RESOLUTION NO. 72R-333
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM GRANTING VARIANCE NO. 2391.
WHEREAS, after a request for variance by H. L. BUDLONG,
and R. JOSEPH MAAG, owners; ANACAL ENGINEERING CO., agent, was
received, a public hearing before the Planning Commission of the
City of Anahim was held upon due and proper notice as a result
of which Variance No. 2391 was denied covering the following
described property:
Parcel I:
That portion of Lots 1 and 2 of the Dominguez Estate
in the City of Anaheim, County of Orange, State of
California, as per map filed in Book 2 page 15 of
Record of Surveys, in the office of the County Recorder
of said County, described as follows:
Beginning at the southeast corner of said Lot 2;
thence South 890 46' 00" West 1064.44 feet along the
south line of said Dominguez Estate; thence North
00 16' 30" West 1091. 00 feet; thence North 890 50' 00"
East 671.15 feet to the west line of the land described
in the Deed recorded in book 206 page 290 of Deeds of
said Orange County; thence South 00 18' 00" East
501.50 feet to the southwest corner of said land; thence
North 890 42' 00" East 393.36 feet along the South line
of said land to the east line of said Lot 2; thence
South 00 18' 00" East 589.20 feet along said east line
to the point of beginning.
Except that portion thereof included within the follow-
ing described land: Beginning at a point on the south
line of said Dominguez Estate, South 890 46' 00" West
1064.44 feet from the southeast corner thereof, said
point being the southeast corner of the land described
in the Deed recorded in book 524 page 24 of Deeds; thence
North 890 46' 00" East 22.00 feet along said south line;
thence North 000 16' 30" West 2302.00 feet parallel with
the east line of the land described in said Deed to the
center line of Santa Ana Canyon Road; thence westerly
22.85 feet along said center line to the northeast
corner of the land described in said Deed; thence South
00 16' 30" East 2301.40 feet to the point of beginning.
Also except that portion thereof lying easterly of the
southerly prolongation of said west line of the Deed
recorded in book 206 page 290 of Deeds of said County
of Orange.
Parcel 2:
That portion of Lots 1 and 2 of the Dominguez Estate,
in the City of Anaheim, County of Orange, State of
California, as per map filed in book 2 page 15 of Record
of Surveys, in the Office of the County Recorder of
said County, described as follows:

Beginning at a point on the west line of the land
described in the Deed recorded in book 206 page 290 of
Deeds of said Orange County, North 00 18' 00" West
501.50 feet from the southwest corner thereof; thence
South 890 50' 00" West 671.15 feet; thence North 00
16' 30" West 1210.40 feet to the center line of Santa
Ana Canyon Road; thence North 740 01' 30" East 696.40
feet along said center line to the west line of the
land described in said Deed; thence South 00 18'
00" East 1400.00 feet along said west line to the
point of beginning.
Except that portion thereof included within the follow-
ing described land: Beginning at a point on the south
line of said Dominguez Estate, South 890 46' 00" West
1064.44 feet from the southeast corner thereof, said
point being the southeast corner of the land described
in the Deed recorded in book 524 page 24 of Deeds;
thence North 890 46' 00" East 22.00 feet along said
south line; thence North 00 16' 30" West 2302.00 feet
parallel with the east line of the land described in
said Deed to the center line of Santa Ana Canyon Road;
thence Westerly 22.85 feet along said center line to
the northeast corner of the land described in said
Deed; thence South 00 16' 30" East 2301.40 feet to the
point of beginning.
Also except that portion thereof lying northerly of
the southerly line of the land described in the Deed
to the State of California, recorded August 10,
1948 in book 1683 page 547 of Official Records of said
Orange County.
WHEREAS, thereafter, within the time prescribed
by law an interested party or the City Council on its own
motion caused the review of said Planning Commission action
at a public hearing noticed and held as prescribed by law
and as a result thereof the City Council does hereby make the
following findings:
1. That there are special circumstances applicable
to the property, including size, shape, topo-
graphy, location or surroundings, which do not
apply to other property under identical zoning
classification in the vicinity.
2. That, because of special circumstances shown in
(I) above, strict application of the zoning
code deprives the property of privileges enjoyed
by other property under identical zoning classi-
fication in the vicinity.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that a conditional zoning variance
be, and the same is hereby, granted permitting l62-lot
subdivisions on the property hereinbefore described with
waivers of the following sections of the Anaheim Municipal
Code:
SECTION l8.24.030(4-a)
Minimum lot area (7200 square
feet required; 600 square
feet proposed)

Minimum lot width (70 feet
required; 60 feet proposed)
That said variance is granted subject to the following
conditions:

BE IT FURTHER RESOLVED that the City Council hereby
reserves the right to revoke such variance permit for good
cause or failure of said owners, their heirs, successors or
assigns to comply with the Anaheim Municipal Code and regu-
lations and the conditions herein. Said variance is granted
for the term prescribed by the Anaheim Municipal Code unless
otherwise specified herein.
THE FOREGOING RESOLUTION is approved and signed by me
this 8th day of August, 1972.
