1974-299ATTY 18 -C (Page 1 of 1 page) RESOLUTION NO. 74R -299 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUND- ARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Pro- ceedings No. 73 -7L_55 to consider an amendment to Title 18 of the Anaheim '_Municipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing, the Planning Commission did duly adopt a resolution containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the proposed amendment be adopted by the City Council and that a certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Planning Commission the City Council did fix the 25th day of June 19 74, and continued to the day of 19__ as the time, and the City Council Chambers in the City Hall of the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone or zones in which it is now situated and the incor- poration thereof in the zone or zones hereinafter set forth, and did give notice thereof in the manner and form provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following described property, situated in the City of Anaheim, County of Orange, State of California, to wit: -1- Beginning at the Southeasterly corner of the land shown as Parcel 1 on said map; thence South 0 14' 36" East 1150.50 feet along the Easterly line of said Parcel 2 to the beginning of a tangent curve therein concave North- westerly and having a radius of 25.00 feet; thence South- easterly 39.27 feet along said curve through a central angle of 90 00' 04 thence tangent to said curve South 89 45' 28" West 1249.62 feet along the Southerly line of said Parcel 2 to the Southwest corner thereof; thence North 0 13' 32" West 294.00 feet along the Westerly line of said Parcel 2; thence North 89° 45' 28" East 35.00 feet; thence South 45 15' 00" East 45.00 feet; thence North 44° 45' 00" East 320.00 feet; thence South 45 15' 00" East 60.00 feet; thence North 44° 45 00" East 35.00 feet; thence South 45 15' 00" East 100.00 feet; thence North 44° 45' 00" East 198.69 feet to a point on a non tangent curve concave Northeasterly and having a radius of 1000.00 feet, a radial to said point bears South 32° 59' 26" West; thence Southeasterly 148.19 feet along said curve through a central angle of 8° 29' 26 thence tan- gent to said curve South 65 30' 00" East 109.99 feet to a point on a nontangent curve concave Northwesterly and having a radius of 310.00 feet, a radial to said point beats South 55 01' 54" East; thence Northeasterly 85.00 feet along said curve through a central angle of 15 42' 36 thence tangent to said curve North 19 15' 30" East 73.60 feet to the beginning of a tangent curve concave Southeasterly and having a radius of 425.00 feet; thence Northeasterly 342.08 feet along said curve through a cen- tral angle of 46° 07' 00 thence North 44° 15' 30" West 115.13 feet; thence North 0 14' 36" West 280.00 feet to the Southerly line of said Parcel 1; thence North 89° 45' 24" East 265.00 feet along said Southerly line to the point of beginning. (Lots 1 and 2 only) be excluded from M -1, LIGHT INDUSTRIAL, ZONE and incorporated in C -1, GENERAL COMMERCIAL, ZONE subject to the following conditions: 1. That the completion of these reclassification pro- ceedings is contingent upon the granting of Variance No. 2598, Conditional Use Permit No. 1462, and Tentative Map of Tract No. 8660. 2. That a final tract map of subject property shall be submitted to and approved by the City Council and then be recorded in the office of the Orange County Recorder. 3. That fire hydrants shall be installed and charged as required and determined to be necessary by the Chief of the Fire De- partment prior to commencement of structural framing. 4. That all air conditioning facilities shall be prop- erly shielded from view, and the sound buffered from adjacent prop- erties. utilities. 5. That subject property shall be served by underground -2- 6. That trash storage areas shall be provided in accord- ance with approved plans on file with the office of the Director of Public Works. 7. That final specific plans shall be submitted to the Planning Commission and City Council for their review and approval. 8. That subject property shall be developed substan- tially in accordance with plans and specifications on file with the City of Anaheim marked Exhibit Nos. 1, 2, 3, 4 and 5. 9. Prior to the introduction of an ordinance rezoning subject property, Condition Nos. 1, 2 and 7, above mentioned, shall be completed. The provisions or rights granted by this resolution shall become null and void by action of the City Council unless said conditions are complied with within one year from the date hereof, or such further time as the City Council may grant. 10. That Condition Nos. 3, 4, 5, 6 and 8, above mentioned, shall be complied with prior to final building and zoning inspections. Further subject to the following condition: That ordinances reclassifying the property shall be adopted as each parcel is ready to comply with the conditions per- taining to such parcel provided, however, that the word "parcel" shall mean presently existing parcels of record and any parcel or parcels approved by the City Council for a lot split. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby, authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and determined to be necessary and proper.
