A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM GRANTING CONDITIONAL USE PERMIT
NO. 1520
WHEREAS, the City Planning Commission of the City of
Anaheim did receive an application for a conditional use permit
from STATE INDUSTRIES to permit a private tennis facility, grille
and soft drink bar in the "ML" LIMITTED INDUSTRIAL ZONE on the
following property:
Lots 4, 5, and 6 of Kraemer Tract as shown on Page 27
of Book 59 of the Miscellaneous Maps on file with the
Recorder of Orange County, California.
AND WHEREAS, the City Planning Commission did hold a
public hearing at the City Hall in the City of Anaheim upon
said application on March 3 1975 notices of which
said public hearing were duly given as refired by law and the
provisions of Title 18, Chapter 18.76 of the Anaheim Municipal
Code; and
WHEREAS, said Commission, after due inspection, inves-
tigation and studies made by itself and in its behalf and after
due consideration of all evidence and reports offered at said
hearing, did adopt its Resolution No. PC75 50 Series
granting Conditional Use Permit No. 1520

WHEREAS, thereafter, within twenty -two (22) days from
the date of the adoption of said resolution, the City Council
did elect, upon its own motion, to review the action of the
City Planning Commission in granting said conditional use
permit and did thereupon fix the 15th day of April
19 75 as the time and the Council Chamber in the City Hall
of the City of Anaheim as the place for a public hearing upon
said conditional use permit, and notices of such public hearing
were duly given as required by law and the provisions of Title
18, Chapter 18.76 of the Anaheim Municipal Code; and
WHEREAS, at the time and place fixed for said public
hearing, the City Council did duly hold and conduct such hear
ing and did give all persons interested therein an opportunity
to be heard and did receive evidence and reports; and
WHEREAS, the City Council finds, after careful conside-
ration of the recommendations of the City Planning Commission
and all evidence and reports offered at said hearing, that:
1. The proposed use is properly one for which a
conditional use permit is authorized by the
Anaheim Municipal Code.
2. The proposed use will not adversely affect the
adjoining land uses and the growth and development
of the area in which it is proposed to be located.
3. The size and shape of the site proposed for the
use is adequate to allow the full development of
the proposed use in a manner not detrimental the
particular area nor to the peace, health, safety
and general welfare.
4. The traffic generated by the proposed use will not
impose an undue burden upon the streets and high-
ways designed and improved to carry the traffic in
the area.
5. The granting of the conditional use permit under
the conditions imposed will not be detrimental to
the peace, health, safety and general welfare of
the citizens of the City of Anaheim.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the action of the City Planning Com-
mission granting said conditional use permit be, and
the same is hereby sustained and that Conditional Use
Permit No. 1520 be, and the same is hereby, granted
permitting a private tennis facility, grille and soft drink
bar on the aforesaid property without waiver of any section of
the Anaheim Municipal Code.
However, that said Conditional Use Permit No. 1520 be
granted subject to the following conditions:
1. That trash storage areas shall be provided in accordance
with approved plans on file with the office of the Director of Pub-
lic Works.

2. That fire hydrants shall be installed and charged as
required and determined to be necessary by the Chief of the Fire
Department prior to commencement of structural framing.
3. That subject property shall be served by underground
utilities.
4. That sidewalks shall be installed along Kraemer Place
and La Mesa Street as required by the City Engineer and in accord-
ance with standard plans and specifications on file in the office
of the City Engineer.
5. That drainage of subject property shall be disposed of
in a manner satisfactory to the City Engineer.
6. That street lighting facilities along La Mesa Street
shall be installed as required by the Director of Public Utilities
and in accordance with standard plans and specifications on file
in the office of the Director of Public Utilities; and that a bond
in an amount and form satisfactory to the City of Anaheim shall be
posted with the City to guarantee the installation of the above-
mentioned requirements.
7. That all exterior lighting shall be directed downward so
as not to cause a hazardous condition to the motoring public along
the Riverside Freeway and that said lighting shall be reviewed one
year from the date of this resolution to determine whether a light-
ing problem exists.
8. That subject property shall be developed substantially
in accordance with plans and specifications on file with the City
of Anaheim marked Exhibit No. 1 (Revision No. 1) and Exhibit No.
2; provided, however, that the proposed tennis facility shall be
constructed in accordance with the site development standards of
the ML Zone and, further provided, that the proposed tennis court
lighting shall not exceed the height of the 14 -foot high canvas
material on the surrounding chain link fencing.
9. That Condition No. 6, above- mentioned, shall be complied
with prior to the commencement of the activity authorized under
this resolution, or prior to the time that the building permit is
issued, or within a period of one year from date hereof, whichever
occurs first, or such further time as the Planning Commission or
City Council may grant.
10. That Condition Nos. 1, 3, 4, 5 and 3, above- mentioned,
shall be complied with prior to final building and zoning inspec-
tions.
BE IT FURTHER RESOLVED, that the City Council hereby
reserves the right to revoke such Conditional Use Permit for good
cause or failure of said owner, its heirs, successors or assigns
to comply with the Anaheim Municipal Code and regulations and the
conditions therein.
