RES-2026-026RESOLUTION NO.2026-026 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AMENDING THE LIBRARY FACILITIES AND COLLECTION ITEMS IMPACT FEES WHEREAS, per Anaheim Municipal Code 17.08.385 and the provisions of the state law, authorize the City Council of the City of Anaheim ("City Council") to establish Library Impact Fees ("Fees") to mitigate the impacts on library facilities caused by new and expanded development within the City of Anaheim ("City"); and WHEREAS, an analysis of the need for additional library facilities and collection items required by new and expanded development in the City is set forth in the Development Impact Development Impact Fee ("DIF") Nexus Report developed by DTA and Development Impact Fee Improvement Plan (together hereinafter referred to as the "DIF Nexus Report"); and WHEREAS, the DIF Nexus Report analyzed the impact of new and expanded development on library facilities and collection items, the resulting need for additional facilities and collection items, and the estimated costs of additional facilities and collection items; and WHEREAS, said Fees as hereinafter set forth have been considered at a duly noticed public meeting or hearing as required by law; and WHEREAS, the City Council finds that said Fees, in the amount hereinafter set forth in this resolution, are less than or equal to, but in any event do not exceed, the actual direct and indirect costs and expenses incurred by the City of Anaheim in providing said services; and WHEREAS, the City Council, after due consideration of all evidence, testimony and reports offered at the public hearing does find as follows: A. The purpose of establishing the Library Impact Fees is to finance improvements and additions to public library facilities, Bookmobile, infrastructure including the acquisition of new library collection items, and technology to support an increase in demand on the facilities and infrastructure made necessary by new development and expansion of and additions to existing developments within the City. B. The Library Impact Fees collected pursuant to this resolution shall be used to finance only the additional and improved facilities and equipment set forth in the DIF Nexus Report, which additional facilities and equipment are needed to offset the impacts of new development and expansion of and additions to existing development within the City. C. The DIF Nexus Report, a copy of which is available in the office of the Finance Department, has been contemporaneously reviewed and approved by City Council via separate Resolution and is incorporated herein by this reference. D. The facts and evidence presented establish that there is a reasonable relationship between the need for the Improved Facilities and the impacts of the types of development, for which the corresponding Fees are charged and also that there is a reasonable relationship between the use of the Impact Fees and the type of development for which the Fees are charged in that the "Improved Facilities" accommodate the additional demand generated by development, as is described further and in more detail in the DIF Nexus Report. E. The cost estimates set forth in the DIF Nexus Report are reasonable estimates of the cost of providing the Improved Facilities and the Impact Fees to be generated by the construction of new developments and expansions and additions to such existing development will not exceed the total of these costs. F. The City has determined that, on average, there is no evidence that a larger home in the City corresponds to additional residents in the home, thus a uniform per -unit fee best reflects the actual impact a new home will have on local library facilities. G. The Library Impact Fees methodology has been determined to be generated by both residential and non-residential development. An employment adjustment factor of 20.91% is applied to non-residential developments with the assumption that residential developments typically generate roughly five times the demand for Library services than employees of non- residential development. This adjustment to the Library Impact Fees across all development types addresses the reality that residents and employees both utilize Library services provided within the City. H. City Council further finds and determines that this resolution amending Library Impact Fees of the City in the manner hereinafter set forth is exempt from the provisions of the California Environmental Quality Act pursuant to Section 15060(c)(2), 15060(c)(3), and 15061(b)(3) of the State CEQA Guidelines, because it will not result in a direct or reasonably foreseeable indirect physical change in the environment, because there is no possibility that it may have a significant effect on the environment, and because it is not a "project," as that term is defined in Section 15378 of the State CEQA Guidelines. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ANAHEIM AS FOLLOWS: 1. Definitions. (a) "New Development" shall mean construction of new residential, commercial, entertainment, amusement, and industrial developments and expansions and additions to such existing developments. (b) "Exempted Development" shall mean development exempted pursuant to Section 17.36.050 of the Anaheim Municipal Code. 2 2. Imposition of Fee. The Public Safety Impact Fees shall be charged and paid prior to approval of each building permit for new development within the City, as shown in Exhibit A, except as otherwise provided in Section 66007 of the Government Code. 3. Use of Library Impact Fees. Library Impact Fees shall be used solely to pay for the additional and improved library facilities, equipment and materials, all as identified in the DIF Nexus Report. BE IT FURTHER RESOLVED as follows: l . The Library Impact Fees set forth in Exhibit "A", attached hereto and incorporated herein by reference, shall be, and are hereby, adopted. 2. The Fees established herein shall become effective sixty (60) days following the date of adoption of this Resolution. 3. The Fees established herein shall, upon becoming effective, supersede any fees previously adopted for the same purposes. 4. The fees established herein shall be increased on July 1, 2027, and annually thereafter, by the California Construction Cost Index ("CCCI") from the California Department of General Services for the calendar year immediately preceding the increase, rounded down to the nearest whole dollar. 5.
