A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM GRANTING VARIANCE NO. 2436.
WHEREAS, after a request for variance by MR. and MRS.
C. W. WINGERT, JR., owners, and J. ~'1. KLUG DEVELOPMENT COMPANY,
INCORPORATED, agent, was received, a public hearing before the
Planning Commission of the City of Anaheim was held upon due
and proper notice as a result of which Variance No. 2436 was
granted in whole covering the following described property:
That portion of the South half of the Southwest
quarter of the Northeast quarter of Section 12,
Township 4 South, Range 10 West in the Rancho San
Juan Cajon de Santa Ana, in the City of Anaheim,
as shown on a map thereof recorded in book 51, page
10, Miscellaneous Maps, records of said Orange
County, lying Westerly of the following described
lines:
Beginning at the Southeast corner of Tract No. 2767,
as shown on a map thereof recorded in book 136, pages
21 to 23, Miscellaneous Maps, records of said Orange
County, the Easterly line of said tract having a
bearing of South 010 06' 43" West, thence South 010
010 36" West, 95.19 feet; thence South 040 14' 46"
West, 539.40 feet to a tangent curve concave Westerly
having a radius of 450.00 feet; thence Southerly
along said curve, through an angle of 30 3D' 47", an
arc distance of 27.59 feet to the Southerly line of
said Northeast quarter.
EXCEPTING THEREFROM, however, the South 185.00 feet
thereof, measured at right angles.
ALSO EXCEPTING THEREFROM that portion deeded to the
State of California by deed recorded July 16, 1968
in book 8659, page 698, Official Records.
WHEREAS, thereafter, within the time prescribed by law
an interested party or the City Council on its own motion caused
the review of said Planning Commission action at a public hear-
ing noticed and held as prescribed by law and as a result thereof
the City Council does hereby make the following findings:
1. That there are special circumstances applicable to
the property, including size, shape, topography,
location or surroundings, which do not apply to
other property under identical zoning classifica-
tion in the vicinity.
2.
That, because of special circumstances shown in
(1) above, strict application of the zoning code
deprives the property of privileges enjoyed by
other property under identical zoning classifica-
tion in tho vicinity.

NOW, THEREFORE, BE IT RESOLVED by the City Council of
of Anaheim that a conditional zoning variance be, and
is hereby granted permitting the establishment of a

58-lot, single-family subdivision on the property hereinbefore
described with waivers of the following sections of the Anaheim
N.unicipal Code:
SECTION 18.24.030(4-a)
Minimum lot width (70 feet
required; 60 to 67 feet pro-
posed).
SECTION 18.24.030(4-b)
Minimum lot area (7200 square
feet required; 6000 square foot
minimum proposed on 19 lots;
6000 square feet to 7200 square
feet proposed on 16 lots; 7200
square feet and over proposed
on 23 lots).
SECTION 18.24.030(1-a)
Minimum front yard setback
(25% or 25 feet required; 10
feet proposed).
SECTION 18.08.550
Minimum lot width on a cul-de-
sac (60 feet required; 45 feet
proposed) .
That said variance be granted subject to the following condition:
That this variance is granted subject to the completion
of Reclassification No. 72-73-21 and Tentative Map of
Tract No. 6569, now pending.
BE IT FURTHER RESOLVED that the City Council hereby
reserves the right to revoke such variance permit for good cause
or failure of said owners, their heirs, successors or aSsigns,
to comply with the Anaheim Municipal Code and r~ulations and the
conditions herein. Said variance is granted for the term prescribed
by the Anaheim Municipal Code unless otherwise specified herein.
THE FOREGOING RESOLUTION is approved and signed by me
this 28th day of November, 1972.
