1 RESOLUTION OF THE CITY OF ANAHEI
2 WHEREAS, the City of Anaheim is the owner of that certain
3 real estate located in the County of Orange, State of California,
4 particularly described as follows:
5 PARCEL 1: Lots 11 and 15, Anaheim Investment Company's
Tract, in the County of Orange, State of California, as
6 shown on a map recorded in Book 7, pages 33 and 34, Mis-
cellaneous Maps, Records of Orange County; containing an
7 area of 19.99 acres. Subject to road and other reserva-
tions of record.

Reserving to the City a right -of -way ten feet in
9 width over and across said Lot 11 for the purpose of
maintaining, operating, repairing and reconstructing
10 thereon a sewer pipe line with necessary manholes and
other appurtenances, the center line of said right -of-
11 way being parallel with and 154 feet south of the north
line of said Lot 11; also reserving the right of ingress
12 and egress over lands adjoining said right -of -way, in
emergencies.

PARCEL 2: An undivided two - thirds interest in and to the
14 following described pump house site, including well, pump
house, pump, motor and other appurtenances located thereon:

A tract of land near the southeast corner of Lot 10
16 of said Anaheim Investment Company's Tract, particularly 1
described as beginning at a point on the west side of
17 Loara (or West Anaheim) Road, 64 feet north from the cen-
ter line of Crone Avenue; thence west 38 feet; thence
18 north 16 feet; thence east 38 feet; thence south along j
said west line of Loara Road 15 feet to the point of
1 beginning, to ether with ingress tnd eg ress over Lot 10 of said

20 WHEREAS, Carrie K. Graham is the owner of that certain real

in the County of Orange, State of California, as per map j
24 thereof recorded in Book 4, page 7 of Miscellaneous Mapp,
records of said Orange County, less that portion deeded
25 ;; for streets and the triangular piece East of Leon Street_
containing 22 acres, more or less;

28 ( That portion of said Lot 16 of the Miles Rancho
described as follows: Beginning at the intersection of
29 the West line of North Lemon Street and the Southwesterly
line of the State Highway; as said streets existed on June
30 I 25th, 1929; thence Southeasterly along the West line of
North Lemon Street a distance of 200 feet; thence Vest par -
31 alle1 to the South line of said Lot 16, 175 feet; thence
North parallel to the West line of said Lot to an intersec-

(b) That part of said Lot Seventeen (17) of Miles
Rancho described as follows: Beginning at a point on the
West line of said Section 3, which point is 30 feet North
of the Southwest corner of said Section; running thence
Forth along the West line of said Section 247.91 feet more
or less to its intersection with the Westerly line of North
Palm Street; thence Southwestwardly along said Westerly
line of North Palm Street 256.70 feet more or less, to its
intersection with the North line of West La Palma Avenue;
thence West along the North line of West La Palma Avenue
66.58 feet, more or less to the point of beginning, con-
taining approximately .19 of an acre.
(c) A strip of land 20 feet in width along the
Northerly line of LotsSeventeen (17) and a portion of
Lot Sixteen (16) of said :Miles Rancho as conveyed to the
City of Anaheim for widening North Los Angeles Street by
deed recorded May llth, 1934 in Book 675, page 7 Official
Records of said Orange County, and,
WHEREAS, said Carrie K. Graham has offered to exchange said
property owned by her for the above described property owned by
the City of Anahei_ma said property owned by Carrie K. Graham to be
subject to:
1. City and County taxes for 1935 -1936, not yet due,
2. Improv e t bond on Palm Street, in three (3) payments
of 564.g9�ther with interest thereon from July 1,1935,
3. City acqusition and improvement district # 1 bonds and
county acqusition and improvement district f 2 bonds;
the property above described owned by the City of Anaheim to be
subject to county taxes for 1935 -1936, not yet due; the City of
Anaheim to have the present crop now upon the trees located on
said property, and said property to be subject to a ten foot ease-
ment a4" the nort p of Lot 11 for sewer purposes; both prop-
erties to be free and clear of all encumbrances, except as herein-
above stated; the City of Anaheim having the right to remove the
oranges now upon said trees on
the City of Anaheim's property
until October 1, 1935, and if it is not feasible to market said
oranges by reason of any pro -rate or marketing agreement existing,
then the City of Anaheim to remove said oranges at the earliest
possible time, in accordance with any such pro -rate agreement and

marketing agency handling said fruit; all billboards, buildings
and materials now upon the property owned by Carrie K. Graham to
be removed by Carrie K. Graham by October 1, 1935; the City of
Anaheim having permission, however, to take possession of said
property at any tie after the recording of the deed, but said
City of Anaheim shall not interfere with the removal of the bill-
boards, buildings and materials now upon said property; said Carri
K. Graham to take possession of the property owned by the City of
Anaheim, for the purpose of spraying, fumigating, fertilizing,etc.
as may be required, but not to interfere with the removal by the
City of Anaheim of the fruit now upon said trees, the City of Ana-
heim, however, to water and cultivate said land until Septenb er 1,
1935, and,
WHEREAS, the City Council of the City of Anaheim deems it for'
the public interest and convenience, and for the benefit of the j
City of Anaheim that the City of Anaheim dispose of the property
owned by it, and hereinbefore described, and,

the public interest and convenience, and for the benefit of the
City of Anaheim, said property being proper for municipal purposes
that the City of Anaheim acquire the property hereinabove des -
cribed and owned by Carrie K. Graham, for municipal purposes;
IiUW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Anaheim that the City of Anaheim accept the proposal of
Carrie K. Graham for the exchange of the property above described,
owned by Carrie K. Graham, for the property of the City of Anaheim
above described, upon the terms and conditions above set forth.
BE IT FURTHER RESOLVED that it is for the public interest and
convenience, and for the benefit of the City of Anaheim, that the
City of Anaheim dispose of the property above described as owned
by the City of Anaheim.
BE IT FURTHER RESOLVES that it is for the public interest and

convenience, and for the benefit of the City of Anaheim, and said
property being proper for municipal purposes, that the City of
Anaheim acquire property above described as owned by Carrie K.
Graham,for municipal purposes.
BE IT FURTHER RESOLVED that the Mayor of the City of Anaheim
be and he is hereby authorized to execute, on behalf of the City
of Anaheim, such escrow instructions as may be necessary to carry
into effect the exchange of the property above described,upon the
terms above set forth, through the Abstract & Title Insurance Com-
pany, at Santa Ana, California, and the Clerk of the City of
Anaheim be and he is hereby authorized to attest the same.
BE IT FURTHER RESOLVED that the Tlayor of the City of Anaheim
be and he is hereby authorized to execute and acknowledge a grant
deed to the property above described as owned by the City of Ana -
heir. to Carrie K. Graham, and the Clerk of the City of Anaheimbe;a#dh
is hereby authorized and directed to attest the same.
BE IT FURTHER RESOLVED that the escrow in said matter be
handled by the Abstract & Title Insurance Company, at Santa Ana,
California, and that said company is instructed to close said
escrow .ihen the agreements hereinabove set forth on the part of
said Carrie K. Graham and said City of Anaheim have been complied
with.
BE IT FURTHER RESOLVED that each party shall furnish a guaran-
teed certificate of title to the other,and that each party shall pair
one -half (J) of the escrow charges.
