OF THE CITY OF ANAHEIM
RESOLUTION FIXING TIME FOR HEARING UPON PROPOSED
ISSUANCE OF BONDS TO OBTAIN IMMEDIATE POSSESSION.
WHEREAS, in a Resolution adopted by the City Council of the
City of Anaheim on the 13th day of May, 1930, in the Matter of
Acquisition and Improvement District No. 2 of the City of Anaheim,
the acquisition of lands for the widening of West Center Street from
Palm Street to Nest Street in said city to a uniform width of eighty -
nine and five - tenths (89.5) feet, being forty -four and seventy -five
hundredths (44.75) feet on each side of the established center line
of said street, with additional widening at the northeasterly corner
of said Center and Test Streets to improve the traffic lane to Lincoln
Avenue, a public street in said City, as proposed in the Resolution
of Intention in the above entitled matter, adopted on the 22nd day
of Aptil, 1930, was ordered, and Geo. F. Holden, Attorney of the City
of Anaheim and attorney for said Acquisition and Improvement District
No. 2, was ordered to bring an action for the condemnation of the
property necessary therefor, and to report to this City Council the
amounts of money required for the purpose of obtaining immediate
possession and use of the property so sought to be acquired; and,
WHEREAS, the said Geo. F. Holden, Attorney, has reported to
this City Council that an action in eminent domain has been riled
in
in the Superior Court of the State of Californi&, and for the County
of Orange, said action being entitled: "City of Anaheim, a 'Municipal
Corporation of the Sixth Class of the State of California, Plaintiff,
vs. Janss Investment Corporation, a corporation, et al., Defendants ",
being Superior Court case No. 26421, and that proof was presented to
the said Court of the amounts of money required to secure immediate
possession of the lands sought to be oondemned, and tkt the said Court
made an Order directing the deposit of money to secure payment of

compensation to defendants in said action, and that the total
amount required for deposit in Court in order to obtain immediate
possession of said property, as set forth in said Order of Court,
is the sum of Thirty Nine Thousand, Two Hundred Seventy -Four and
Eighty -Five Hundredths ($39,274.85) Dollars, and,
WHEREAS, it is the intention of this City Council to order
that bonds of said district be issued and sold for the purpose of
obtaining the necessary money to deposit in Court in order to
secure said immediate possession and use of said property,
NOW, THEREFORE, be it RESOLVED by the City Council of the City
of Anaheim as follwws, to -wit:
1. That Tuesday , the 10th day of June ,
1930, at the hour of 8 o'clock P.M., is the time, and the
chambers of the City Council of the City of Anaheim, in the City Hall,
in the City of Anaheim, is the place, hereby fixed for a hearing upon
the issuance of bonds against the lands in the assessment district in
Acquisition and Improvement District No. 2 of the City of Anaheim,
for the purpose of obtaining the amounts required by the Court,to -wit:
amounts totaling the sum of Thirty Nine Thousand, Two Hundred Seventy -Four
and Eighty -Five Hundredths ($39,274.85) Dollars, in order that immediate
possession and use of the public ways sought to be acquired under the
proceedings in the above entitled matter may be had, and for the purpose
of furbishing an opportunity to all persons owning lands within the
said assessment district, or otherwise interested, and feeling aggrieved
by any act or determination done or made in the said proceeding, or
claiming that any of the previous acts, determinations or proceedings
are irregular, defective, erroneous or faulty, or having any ob4sotions
to offer, or any reason to advance why bonds should not be issued in the
amount above set forth, for the purposes above set forth, to appear
before this City Council, and be heard upon any of the above mentioned
matters. Said bonds, so proposed to be issued in the sum of Thirty
Nine Thousand, Two Hundred Seventy -Four and Eighty -Five Hundredths
($39,274.85) Dollars, will be issued under and in pursuance of the

Provisions of the *Acquisition and Improvement Act of 1925H, and
shall bear interest at the rate of six per cent (6%) per annum,
payable semi - annually, and the aggregate principal of all bonds issued
shall be paid and discharged within twelve (12) years after the date of
issuance, approximately one -tenth (1J10tht part of such aggregate prin-
cipal to be payable annually beginning three (3) years after date of
issuance, all in gold coin. A special fund for the payment of said
bonds will be constituted by the levy of special assessment taxes upon
the lands within the assessment district, according to the assessed
value of said lands, (exclusive of the improvements thereon) and in
accordance with the zones and percentages as finally determined by this
City Council on the 13th day of May, 1930, and as more fully set forth
in the Resolution of Intention in the above entitled matter adopted by
said City Council on the 22nd day of April, 1930,
2. The City Clerk of the City of Anaheim shall prepare and sign
a Notice of the above mentioned haring, and shall cause the same to
be published by at least two insertions in the newspaper designated
in said Resolution of Intention, and a copy of said Notice shall be
posted, and kept pouted for at least two days on or near the chamber
door of this City Council.
The foregoing Resolution Fixing Time for Hearing upon Proposed
Issuance of Bonds to Obtain Immediate Possession is hereby approved,
signed and attested this 27th day of May, 1930.
