6 WHEREAS, in a Resolution adopted by the City Council of the

Street to West Street in sadd city to a, uniform width of eighty-
nine and five-tent',-Ls (89.5) feet, being forty-four and seventy-
five hundredths (44.75) feet on each side of the established cente
line of said street, rith additional widening at the northeasterly
corner of said Center and 'West Streets to improve the traffic lane
to Lincoln Avenue, a public street in said City, as proposed in
the Resolution of Intention in the above enticed matter, adopted
on the 22nd day of , M,gust, 1929, - mas ordered, and Geo. F. Holden,
Attorney of the City of Anaheim, vi:as ordered to bring an motion
for the condemnation of the property necessary therefor, and to
report to this City Council the amounts of money required for the
purpose of obtaining imziiaediate possession and use of the property
.so sought to be acquired; and,
WHEREAS the said Geo. F. Holden Attorney, has reported to
this City Council that an action in eminent domain has been filed
in the Superior Court of the State of California, in c.nd for the
County of Orange, said action being entitled: "City of Anaheim,
a la=ici Corporation of t1ae Sixth Class of the State of Cali-
fornia, Plaintil"' f, vs. Janss Investment Corpr)ration, a corporation,
et al.1?efendants", being Superior Court case No. 26421, and that
proof was presented to the said Court of the amounts of money re-
quired to secure immediate possession of the lands sou6ht to be
condemned, and that the said Court made an Order directing the

secure payment
of compensation
to
defendants

action,
and
that the total
amount required
for
deposit in
3 Court in order to obtain immediate possession of said property, as
4 set forth in said Order of Court is the sum of Thirty Nine
5 Thousand, Tiro Hundred Seventy-Four and Eighty-Five (439,274.85)
6 Dollars, and,

WHEIREAS $
it is the intention of this City Council to order
8 that bonds of said district be issued and sold for the purpose of
9 obtaining tlae necessary nioney to deposit in Court in order to
10 secure said immediate possession and use of said property,
11 NOVI - BE IT RESOLVED by the City Council of the
12 City of Anaheim as followp, to-wit:

15 and the chambers of the City Council of the City of Anaheim, in
16 the City Hall, in the City of Anciheim, is the place, hereby fixed

for a hearing upon t issuance of bonds against the lands in the
P.ssessment district in Acouisition District No. 2 of the City of
Anaheim, for the purpose of obtaining the amounts required by the
Court, to-vit: amounts totaling the sum of Thirty Nine Thousand,
Two Hundred Seventy-Four and Eighty-Five ($39,274.85) Dollars, in
order that immediate possession and use of the public ways sought
to be accuired under the proceedings in the above entitled natter
may be had, and for the purpose of furnishing an opportunity to al
persons ol lan�,.s within the said assessment district, or
otherwise interested, and feeling aggrieved by any act or deter-
mination done or made in the said proceeding or claiming that any

of the - -revious acts determinations or proceedings are irregular,
defective, erroneous or faulty, or having any objections to offer,
or any reason to advance thy bonds should not be issued in the
amount above set forth, for the purposes above set forth, to appea
before this City Council, and be aeard u any of the above

mentioned matters. Said bonds, so proposed to be issued in the
sum of Thirty Nine Thousand, Two HundredSeventy -Four and Eighty -
Five (939,274.85) Dollars, will be issued under and in pursuance
of the provisions of the "Acquisition and Improvement Act of 1925 "
and shall bear interest at the rate of six per cent (6 %) per annum,
payable semi - annually, and the aggregate principal of all bonds
issued shall be paid and discharged within twelve (12) years after
the date of issuance, approximately one -tenth (1 /10th) part of
such aggregate principal to be payable annually beginning three
(3) years after date of issuance all in gold coin. A spedal fund
for the j
payment of said bonds will be constituted by the levy of
special assessment taxes upon the lands within the assessment
district, according to the assessed value of said lands, (exclusive
of the improvements thereon) and in accordance with the zones and
percentages as finally determined by this City Council on the 24th
day of September,1929, and as more fully set forth in the Resolution
of Intention in the above entitled matter adopted by said City
Council on the 22nd day of August, 1929.
2. The City Clerk of the City of Anaheim shall prepare and
sign a Notice of the above mentioned hearing, and shall cause the
same to be published by at least two insertions in the newspaper
designated in said Resolution of Intention, and a copy of said
Notice shall be posted,and kept posted for at least two days on
or near the chamber door of this City Council.
The foregoing Resolution Fixing Time for Waring upon Proposed
Issuance of Bonds to Obtain Immediate Possession is hereby
approved, signed and attested this 14th day of Januaxv 1930.
