06/10/1930-024IN THE MATTER OF ACQUISITION AND IMPROVEMENT DISTRICT NO. TWO OF THE CITY OF ANAHEIM. RESOLUTION ORDERING ISSUANCE OF BONDS TO OBTAIN IMMEDIATE POSSESSION WHEREAS, on the 27th day of May, 1930, this City Council adopted a resolution fixing a time and place for hearing upon the issuance of bonds against the lands in the Assessment District in Acquisition and Improvement District No. Two of the City of Anaheim, for the purpose of obtaining the amount required by the oourt in order that immediate possession and use of the public Ways sought to be acquired may be had, and for the purpose of furnishing an opportunity to all persons inter- ested to be heard upon any of the matters upon Which they are given the right to be heard and present objections under Section 28 of the Acquisition and Improvement Act of 1925, and WHEREAS, at the time and -place so fixed, the said matter Was regularly called for hearing and no objection, either Written or oral, having been made to the issuance of,said bonds, or as to any of the previous proceedings, acts or determinations of this Council in said proceeding, and this Council having fully considered said matter, and WHEREAS, it appears from affidavits on file With the Clerk of this Council that notice of said hearing has been duly and regularly published and posted as ordered and as required by law; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Anaheim finds, determines and orders as follows, to -Wit: 1. That notice of the day, hour and place ofthe hearing upon the issuance of bonds for the purposes above stated has been duly and regularly published and posted in the manner required by law. 2. That all of the acts, determinations and proceedings hereto'nre had and taken in the matter of Acquisition and Improvement District No. Two of the City of Anaheim are regular and in all respects sufficient, and that no protests ox objections aegarding the same or to the issuance of said bonds have been presented to this City Council. _1_ 3. That the public necessity and convenience require and it is hereby ordered that bonds of the said District shall be issued in the total sum of Thirty -Mine Thousand, Two Hundred Seventy -Four and 85/100 ($39,274.85) Dollars, for the purposes above recited, and the City Treasurer of the City of Anaheim is hereby ordered to issue bonds of the said District, designated "Series AN, in the said aggregate prin- cipal sum, dated the day this resolution is adopted, all in the manner and form provided in the Acquisition and Improvement Act of 1925 and in further aecordan od with the progisions for such bonds contained in the Resolution of Intention adopted in the matter of said Acquisition and Improvement District by this City Council on the 22nd day of April, 1930, 4. That the Clerk of this City Council shall forthwith transmit to said City Treasurer an attested apy of this resolution and order, together with an attested copy of said Resolution of Intention.
