1974-347RESOLUTION NO. 74R A RESOLUTION OF THE CITY COUNCIL OF THE CITY COUNCIL OF THE CITY OF ANAHEIM APPROVING AN AGREEMENT TO PROVIDE FOR THE CITY TO CONSTRUCT THE WESTRIDGE PUMPING STATION TO BE PAID FOR BY THE ROBERT H. GRANT CORPORATION AND THE REIMBURSEMENT OF SAID CORPORATION FOR THE COST THEREOF, AND TO AUTHORIZE THE MAYOR AND CITY CLERK TO EXECUTE SAID AGREEMENT. WHEREAS, the Robert H. Grant Corporation has applied to the City for water facilities to serve Tract 7567 and certain other properties adjacent thereto; and WHEREAS, the City is unable to furnish water at said tract at an adequate pressure level to serve said Tract in the absence of a special facility as defined pursuant to Rule No. 15 of the Water Rules of the City of Anaheim; and WHEREAS, said special facility is determined to be a pumping station hereinafter named the Westridge Pumping Station; and WHEREAS, the Robert H. Grant Corporation has agreed to accept water at Tract 7567 at a low pressure situation and notify all potential buyers of property of said low pressure until the Westridge Pumping Station can be constructed; and WHEREAS, the Robert H. Grant Corporation desires to have said Westridge Pumping Station located within said Tract 7567 and is willing to pay for the cost of construction of said Westridge Pumping Station subject to the right of reimbursement to Robert H. Grant Corporation from funds received from the person or persons served by said Westridge Pumping Station; and /or within the special facilities district No. 1. A map of special facilities district No. 1 is attached hereto as Exhibit WHEREAS, the City is willing to construct said West ridge Pumping Station to be paid for by Robert H. Grant Corpora- tion and subsequently collect from the ultimate users of said pumping station, and /or persons within the special facility's district No. 1, the fees necessary to reimburse the Robert H. Grant Corporation the cost of said pumping station. WHEREAS, it is in the best interests of the City of Anaheim to approve said agreement. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the agreement between the City of Anaheim and Robert H. Grant Corporation to provide for the con- struction, payment and reimbursement of the Westridge Pumping Station, this day submitted be, and the same is hereby approved. -1- BE IT FURTHER RESOLVED that the Mayor and City Clerk are hereby authorized to execute said agreement for and on behalf of the City of Anaheim. 16th THE FOREGOING RESOLUTION is approved and signed by me this day of July 1974.
