IN T'HE MATTER OF ACQUISITION AND
Ih'IJROVEIMENT DISTRICT NO. 2 OF THE CITY OF ANAHEIM.
RESOLUTION ORDERING ACQUISITION.
WHERFAS, at the time, place and in the manner set forth in Resolution
of Intention No. 218, adopted by this City Council on the 22nd day of April,
1930, in the matter of Acquisition and Improvement District No. 2 of the
City of Anaheim, a full, fair and impartial hearing was accorded all persons
having any objections to those things roposed to be done, as set forth in
said resolution; and 11
WEEP AS, this City Council has adopted its resolution passinc upon all
protests presented, both written and oral, and has made its determinations
as to the extent of the assessment district, and as to the zones and per-
centages proposed; and
RE,AS, evidence has been received as to the publication of said res-
olution of intention and the posting of the notice of public improvement
therein ordered posted, at the time and in the manner prescribed by law, and
as to the necessity for the acquisitions contemplated, and the benefits to
be derived therefrom;
NOW, TMEFORE, RE IT RESOLVED, by the City Council of the City of
Anaheim, that it is hereby found, determined and ordered, follows:
1. That the said Resolution of Intention No. 218 heretofore adopted on
the 22nd day of April, 1930, has been duly and legally published as required
by law, and that the notice of public improvement therein directed to be
posted has been duly and legally posted in the time,fform, manner and number
as required by law, and that all protests or objections presented have been
disposed of in the time, formoand manner as required by law, and that this
legislative body has now acquired jurisdiction to order the things proposed to
be done as set forth in said resolution of intention.
2. That the public interest and necessity require and it is hereby order-
ed that the following acquisitions for the widening of West Center Street from
Palm Street to Vest Street in said City be made;- all property necessary to
be taken to widen said street to a uniform width of eighty -nine and five tenths
(89.5) feet, being forty -four and seventy -five hundredths (44.75) feet on each
side of the established center line of said street, with additional widening
at the northeasterly corner of Said Center And West Streets to improve the ;"
traffic lane to Lincoln Avenue, all as set forth and described in said Resolution
of Intention No. 218, and in the specifications therein referred to, and that
the property necessary to be taked for such acquisition, and which is hereby
ordered to be acquired therefor, is that described in Section 2 of said resolution
of intention.
3. That the boundaties of the assessment district, the zones into which
said district shall be divided, and the percentages to be raised from each of
said zones, shall be those set forth in the said resolution of intention, and
in the specifications therein referred to, reference to which is hereby made.
4. That George F. Holden, the attorney for said Acquisition and
Improvement District No. 2, is hereby ordered to continue the action in the
above named matter brought on the 3th day of December, 1929, in the name of
the City of Anaheim, being Case No. 26421 in the Superior Court of the State
of California, in and for the County of Orange, by amending the complaint in
said action for the condemnation of the property necessary to be taken for the
acquisition ordered herein and described in Section 2 of said Resolution of
Intention No. 218, and to prosecute said action to final determination.
5. That the public interest and convenience.require and it is hereby
ordered that the City of Anaheim, plaintiff' in the said condemnation action,
take Uumediate possession and use of the property herein ordered to be $squir-
ed, upon complying with the requirements of law applicable thereto, and that
the said City Attorney report to this City Council the amounts of money re-
quired therefor as soon as the same can be ascertained.
6. That, to defray the expenses of the acquisitions herein ordered,
bonds will be issued to the toa.l amount of the same; said bonds to hear inter-
est at the rate of six(6) per cent anmr�, payable semi - annually, the aggregate
principal of all bonds issued to be paid and discharged within twelve(12)
years after the date of issuance, approxit ately one -tenth part of said aggregate
principal to be paid annually beginning three (3) years after the date of
issuance, all in gold coin, and that a special fund for the payment of said
bonds will be constitutid by the levy of special assessment taxes upon the
lands within the assessment district, according to the assessed value of
said lands (exclusive of the improvements thereon), and in accordance with
the zones and percentages, as said assessment district, zones and percentages
are set forth in said resolution of intention.
7. That the proceedings for said acquisition shall be had and taken
under and in accordance with an Act of the Legislature of the State of
California, known and designated as the "Acquisition and Improvement Act of
1925," approved May 23, 1925, and amendments thereto and said bonds shall
also be issued in accordance with the provisions of said Act.
The foregoing resolution is approved and sued this 13th. day of
May, 1930.
