IN THE MATTER OF ACQUISITION AND
IMPROVEMENT DISTRICT NO. 3 OF THE CITY OF ANAHEIM.
RESOLUTION ORDERING ACQUISITION,
WHEREAS, at the time, place and in the manner set forth inthe
Resolution of Intention adopted by this City Council on the 14th
day of January, 1930, in the matter of Acquisition & Improvement
District No, 3, of the City of Anaheim, a full, fair and impartial
hearing was accorded all persons having any objections to those
things proposed to be done, as set forth in said resolution; and
WHEREAS, this City Council has adopted it* resolution passing
upon al rotests presented, both written and oral, and has made
its det rminations as to the extent of the assessment district, and
as to the zones and percentages proposed; and
WHEREAS, evidence has been received as to the publication of
said resolution of intention and the posting of the notice of public
improvement therein ordered posted, at the time and in the manner
prescribed by law, and as to the necessity for the acquisitions con-
templated, and the benefits to be derived therefrom;
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City
of Anaheim, that it is hereby found, determined and ordered as follows;
1. That the said Resolution of Intention No. 216, heretofore
adopted on the 14th day of January, 1930, has been duly and legally
published as required by law, and that the notice of public improvement
therein diredted to be posted has been duly and legally posted in the
time, form, manner and number as required by law, and that all protests
or objections presented have been disposed of in the time, form and
manner as required by law, and that this legislative body has now ao-
quired jurisdiction to order the things proposed to be done as set forth
in said resolution of intention.
2. That the public interest and necessity require and it is
hereby ordered that the acquisition be made of a strip of land twenty
(20) feet in width along and adjoining the present north line of Lincoln
Avenue, from the westerly line of North West Street to the west city
boundary line, in the City of Anaheim, in order to widen said avenue to
a uniform width of eighty (80) feet, all as set forth and described in
daid Resolution of Intention, No. 216 and in the specifications therein
referred to, and that the property necessary to be taken for such aoquisi-
tion, and which is hereby ordered to be acquired therefor, is that de-
scribed in Section 2 of said resolution of intention.
3. That the boundaries of the assessment district, the zonws into
which said district shall be divided, and the percentages to be raised
from each of said zones, shall be those set forth in the Resolution
Passing upon Protests and Making Final Determinations as to Boundaries,
Zones and Percentages iii the matter of Acquisition and Improvement
District No. 3, passed and adopted by this City Council on the 11th day
of February, 1930, reference to which is hereby made.

hah George F. Holden, the City Attorney of the City of
Anahe i 1, is ereby ordered to bring an action in the name of the
City of Anaheim in the Superior Court of the State of California,
in and for the County of Orange, for the condemnation of the property
necessary to be taken for the acquisition herein ordered and described
in Section 2 of said resolution of intention, and to do all things
necessary to prosecute said action to final determination.
5. That the public interest and convenience require and it is
hereby ordered that the Cityof Anaheim, plaintiff in the said
condemnation action, take immediate possession and use of the
property herein ordered to be acquired, upon complying with the
requirements of law applicable thereto, and that the said Ctty
Attorney report to this City Council the amounts of money required
therefor as soon as the same can be ascertained.
6. That, to defray the expenses of the acquisition herein
ordered, bonds will be issued to the total amount of thesame; said
bonds to bear interest at the rate of six (6) per cent payable
semi - annually, the aggregate principal of all bonds issued to be
paid and discharged within twelve (12) years after the date of
issuance, approximately one -tenth part of said aggregate principal to
be paid annually beginning three (3) years after the date of issuance,
all in gold coin, and that a speciaal *und for the payment of said bonds
will be constituted by the levy of �sppecial assessment taxes upon the
lands within the assessment district, according to the assessed
value of said lands (exclusive of the improvements thereon), and in
accordance with the zones and percentages, as said assessment distric 't,
zones and percentages are set forth in said resolution of final
determination referred to in Section 3 hereof.
7. That the proceedings for said acquisition shall he had and
taken under and in accordance with an Act of the Legislature of the
State of California, known and designated as the "Acquisition and Im-
provement Act of 1925," approved May 23, 1925, and amendments thereto,
and said bonds shall also be issued in accordance with the provisions
of said Act.
The foregoing resolution is approved and signed this llth day of
February, 1930.
