A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM FOR EXCEPTION TO THE 180-DAY WAIT
PERIOD IN COMPLIANCE WITH SECTIONS 7522.56 AND
21224 OF THE CALIFORNIA GOVERNMENT CODE
WHEREAS, in compliance with Government Code Section 7522.56 the City
Council of the City of Anaheim must provide Ca1PERS this certification resolution when hiring a
retiree before 180 days has passed since his or her retirement date; and
WHEREAS Government Code Section 21221(h) of the Public Employees'
Retirement Law permits the governing body to appoint a Ca1PERS retiree to vacant position
requiring specialized skills during recruitment for a permanent appointment, and provides that
such appointment will not subject the retired person to reinstatement from retirement or loss of
benefits so long as it is a single appointment that does not exceed 960 hours in a fiscal year; and
WHEREAS, Dawn Hernandez retired from the City of Anaheim in the position of
Senior Police Dispatcher, effective December 3, 2025; and
WHEREAS, Section 7522.56 requires that post -retirement employment commence
no earlier than 180-days after the retirement date, without this certification resolution; and
WHEREAS, Section 7522.56 provides that the exception to the 180-day wait period
shall not apply if the retiree accepts any retirement -related incentive; and
WHEREAS, the City Council of the City of Anaheim and the City of Anaheim
Human Resources Department has not and will not provide any other retirement -related incentive;
and
WHEREAS, the City Council of the City of Anaheim hereby appoints Dawn
Hernandez as a retired annuitant to perform the duties of the Senior Police Dispatcher for the City
of Anaheim under Government Code Section 21224, effective February 25, 2026; and
WHEREAS, the appointment of Dawn Hernandez and the City of Anaheim has
been reviewed by this body; and
WHEREAS, no matters, issues, terms or conditions related to this employment
exist and the appointment has been or will be placed on the business calendar (off -consent); and
WHEREAS, the employment shall be limited to 960 hours per fiscal year; and
WHEREAS, the hourly rate paid to Dawn Hernandez will be $52.11; and
WHEREAS, Dawn Hernandez has not and will not receive any other benefit,
incentive, compensation in addition to this hourly pay rate; and
THEREFORE, BE IT RESOLVED THAT the City Council of the City of Anaheim
hereby certifies the nature of the appointment of Dawn Hernandez as described herein and that this
appointment is necessary to fill the critically needed position of Senior Police Dispatcher for the
City of Anaheim by February 25, 2026.
THE FOREGOING RESOLUTION is approved and adopted by the City Council
of the City of Anaheim this 2 4 day of February 2026, by the following roll
call vote:
