FS901VED by the Board of Trustees of the City of Anaheim:
sECTION 1. That the public interest and convenience require
that the .following described street work be done in said city,
to -wit: That the following described street intersections be grad-.
e d to the official grade and paved with hydraulic concrete base
and with asphaltic wearing surface.
That those certain intersections of said public streets which
are herein referred to are described as follows, to -wit: The in-
tersection of East Chartres Street and Forth Emily Street in said
city; the intersection of ,East Chartres Street and North Claudina
Street in said city; the intersection of West Chartres Street and
?orth Clementine Street in said city; the intersection of West
Chartres Street and North Helena Street in said city; as shown oni
the plans and profiles hereinafter referred to.
sr CTI()N 2. Said work shall be done in accordance with the
plans, profiles, and specifications therefor, which said plans
and profiles were adopted by the Board of Trustees of the City of
Anaheim, by resolution on the 12th day of January, 1922, and are
marked and designated "Flans for paving intersections on East and
West Chartres Street" and are on file in the office of the City
Engineer of said city, and which said specifications were adopted
by the Board of Trustees of the City of Anaheim, by resolution on
the 28th day of July, 1921, and are marked and designated "Speci-
fications No. 26 for the construction of street paving with hy-
draulic concrete base and asphaltic wearing surface in the City
of Anaheim, California, and which are an file in the office of
the City Clerk of the City of Anaheim.
SECTION �. That the City Blerk of the Cjty of Anaheim be,
and he is hereby authorized and directed to publish for at least
two weeks, in the Anaheim Gazette, a newspaper of general circa-

lation, printed, published, and circulated in said city, a notice
inviting sealed proposals or bids for the furnishing of all Labor
and materials for the doing of said work in ac co rd a- ce with said
plans and specifications which said propo=sals or bids shall be
received by the Board of Trustees of the City of Anaheim, at the
office of the City Clerk of the said city, up to eight o'clock P.
M. of Thursday the 9th day of February 1922 and the Board of
Trustees of said city reserves the right to reject any and all bid
SECTIOTr 4. All proposals or bids must be accompanied by a
check payable to the City of Anaheim, certified by a responsible
bank, for an amount which shall not be less than ten per cent of
the aggregate amount of the proposal, or a bond for the said a-
mount so payable, signed by the bidder and two sureties, who sha
justify before any officer competent to administer an oath, in
double the said amount, over and above all statutory exemptions,
or by a corporate surety, as provided by law, said check or bond
to become forfeited to the City of Anaheim in the event that the
successful bidder shall fail to enter into a contract for the do-
ing of said work, and furnish the bonds required within ten days
after the contract is awarded to him.
SECTION 5. The successful bidder shall, within ten days aftex
the contract is awarded to him, file with the Board of Trustees
of the City of Anaheim, a bond for an amount w'nich shall not be
less than fifty per cent of the aggregate amount of the contract
price, for the furnishing Of said materials and the doing of said
work, payable to the City of Anaheim and signed by the bidder, ani
at least two sureties who shall justify before any officer compe-
tent to administer an oath in double the said amount, over and a-
bove all statutory exemptions, or by a corporate surety, as pro-
vided by law, which said bond shall be subject to the approval
of the Board of Trustees of the City of Anaheim, and shall be
conditioned upon the faithful performance of said contract,

1 The successful bidder shall likewise, within ten days after
2 the contract is awarded to him, and before entering upon the per-
3 formance of said work, file with the City Clerk of the City of
4 Anaheim, a good and sufficient bond, to be approved by the Board
5 of Trustees of the City of Anaheim, in a sum of not less than one-
6 half of the total amount payable by the terms of said contract,
7 which said bond shall be executed by the contractor, and either
8 at least two sureties, or by a corporate surety as provided by
9 law an amZantn t less than the sum specified in the bond, and
10 must provide that if the contractors person company, or corpora-
11 tion, or his or its subcontractor fails to pay for any materials,
12 provisions, provender, or other supplies , . or teams used in,
13 upon, for, or about the performance of the work contracted to be
14 done or for any work or labor done thereon, of any kind, that the
1,5 surety or sureties will pay the same in an amount not exceeding
16 the sum specified in the bond, and also in case suit is brought
17 upon such bond, a reasonable attorney's fee to be fixed by the
18 court.
19 SEC TIOTT 6. The work herein referred to and described, must
20 be done and completed by the contractor within one hundred and
21 twenty days after the execution of the contract by the parties
22 hereto and the approval of said bond by the �o of Trustees of
23 the City of Anaheim.
24 SEC TIOIT 7. The time of service of any workman, laborer
25 or mechanic employed upon any of the work herein de scribed, shall
26 be limited and restricted to eight hours during any one calendar
27 day, and the contractor shall forfeit as a penalty to the City
28 . of Anaheim, ten Otcellars, for each laborer, workman, or mechanic
29 employed by him in the execution of said contract, or for any
30 subcontractor under him, upon any of said work herein referred
31 to or described, for each calendar day during which such laborer
32 workman or mechanic is required or permitted to labor more than

eight hours in violation of the provisions of Section 653 C of
Penal Code of the State of California.
SECTIO1 8* The minimum compensation to be paid for labor up-
on all work performed under and pursuant to the terms I of said
contract shall be the Sam of Two dollars per day.
SEC TION, 9. The contractor shall at all times during the pro
..ress of the work contracted for an at his own cost and expense,
carry sufficient insurance, evidenced by policies issued and exe-
cuted by some reliable corporation thereunto duly authorized by
the laws of the State of California, or by the State Compensation
Insurance Fund of the State of California, to indemnify and hold
harmless, himself and the City of Anaheim from ard against all
claims for damages arising out of the death or injury sustained
in the course of his employment by any workman, laborer, or em-
ployee employed ujr)on the work contracted to be done, and shall
at all times during the progress of such work, keep on, file with
the City Clerk of such city, satisfactory evidence that such
insurance in in fall force and effect*
The foregoing resolution was passed and adopted at a regular
meeting of the Board of Trustees of the City of Anaheim and was
signed and approved and attested by me this 12th day of January,
1922*
