RESOLUTION NO. 74R -281
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM FINDING AND DETERMINING THAT TITLE
18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO
ZONING SHOULD BE AMENDED AND THAT THE BOUND-
ARIES OF CERTAIN ZONES SHOULD BE CHANGED.
WHEREAS, the City Planning Commission of the City
of Anaheim did hold a public hearing in Reclassification Pro-
ceedings No. 73 -74 -56 to consider an amendment to Title 18 of
the Anaheim Municipal Code relating to zoning, and to consider
a change in the boundaries of the zone or zones hereinafter
mentioned and described, and at said hearing did receive evidence
and reports from persons interested therein and from its staff;
and
WHEREAS, within a period of forty days following said
hearing, the Planning Commission did duly adopt a resolution
containing a report of its findings, a summary of the evidence
presented at said hearing, and a recommendation that the proposed
amendment be adopted by the City Council and that a certain zone
or zones be changed as hereinafter set forth; and
WHEREAS, upon receipt of said resolution, summary of
evidence, report of findings and recommendation of the City
Planning Commission the City Council did fix the _llth day of
J�nP 19 74, and continued to the day of June
19 74 as the time, and the City CounciY4ambers in the City
Hall of the City of Anaheim as the place for a public hearing
upon said proposed amendment to Title 18 of the Anaheim Municipal
Code, and the exclusion of said property, hereinafter described,
from the zone or zones in which it is now situated and the incor-
poration thereof in the zone or zones hereinafter set forth, and
did give notice thereof in the manner and form provided in said
Title 18 of the Anaheim Municipal Code; and
WHEREAS, at the time and place fixed for said public
hearing the City Council did hold and conduct such public hearing
and did give all persons interested therein an opportunity to be
heard, and did receive evidence and reports, and did thereunon
consider the summary of evidence presented at said public hearing
before the Planning Commission, its report of findings and
recommendation; and
WHEREAS, the City Council does find and determine that
the amendment to Title 18 of the Anaheim Municipal Code should
be adopted and that the property hereinafter described should
be excluded from the zone or zones in which it is now situated
and incorporated in the zone or zones as hereinafter set forth.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that Title 18 of the Anaheim Municipal Code
be, and the same is hereby, amended and that the following
described property, situated in the City of Anaheim, County of
Orange, State of California, to wit:

PARCEL 1:
That portion of the land, lying within Parcel 1 of
Executors Deed recorded in book 9446, page 927 of Offi-
cial Records of said County, described as follows:
Beginning at the Northwest corner of said Parcel 1,
said Northwest corner also being the Southwest corner
of Tract No. 936, as per map recorded in book 30, pages
1 and 2 of Miscellaneous Maps, records of said County;
thence along the Southerly boundary of said Tract South
89° 12' 19" East 3265.56 feet to a point distant 2.03
feet from the Southeast corner of said Tract, said point
also being on a curve concave Westerly having a radius
of 1000.00 feet, a radial to said point bears South 85
10' 58" East; thence Southerly along said curve through
a central angle of 12 02' 06" an arc distance of 210.05
feet; thence tangent to said curve South 16 51' 08"
West 173.74 feet to a tangent curve concave Easterly
having a radius of 1000 feet; thence Southerly along
said curve through a central angle of 17° 37' 42" an
are distance of 307.67 feet; thence tangent to said curve
South 0 46' 34" East 506.62 feet to the beginning of
a tangent curve concave Westerly having a radius of 1200
feet; thence Southerly along said curve and through a
central angle of 11 26' 22" an arc distance of 239.59
feet; thence tangent to said curve South 10° 39' 48"
West 442.12 feet to the Northerly boundary of the Agri-
cultural Preserve as described in document recorded in
book 8888, page 880 of Official Records of said County;
thence along said boundary the following courses; South
89° 56' 41" West 2244.00 feet; South 0 56' 41" West
530.00 feet; North 89° 03' 19" West along said boundary
and its Westerly prolongation 1110.00 feet to the Westerly
line of said Parcel 1; thence along the boundary of said
Parcel 1, North 0 36' 20" East 1896.23 feet, South 89
23' 40" East 300.00 feet, and North 0 36' 20" East 521.17
feet to the point of beginning.
Excepting therefrom that portion described as follows:
Commencing at a point in the Southerly line of Tract
No. 936 as per map recorded in book 30, pages 1 and 2,
of Miscellaneous Maps, in the office of the County Re-
corder of said County, said point being distant North
89° 12' 19" West 2.03 feet from the Southeast corner
of said Tract, said point also being on a curve concave

along said curve through a central angle of 12 02' 06"

