A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM GRANTING VARIANCE NO. 2644.
WHEREAS, after a request for variance by Martina
Y. Pelanconi, owner, was received, a public hearing before
the Planning Commission of the City of Anaheim was held
upon due and proper notice as a result of which Variance
No. 2644 was granted in whole, covering the following
described property:
Beginning at the Southwest corner of Lot 17,
Tract No. 5999 as shown on map recorded in
Book 221, pages 39 to 41 inclusive, of
Miscellaneous Maps, in the office of the County
Recorder of said county being a point on the
Easterly line of Royal Oak Road 62.00 feet in
width; thence South 89° 23' 45" East 201.45
feet to the Southeast corner of Lot 16 of said
Tract No. 5999, being a point on the West line
of Tract No. 936 as shown on map recorded in
Book 30, page 2 of said maps; thence South 0°
36' 15" West 1383.64 feet along said West line
of Tract No. 936 and Tract No. 7566 as shown
on map recorded in Book 298, pages 21, 22 and
23 of said maps to the intersection with the
Easterly line of Tract No. 5674 as shown on
map recorded in Book 307, pages 22,23 and 24
of said maps, being a point on the Easterly
line of said Royal Oak Road, 63.00 feet in
width; thence along the Easterly line of said
Tract No. 5674 and said Easterly line of Royal
Oak Road as follows: North 10° 04' 00" West
115.90 feet to the beginning of a tangent curve,
concave to the East and having a radius of
570.00 feet; thence Northerly along said curve
through a central angle of 14° 00' 00" an arc
distance of 139.28 feet; thence tangent to said
curve North 3° 56' 00" East 301.94 feet to the
Northeast corner of said Tract No. 5674, and
the Southeast corner of said Tract No. 5999,
and the beginning of a tangent curve in the
Easterly line of said Royal Oak Road, 62.00
feet in width, said curve being concave to the
West and having a radius of 630.00 feet; thence
Northerly along said curve and the Easterly line
of said Royal Oak Road through a central angle
of 18° 10' 00" an arc distance of 199.75 feet;
thence tangent to said curve North 14° 14' 00"
West 613.75 feet to the beginning of a tangent
curve concave to the West and having a radius
of 630.00 feet; thence Northerly along said
curve through a central angle of 3° 39' 07" an
arc distance of 40.16 feet to the point of
beginning.
EXCEPT therefrom that portion thereof lying
Southerly of the Westerly prolongation of the
Northerly line of said Tract No. 7566.

WHEREAS, thereafter, within the time prescribed by
law an interested party or the City Council on its own motion
caused the review of said Planning Commission action at a
public hearing noticed and held as prescribed by law and as a
result thereof the City Council does hereby make the following
findings:

1. That there are special circumstances applicable to
the property, including size, shape, topography,
location or surroundings, which do not apply to
other property under identical zoning classifica-
tion in the vicinity.

That, because of special circumstances shown in
(1) above, strict application of the zoning code
deprives the property of privileges enjoveC by
other property under identical zoning classifica-
tion in the vicinity.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim, that a conditional zoning variance be,
and the same is hereby, granted permitting a 140-lot
"RS-HS-10,000" Residential, Single-Family Hillside Zone, with
a waiver of the following section of the Anaheim Municipal
Code:
SECTION 13.04.075 Requirement that single family
residence rear on arterial
highways (one lot to sides on
an arterial highway).
That said variance be granted subject to the following
conditions:
1. That this variance is granted subject to the
completion of Reclassification No. 67-68-7 and Tentative Map,
Tract No. 3783.
2. That subject property shall be developed
substantially in accordance with plans and specifications on
file with the City of Anaheim marked Exhibit No. 1.
BE IT FURTHER RESOLVED that the City Council hereby
reserves the right to revoke such variance permit for good
cause or failure of said owner, her heirs, successors or assigns
to comply with the Anaheim Municipal Code and regulations and
the conditions herein. Said variance is granted for the term
prescribed by the Anaheim Municipal Code unless otherwise speci-
fied herein.
THE FOREGOING RESOLUTION is approved and signed by me
