A RESOLUTION OF InE CITY COUNCIL OF ME CITY
OF ANAHEIlii GRANTING VARIANCE O. 2700.
WHEREAS, after a request for variance by David S.
Collins and Marion G. Collins, owners, was received, a public
hearing before the Planning Commission of the City of Anaheim was
held upon due and proper notice as a result of which Variance No.
2700 was granted covering the following described property:
Parcel 2, in the City of Anaheim, County of Orange,
State of California, as shown on a parcel map filed
in Book 36 Page 24 of Parcels Haps, in the Office
of tne County Recorder of said county.
EXCEPT any portion thereof included witnin tae land
eseribed in a deed to Wilshire Woods Inc.,
recorded March. 27, 1973 in Book 11365 Page 821,
Official Records.
AND, EXCEPTING the following described real
property in the County of Orange, State of
California:
The Easterly 5 feet of the Westerly 35 feet of that
portion of Lot 35 of Anaheim Extension, in the City
of Anaheim, County of Orange, State of California
as said lot is shown on a map of survey by William
Hamel, a copy of which is shown in Book 3, Page 163
and 164 of "Los Angeles County Haps", in the office
of tne County Recorder of said Orange County,
together with that portion of the Southeast 1/4 of
the Southwest 1/4 of Section 9, Township 4 South,
Range it) West, as snown on a map recorded in Sook
51, Page 10, discellancous Maps, records of said
Orange County, described as follows:
beginning at the intersection on the South line of
said Section 9, with the Southerly prolongation of
the Westerly line of Tract 5444, as per map
recorded in Book 210, Page 28 and 29 of
Miscellaneous Maps of said Orange County; thence
Northerly 828.83 feet along said Soutnerly
prolongation, the Westerly line of said. Tract 5444
and the Northerly prolongation of the Westerly line
of said Tract 5444 to the Southeast corner of Lot 5
of the Anaheim Homestead Tract, as per map thereof
recorded in Book 26 Page 10, Hiscelianeous ecords
of Los Angeles County, California; thence Westerly
616.02 feet along the South line of said Lot 5 and
tne South Line of said Anaheim Homestead Tract;
thence South 829.17 feet to the South line of said
Section; thence Last 618.82 feet to the point of
beginning.
EXCEPTING ThE2EFRODI any portion thereof lying
Southerly of the Northerly line of Wilshire Avenue
as now shown of record.
ALSO EXCEPTING tne Northerly 260 feet thereof.

WHEREAS, thereafter, within the time prescribed by law,
an interested party or the City Council on its own motion caused
the review of said Planning Commission action at a public hearing
noticed and held as prescribed by law and as a result thereof, the
City Council does hereby make the following findings:
1. That there are special circumstances applicable
to the property including size, shape, topography,
location or surroundings, which do not apply to
other property under identical zoning classifica-
tion in the vicinity.
2. That, because of special circumstances shown in
(1) above, strict application of the zoning code
deprives the property of privileges enjoyed by
other property under identical zoning classifi-
cation in the vicinity.
'HOW, THEREFORE, BE IT i:ESOLVED by the City Council of
the City of Anaheim, that a conditional zoning variance be, and
the same is hereby, granted permitting a 77-unit apartment complex
on the aforedescribed property with waivers of the following sec-
•ions of the Anaheim Municipal Code:
SECTION 18.34.062.032 Minimum floor area. (700
square feet required; 550
square feet proposed)
SECTION 16.34.065.011 iinimum distance between
buildings. (16, 21 and 26 feet
required; 9, 16 and 23 feet
proposed)
That said variance be granted subject to the following conditions:
1. That this variance is granted subject to the completion
of Reclassification Ho. 74-75-32, now pending.
2. That subject property shall be developed substantially
in accordance with plans and specifications on file with the City
of Anaheim marked Exhibit No. 1 (Revision Ho. 1), and Exhibit os.
2, 3, 4 and 5, with the following modification:
a. That the carport roofs located along the northerly
property line shall be covered with green or earthen tone rock.
b. That a minimum three-foot wide planter area shall be
provided immediately adjacent to the northerly boundary of subject
property except where carports abut the northern boundary, and Yew
pines shall be installed in said planter on four-foot centers in
order to provide an effective landscaping screen within three years
from date of planting.
c. That landscaped planter boxes shall be placed on the
roofs of the carports adjacent to the north boundary of the property,
as stipulated to by the petitioner.
d. Lattice-type covering Shall be installed on the trash
enclosure areas, screening said areas from the apartments to the
north.

BE IT FURTHER RESOLVED that the City Council hereby re-
serves the right to revoke such variance permit for good cause or
failure of said owners, their heirs, successors or assigns to comply
with the Anaheim Municipal Code and regulations and the conditions
herein. Said variance is granted for the term prescribed by the
Anaheim Municipal Code unless otherwise specified herein.