Avenue, 60.00 feet in width, as shown on plans for water
transmission main, Unit No. 8, Sheet No. 5, Drawing No.
D -1172 with a revised date of January 21, 1965, on file
in the City of Anaheim, said County of Orange; thence
along said centerline as per Sheet No. 5 of said plans
North 74 17' 32" East 198.07 feet; thence leaving said
centerline North 15 42' 28" West 257.35 feet; thence
North 88° 05' 52" East 286.90 feet to the true point
of beginning.
Also excepting therefrom those portions lying Westerly
of the Easterly boundaries of Tract No. 7569, as shown
on a map recorded in book 301, pages 7, 8 and 9 of Mis-
cellaneous Maps, records of Orange County, California,
and Tract No. 7568, as shown on a Map recorded in book
314, pages 11, 12, 13 and 14 of Miscellaneous Maps, rec-
ords of Orange County, California.
Also excepting therefrom the portion lying Southwesterly
of the Southeasterly extension of the Northeasterly line
of Lot 16 of Tract No. 7568, as shown on a Map recorded
in book 314, pages 11 to 14 inclusive of Miscellaneous
Maps, records of Orange County, California.
Also excepting therefrom the portion lying Northerly of
the center line of Nohl Ranch Road as conveyed to the
County of Orange by deed recorded June 22, 1973 in book
10765, page 501 of Official Records.

be excluded from R -A, AGRICULTURAL ZONE and incorporated in R -H
10,000, RESIDENTIAL HILLSIDE LOW DENSITY SINGLE FAMILY ZONE
subject to the revised plot plan submitted this date indicating
one -story homes on Lot Nos. 30, 35, 37, 38 and 39 and two -story
home on Lot No. 29 of Tract No. 8672 and sight line study for
Lot No. 29 and the following conditions:
1. That final tract maps of subject property shall be
submitted to and approved by the City Council and then be recorded
in the Office of the Orange County Recorder.
2. That some provisions, acceptable to the City Coun-
cil, shall be made for the landscaping and maintenance of the slopes
within and /or created by the development of this property.
3. That final floor plans and elevations shall be sub-
mitted to and approved by the City Council.
4. That the owner(s) of subject property shall make an
irrevocable offer to dedicate an easement for riding and hiking
trail purposes over that portion of subject property over which the
Four Corners Pipe Line Company has an easement for pipe line and
incidental purposes on the date of this resolution. Said offer to
dedicate shall be irrevocable for a period of 20 years and may be
accepted by the City of Anaheim at such time as it is determined
that development of such facilities would be in the best interest
of the City of Anaheim. Said irrevocable offer to dedicate shall
be recorded concurrently with the final tract map.
5. That the owner(s) of subject property shall pay to
the City of Anaheim the appropriate park and recreation in -lieu
fees as determined to be appropriate by the City Council, said fees
to be paid at the time the building permit is issued.
6. That fire hydrants shall be installed and charged as
required and determined to be necessary by the Chief of the Fire De-
partment prior to commencement of structural framing.
7. That all lots within this tract shall be served by
underground utilities.
8. That all air conditioning facilities shall be proper-
ly shielded from view and the sound buffered from adjacent properties.
9. That subject property shall be developed substantially
in accordance with plans and specifications on file with the City of
Anaheim marked Exhibit Nos. 1 and 2 and substantially in accordance
with floor plans and elevations approved for the Westridge Develop-
ment west of subject property.

10. That single -story dwellings shall be constructed on
all lots abutting the west boundary of Tentative Tract No. 8672
except for Lot No. 29 where a two -story dwelling may be construc-
ted provided the height of the dwelling is in conformance with the
approved "line of sight exhibit (Exhibit No. 2) submitted by the
petitioner.
11. Prior to the introduction of an ordinance rezoning
subject property, Condition Nos. 1, 2, 3 and 4, above mentioned,
shall be completed. The provisions or rights granted by this reso-
lution shall become null and void by action of the City Council un-
less said conditions are complied with within one year from the
date hereof, or such further time as the City Council may grant.
12. That Condition Nos. 7, 8, 9 and 10, above mentioned,
shall be complied with prior to final building and zoning inspec-
tions.
13. That ordinances reclassifying the property shall
be adopted as each parcel is ready to comply with conditions per-
taining to such parcel; provided, however, that. the :word "parcel"
shall mean presently existing parcels of record and any parcel or
parcels approved by the City Council by parcel map or subdivision
map.
BE IT FURTHER RESOLVED that the City Attorney be, and
he is hereby, authorized and directed to prepare and submit to the
City Council an ordinance amending Title 18 of the Anaheim Munici-
pal Code to accomplish the objects herein found and determined to
be necessary and proper.
THE FOREGOING RESOLUTION is approved and signed by me
this 18th day of June, 1974.
