED IMPROVEj7ENT. The City Council of the City of Anaheim, pur— suant to the provisions of Chapter 76, page 70, Statutes of 1889 of the State of California, being an act entitled "An Act to provide for laying out, opening, extending, widening, straighten— ing, or closing up in whole or in part any street, square, lane, alley, court or place within municipalities, and to condemn and acquire any and all land and property necessary or convenient for that purpose," and amendments thereto, do resolve and de— clare as follows: Section 1. That the public interest and /or convenience require the closing up and abandonment of certain private roads, particularly described as follows: All of the Private Roads shown on the map of Anaheim In— vestment Company's Tract recorded in Book 7 pages 33 & 34 of Miscellaneous Maps, records of Orange County, California, lying within the area bounded on the North by Crone Avenue, bounded on the South by Ball Road, bounded on the East by 71alnut Street, and bounded on the 'Nest by Sou Pac R R, reserving and excepting to the said City of Anaheim the right of way for a sewer pipe as conveyed to said City, by deed recorded Tuiarch 8, 1911 in Book 196 page 21 of Deeds, Records of Orange County, California, all of which is more clearly shown or, a map approved and adopted by the City Council of the City of Anaheim for said closing up and abandonment, by Resolution No. 1139 on the 26th day of September , 1939. —1— E 1 � 2 3 4 5 6 7 1 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 301 31 32 Section 2. That the exterior boundaries of the district of lands to be affected and /or benefitted by said closing up and abandonment are as follows: Beginning at the intersection of the center line of said Walnut Street with the center line of said Crone Avenue, and running thence West along the center line of said Crone Avenue to the East line of the Sou Pac R R; thence South along the said East line of said Sou Pac R R to the center line of Ball Rpad; thence East along the center line of said Ball Road to the center line of Nalnut Street; thence North along the center line of Walnut Street to the point of Beginning. Section 3. That the proceedings for the closing up of the aforesaid private roads shall be had and taken under and in accordance with Chapter 76, page 70, Statutes of 1889 of the State of California, being an act entitled "An Act to provide for laying out, opening, extending, widening, straightening, or closing, up in whole or in part any street, square, lane, alley, court or place within municipalities, and to condemn and acquire any and all land and property necessary or convenient for that purpose," and amendments thereto. Section 4. The Street Superintendent shall cause to be conspicuously posted along the line of said con- templated work and improvement, at not more than three hundred (300) feet in distance apart, but not less than three in all, notices of the passage of this resolution, in the form and manner as required by law; he shall also cause a notice similar in substance, for a period of ten (10) days, to be published in the Anaheim Bulletin, a daily newspaper published and cir- culated and of general circulation in the City of Anaheim, Cal« - iforAia,- 'and',hereby designated for that purpose by the City Council, containing a statement of the fact of the passage of this Resolution of Intention, the date thereof, and briefly -2- I 1 and describing the work or improvement proposed, and referring 2 to this Resolution for further particulars. 3 Section 5.
