A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM GR&~TING VARIANCE NO. 2489.
WHEREAS, after a request for variance by ~~aheim
Hills, Inc., owner, and James L. Barisic, agent, was received,
a public hearing before the Planning Commission of the City of
Anaheim was held upon due and proper notice as a result of
which Variance No. 2489 was granted in part, covering the fol-
lowing described property:

PARCEL D:

A strip of land 35.00 feet in width, the Westerly line of
which is described as follows:
Beginning at a point in that certain course shown as N 750
02' 2611 E 2264.54 feet on a map recorded in Book 91, page
40 of Records of Surveys in the office of the County Recorder
of said Orange County, said point being distant N 750 02'
26" E 376.62 feet from the Westerly terminus of said course;
thence S 30 21' 09" E 94.57 feet to a point in a non-tangent
curve concave Southerly having a radius of 277.00 feet, a
radial line of said curve at said point bears N 30 21' 09" \'J.
The Easterly sideline of said strip of land shall be prolonged
or shortened at the beginning thereof so as to terminate in
said course hereinabove described as N 750 02' 26" E 2264.54
feet and so as to terminate at the end thereof in said curve
having a radius of 277.00 feet.
PARCEL E:
A parcel of land bounded Westerly by the Easterly line of the
above described Parcel D, bounded Southerly by said curve
having a radius of 277.00 feet, in said Parcel D and bounded
Northeasterly by a curve concave Northeasterly having a radius
of 15.00 feet, said curve being tangent to said Easterly line
and tangent to said curve having a radius of 277.00 feet.
ALSO RESERVING an easement for public utility purposes over
that portion of said land within a strip of land 25.00 feet
in width the centerline of which is described as follows:
Beginning at a point in that certain course shown as N 750
02' 2611 E 2264.54 feet on map recorded in Book 91, page 40 of
Records of Surveys in the office of said County Recorder,
distant thereon N 750 02' 26" E 961.62 feet from the Westerly
terminus thereof; thence S 210 IS' 0011 E 310.38 feet; thence
S 40 15' 00" W 58.93 feet; thence S 180 IS' 00" E 950.00 feet
more or less, to the Northerly line of the hereinabove de-
scribed 78.00 foot strip of land.
The side lines of said strip of land shall be prolonged or
shortened at the beginning thereof so as to terminate in said

feet and the end thereof so as to terminate in the Northerly
line of said 78.00 foot strip of land.

having a radius of 250.00 feet; thence westerly along said
reverse curve through a central angle of 330 21' 01" a distance

151.00 feet; thence S 750 14' 43" W 258.71 feet to the center
line of the hereinabove described 54.00 foot strip of land.
The side lines of said 36.00 foot strip of land shall be pro-
longed or shortened at the beginning thereof so as to terminate
in the Easterly boundary of the hereinabove described parcel
of land.
EXCEPTING that portion of the above described 36.00 foot strip
of land within the above described 54.00 foot strip of land.
WHEREAS, thereafter, within the time prescribed by
law an interested party or the City Council on its own motion
caused the review of said Planning Commission action at a public
hearing noticed and held as prescribed by law and as a result
thereof the City Council does hereby make the following findings:
1. That there are special circumstances applicable to
the property, including size, shape, topography,
location or surroundings, which do not apply to
other property under identical zoning classifica-
tion in the vicinity.
2. That, because of special circumstances shown in
(1) above, strict application of the zoning code
deprives the property of privileges enjoyed by
other property under identical zoning classifica-
tion in the vicinity.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim, that a conditional zoning variance be,
and the same is hereby granted permitting the subdivision of the
property hereinbefore described into 229 RS-5000 zoned lots in
four tracts with waivers of the following Sections of the Anaheim
Municipal Code:
SECTION 18.26.050(1) (c) - Minimum lot width on cul-de-sac.
(45 feet required; 40 feet pro-
posed for one lot in Tract No.

SECTION 18.26.050(3) -
Maximum lot coverage. (35% permit-
ted; 42% proposed)

That said variance be granted subject to the following conditions:
1. That this variance is granted subject to the approval of
Tentative Map of Tract Nos. 8220, 8221, 8222 and 8223 and the com-
pletion of Reclassification No. 71-72-44.
2. That subject property shall be developed substantially in
accordance with plans and specifications on file with the City of
Anaheim marked Exhibit Nos. 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12,
13, 14, 15 and 16; provided however, that final specific plans shall
be submitted and approved in accordance with provisions of the PC,
Planned Community, Zone prior to the approval of the final tract maps.
BE IT FURTHER RESOLVED that the City Council hereby
reserves the right to revoke such Variance permit for good
cause or failure of said owner, his heirs, successors or assigns
to comply with the Anaheim Municipal Code and regulations and
the conditions herein. Said Variance is granted for the term
prescribed by the Anaheim Municipal Code unless otherwise speci-
fied herein.
THE FOREGOING RESOLUTION is approved and signed by me
this 24th day of April, 1973.
