A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM VACATING A PORTION OF A PUBLIC SERVICE
EASEMENT LOCATED AT 7581 EAST COUNTRY HILL LANE
PURSUANT TO CALIFORNIA STREETS AND HIGHWAYS CODE
SECTION 8330, ET SEQ. — SUMMARY VACATION. (ABA2025-00442)
WHEREAS, the City of Anaheim ("City") holds a public service easement ("Public Service
Easement") generally located at 7581 East Country Hill Lane, in the City of Anaheim, County of
Orange, State of California, for public utility, sanitary sewer, ingress and egress for maintenance and
emergency vehicle purposes;
WHEREAS, an applicant has requested the vacation of a portion of the Public Service Easement in
order to clear title to the land;
WHEREAS, except for certain water utility purposes, the Public Service Easement has not been used
for the purpose for which it was dedicated or acquired for five consecutive years immediately preceding
the proposed vacation;
WHEREAS, except for certain water utility purposes, the Public Service Easement is not necessary
for present or prospective public utility purposes or any other public purpose; and
WHEREAS, the portion of the Public Service Easement to be vacated is determined to be excess.
NOW, THEREFORE, the City Council of the City of Anaheim hereby resolves as follows:
1. The Public Service Easement recorded December 20, 1991, as Instrument Number 91-701138,
Official Records of Orange County (now records of the Recorders Office of said County of
Orange), is ordered to be partially vacated as described in Exhibit A and shown in Exhibit B,
both of which are attached hereto and incorporated by reference.
2. As described in Exhibit A and shown in Exhibit B, the City of Anaheim excepts from the
vacation, and reserves for the City of Anaheim, a portion of the existing Public Service Easement
marked as "Easement Reservation" in Exhibit B on the westerly and southerly boundaries of Lot
2, and which is an easement for public water utilities in, on, over, under, above, along, and across
the entirety of the Easement Reservation, together with all rights of ingress and egress (with or
without vehicles, machinery, and equipment), for the construction, installation, operation,
inspection, maintenance, repair, replacement, relocation, reconfiguration, and removal of any
present or future public water utilities facilities, equipment, fixtures, and appurtenances.
3. The Public Service Easement in the Easement Reservation remains in full effect such that the
City maintains the right to prevent activity on or use of the Easement Area and Easement
Reservation that: (a) is inconsistent with the purposes of this easement; (b) interferes with or is
harmful to the City's rights herein; or (c) interferes with or is harmful to the City's facilities; and
the City maintains the obligation to backfill to grade, pay reasonable costs of removal, repair or
restoration, of grass or asphalt only within the Easement Area and Easement Reservation
affected by work performed by the City in furtherance of the City's rights as the easement
holder.
4. The City Council of the City of Anaheim makes this vacation pursuant to the requirements of the
California Streets and Highways Code, Division 9, Part 3, Chapter 4.
5. The vacation authorized by this Resolution shall not be effective until a certified copy of this
Resolution is recorded in the Office of the Recorder of the County of Orange, California.
6. The City Clerk is authorized and directed to cause a certified copy of this Resolution to be
recorded in the Office of the Recorder of the County of Orange, California.
7. From and after the date the certified copy of this Resolution is recorded in the Office of the
Recorder of the County of Orange, the vacation shall be complete, and the vacated portion of the
Public Service Easement shall no longer constitute a public service easement of the City of
Anaheim.
THE FOREGOING RESOLUTION is approved and adopted by the City Council of the City of
Anaheim this 24 day of February , 2026, by the following roll call vote:

of Lot 2 in the City of Anaheim, County of Orange, State of California, as described in Lot Line Adjustment No. 358,
recorded on October 11, 1996 as Instrument No. 19960518764 of Offical Records, in the office of the County
Recorder of said County.
Containing 16,988 square feet, more or less.
EXCEPTING AND RESERVING THEREFROM the Vacation the westerly 21.00 feet of the southerly 26.00 feet of
said Lot 2, a public utility easement for water purposes.
Containing 556 square feet, more or less.
