3 RESOLVED by the Board. of Trustees of the City of Anaheim
4 SECTION 1. That the ?public interest and convenience
5 require that the following described street work be done in said
6 city, to -wit:
7 First. That the roadway of Porth Clementine Street in said

8 city from the southerly property line of West Cypress Street,
9 produced westerly across the roadway of North Clementine Street
10 to a line nroduc ed westerly across the roadway of said North
11 Clementine Street, said line being; parallel to and forty -four and
12 seventy -five hundredths (44.75) feet northerly from the center
13 sine of West Center Street (excepting therefrom that portion of
14 the roadway of ?forth Clementine Street lying between the norther -
15 l7 f r f hest Chartres Street produced
, and southerly property lines o..
16 , Pesterly across the roadway of said North Clementine Street), be
17 graded to the official grade and raved with hydraulic concrete baE
18 and with asphaltic wearing surface.
19 Second. That the roadway of South n lenentine Street in said

city, from a line produced westerly across the roadway of said

.Routh Clementine Street, said line being parallel to and distant

southerly forty -four and :seventy -five hundredths (44.75) feet

from the center line of West Center Street, to the northerly

property line of West Broadway Street, produced westerly across

the road-vay of said South r;lementina Street (excepting therefrom

roadway of said South Clementine Street.), be graded to the
official grade and paved with 4ydraulic concrete base and with
asphaltic wearing surface.
SECTION 2. Said work shall be done in accordance with
the plans, profiles, and specifications therefor, which said plans
and profiles were adopted by the Roard of Trustees of . the City of
Anaheim, by resolution on the 27th day of April, 1922, are number-
ed "14 and =e marked and designated "Plan of rroposed improve-
ments on Olementine Street, Anaheim calif.," and acre on file in
the 'office of the City Engineer of said City, and which said
specifications were adopted by the Board of Trustees of the City
of Anaheim by resolution on the 28th day Of July, 1921, and which
said specifications are marked and designated "specifications No.
26 for the construction of street paving with hydraulic concrete
base and asphaltic wearing surface in the City of Anaheim,
California," which said specifications are on file in the office
of the City Clerk of the City of Anaheim.
SECTION 3. That the City Clerk of the City OIL Anandim be
and he is hereby authorized and directed to rublish for at least
two weeks, in the Orange County Plain Dealer a newspaper of
general circulation, ]printed, published, and circulated in said
city, a notice inviting; sealed n---Oposals or bids for the furnish-
ing of all labor and materials for the doing of said work in
accordance with said plans and specifications which said Pro-
posals or bids shall be received eceived by the Roard of Trustees of
the City of Anaheim, at the office of the City Clerk of the said
city, up to eight o'clock P. if . of Thursday,, the /j4 day of

and the Board

reserves the right to
reject any and
all
bids.
SECTIOP 4. All proposals or bids must be accompanied
by a check payable to the City of Anaheir., certified by a
responsible bank., for an amount which shall not be less than ten
per cant of the aggregate amount of the proroaal, or a bond for
the said amount so - payable, signed by the bidder and two sureties,
who shall justify before any officier competent to administer an
oath, in double the said amount, over and above all statutory
exemptions., or by a corporate surety as provided by law, said
check or bond tonecome forfeited to the City of Anaheim in the
event that the successful bidder shall fail to enter into a
contract for the doing of said work, and furnish the bonds
required within ten days after the contract is awarded to him.
SECTIOV 5. The successful bidder shall, within ten days
after the contract is awarded to him, file with the Board of
Trustees of the City of Anaheim, a bond for an amount which shall
not be less than fifty per cant of 'the aggregate amount of the
contract Arica, for the furnishing of said materials and the doing
of said work,, payable to the City of Anaheim and signed by the
bidder, and at least two sureties who shall justify before any
officer competent to administer an oath in double the said amount.,
over and above all statutory exemptions., or by a corporate surety,,
as provided by law, which said bond shall be subject to the
approval of the Poard of Trustees of the City of Anaheim, and shal
be conditioned upon the faithful performance of said contract.
The successful bidder shall likewise, within ten days
after the contract is awarded to hin^., and before entering upon the
performance of said work, file with the City 111ark of the City of
Anaheim, a good and sufficient bond, to be approved by the Board
of Trustees of the City of Anaheim, in a sum of not less than one-
1 half of the total amount payable by the terms Of said contract,
2 which said 'bond shall be e.-cecuted by the contractor, and either
3 at least two sureties) or by a corrorate surety as provided by
4 law, in an amount not less than the sum specified in the bond, and
5 must provide that if the contractor, person, company, or corpora-
6 tion, or his or its subcontractor fails to Pay for any materials,
7 provisions, provender,, or other surplies or teams used in, OLpon
a for, or about trhe performance of the work contracted to be done,
9 or for any work or labor done thereon, of any kind, that the
10 sure o r sureties will pay the sane in an amount not exceeding
11 U
the sum specified in the bond, and also in case sui is brought
12 upon such bond, arewonable attorney's fee to be fixed by the
13 court.
14 NOTION G. The wor' herein referred to and described,,
15 must be done and completed by the contractor within
16 days after the execution of the contract by
17 the parties hereto., and the approval of said bond by the Roard
18 of Trustees of the City of Anaheim.
19 SECTION 7. The time of service of any workman, laborer,
20 or mechanic employed upon any of the work herein described, shall
21 be limited and restricted to eight hours during any one calendar
22 day, andthe contractor sha-L.L forfeit as a penalty to the City
23 df Anaheim, ten dollars, for each laborer, workman, or mechanic
24 empl6yed by hin' in the execution of said contract or for any
25 subcontractor under him, upon any of said work herein referred
26 to or described., f or each calendar day during which such laborer,
27 workman, or mechanic is required or nermitted to labor more than
28 eight hours in violation of the -provisions of Section 653 0 of
29 the Penal Code of the State of California.
30 3ECTIOV B. The r-Animurri compensation to be paid for
31 labor upon all work -erforned under and pursuant to the terms of
32 said contract shall be the sum of Two Dollars per day-1

SECTION 9. The contractor shall at all times during the
progress of the work contracted for, and at his own cost and
expense, carry sufficient insurance, evidenced by policies issued
and executed by some reliable cor-,=ation thereunto duly authorize
by the la Ts of the State of California, or by the State Cornren-
sation Insurance Fund of the State of California, to indemnify
and hold harmless, hiri and the City of knaheim from and
against all claims for damages arising out of the death or injury
sustained in the course of his employment by any workrian,laborer,
or er.-�ployae, employed upon the work contracted to be done., and
shall at all times during the progress of such work, keep on file

with the City Clerk of such city, satisfactory evidence that such
insurance is in full force and effect.
The foregoing resolution was gassed and adopted at a
regular meeting of the Board of Trustees of the City of Anaheim
and was signed and approved and attested by me this 10th day of
August, 1922.
