05/13/1930-015RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM, AUTHORIZING ASSIGNMENT OF GAS ENGINE
CONTRACT.
WHEREAS, the City of Anaheim, on or about the 12th day of
April, 1929, made and entered into a contract with the C. & G.
Cooper Company, wherein and whereby the City of Anaheim agreed
with the.,Z. & 0. Cooper Company to acquire a certain four hundred
(400) horsepower gas engine, together with auxiliary electrical
generating equipment, and by the terms of which contract, the
City of Anaheim agreed to pay the said C. & ""O.Cooper Company
the sum of $27,500.00, which payments were to be made from savings
in the cost of energy to be produced by the operation of said gas
engine and generating equipment over the cost of energy to be
produced when purchased by the City of Anaheim from the Southern
California Edison Company, and,
WHEREAS, the City of Anaheim has operated said engine for a
. 2eriod of several months, and said gas engine cannot be operated
by said City of Anaheim at a saving, but, on the contrary, the
operation of said gas engine by said City of Anaheim can only be
operated at a. loss under the prevailing rates approved by the
Railroad Commission of the State of California, -&" the City of
Anaheim can purchase energy from the Southern California Edison
Company, and,
WHEREAS, the operation of said engine by said city causes
g-7eat vibrations of the earth to take place, which vibrations dis-
turbed the comfort of the citizens of Anaheim living in the
close proximity to said gas engine, and,
WHEREAS, the City Council of the,;City of Anaheim deemmc %.�yit for
the public interest that said gas engine be not operatedA and,
WHEREAS, the Southern California Edison Company has made an
offer to purchase the right, title and interest of the City of
Anaheim in and to the aforesaid contract with the said C. & G.

Cooper Company, and,
WHEREAS, by said offer, the said Southern California
Edison Company agreed to pay to the City of Anaheim the sum of
Fifteen Thousand ($15,000.00) Dollars to reimburse the City of
Anaheim for wney expended by the City of Anaheim in the
installation of said engine and in the cost incurred by said
City of Anaheim in the operation of said amine, together with
the cost of litigation, and said Southern California Edison
Company, having expressly agreed in said offer that the C. & G.
Cooper Company may remove said engine and terminate the afore-
said contract of said City of Anaheim with said C. & G. Cooper
Company within sixty (60) days, and,
WHEREAS by said offer, the Southern California Edison
Company has agreed to furnish the City of Anaheim electric energy
for a period of ten (10) years under Schedule designated as
"Schedule P -2
NOW, THEREFORE, BE IT RESOLVED by the City Council Of the
city of Anaheim that the offer of the Southern. California
Edison pompany,dated y'12th, 1930, for the assignment of said
contract between the City of Anaheim and the C. & G. Cooper
Company, dated April 12th, 1928, upon the terms above
mentioned, be and the same is hereby accepted.
BE IT FURTHER RESOLVED that the Mayor of the City of
Anaheim be, and he is hereby authorized to exeeute,in the name,
of the City of Anaheim a rcontraot asstgnmeAt. tom said Southets
California Edison Company the aforesaid contract, with the C. &
G. Cooper Company, and hp is further authorized to enter into
said contract wherein the City of Anaheim agrees to purchase from
the Southern California Edison Company electric energy to be used

BE IT FURTHER RESOLVED that the Mayor and the City Attorney
of the City of Anaheim be, and they are hereby instructed to
cause the complaint heretofore filed by the City of Anaheim
against the Southern California Edison Company before the Railroad
Commission of the State of California to be dismissed.
The foregoing Resolution is signed and approved by me
this 13th day of May, 1930.
