A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM FINDING THE EXISTENCE OF INSANITARY
AND UNSAFE INHABITED DWELLING ACCOMMODATIONS;
FINDING A SHORTAGE OF SAFE AND SANITARY
DWELLING ACCOMMODATIONS; DECLARING THE NEED
FOR A HOUSING AUTHORITY TO FUNCTION, AND
DETERMINING THE POWERS AND DUTIES OF THE
HOUSING AUTHORITY.
WHEREAS, the Development Services Department of
the City of Anaheim has analyzed Federal Government Census
information, surveys conducted by the Orange County Health
Department, and other information available to the City of
Anaheim; and
WHEREAS, this analysis indicates that there are
more than 9600 families requiring housing assistance because
the income of these families is below $10,000, and these
families are living in substandard housing or these families
are expending more than 25% of the incomes for rental
payments; and
WHEREAS, the analysis further indicates that there
are in excess of 1500 housing units in substandard condition
in the City of Anaheim, said substandard conditions due to
the high percentage of land coverage; the inadequate amount
of light, air, space or access available to the inhabitants
of such dwelling accommodations; the inadequate size and
arrangement of rooms; the inadequacy of sanitary facilities;
and conditions existing in such buildings which endanger life
or property by fire or other causes; and
WHEREAS, a housing authority has been created and
established in the City of Anaheim by Section 34240 of the
Health and Safety Code.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim as follows:
SECTION 1. Findings of Insanitary and Unsafe Inhabited
Dwelling Accommodations and of The Shortage
of Safe or Sanitary Accommodations
The City Council does find that both of the
following conditions exist in the City of Anaheim: (a) That
insanitary and unsafe inhabited dwelling accommodations do
exist in the City; and (b) that there is a shortage of safe
or sanitary dwelling accommodations in the City available to
persons of low income at rents they can afford.
SECTION 2. Declaration of Need For a Housing Authority
to Function
Pursuant to the provisions of Section 34241
of Part 2 of Division 24 of the Health and Safety Code, it is
hereby declared that there is a need for the housing authority
to function in the City of Anaheim. That authority shall be
known as the "Anaheim Housing Authority," a public body,
corporate and politic (hereinafter in this Resolution referred
to as the "Housing Authority.
There is a need for the Housing Authority to
transact the business of a housing authority as prescribed
in the Housing Authorities Law, which is Part 2 of Division
24 of the Health and Safety Code.
SECTION 3. Powers and Duties of The Anaheim
Housing Authority
The Anaheim Housing Authority shall have
the powers to exercise those powers and duties vested in a
housing authority, which powers and duties are set forth in
Section 34310 et seq. of the Housing Authority Law of the
State of California, including such additional powers and
duties as may be in the future be vested in the housing
authority.
SECTION 4. Certification of This Resolution
A copy of this Resolution shall be duly
certified by the City Clerk and shall be admissible in
evidence in any proceeding concerning the Housing Authority
or its functions.
