A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM GRANTING VARIANCE NO. 2665.
WHEREAS, after a request for variance by Lawrence A.
Muckenthaler, et al., owners, was received, a public hearing
before the Planning Commission of the City of Anaheim was held
upon due and proper notice as a result of which Variance No.
2665 was granted, covering the following described property:
That portion of the South half of the Southwest
quarter of the Northwest quarter of Section 9,
Township 4 South, Range 10 West in the Rancho
San Cajon de Santa Ana, City of Anaheim, County
of Orange, State of California, as per map
recorded in Book 51, Page 10 of Miscellaneous
Maps in the Office of the County Recorder of
said county, described as follows:
Beginning at the Southeast corner of said South
half; thence West along the South line of said
South half to the Southeast corner of the land
described in the deed to H. Leroy Hall et ux.,
recorded March 13, 1930, in Book 360, Page 385
of Official Records, thence North along the
East line of said land of Hall and along the
East line of Parcel 1 of the land described in
the deed to Floyd M. Hatfield et ux., recorded
April 25, 1935, in Book 745, Page 446, Official
Records to the North line of said South half;
thence East along said North line to the North-
east corner of said South half; thence South
along the East line of said South half to the
point of beginning.
EXCEPT the North 230.00 feet thereof.
ALSO except that portion thereof described in a
deed to Lawrence A. Muckenthaler, Jr., et al.,
recorded December 31, 1968, in Book 8834, Page
117 of Official Records.
WHEREAS, thereafter, within the time prescribed by
law an interested party or the City Council on its own motion
caused the review of said Planning Commission action at a
public hearing noticed and held as prescribed by law and as a
result thereof the City Council does hereby make the following
findings:
1. That there are special circumstances applicable to
the property, including size, shape, topography,
location or surroundings, which do not apply to
other property under identical zoning classifica-
tion in the vicinity.
2. That, because of special circumstances shown in
(1) above, strict application of the zoning code
deprives the property of privileges enjoyed by
other property under identical zoning classifica-
tion in the vicinity.

NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim, that a conditional zoning variance be, and
the same is hereby, granted to construct a 130 -unit apartment
complex with waivers of the following sections of the Anaheim
Municipal Code;
That said variance be granted subject to the following
conditions:
1. That this variance is granted subject to the
completion of Reclassification No. 74- 75 -19.
2. That subject property shall be developed substan-
tially in accordance with plans and specifications on file with
the City of Anaheim marked Exhibits Nos. 1, 2, and 3; provided,
however, that a six -foot (6') high masonry wall shall be
constructed along the entire westerly property line and along
the property line abutting the westerly and northerly boundaries
of the adjacent service station site located at the southeast
corner of the subject property; and that the minimum floor area
for the bachelor units shall be not less than four hundred
twenty -five (425) square feet and the number of said bachelor
units shall not exceed twenty -six (26), as shown on the
submitted plans, all as stipulated to by the petitioner.
BE IT FURTHER RESOLVED that the City Council hereby
reserves the right to revoke such variance permit for good
cause or failure of said owners, their heirs, successors or
assigns to comply with the Anaheim Municipal Code and regulations
and the conditions herein. Said variance is granted for the term
prescribed by the Anaheim Municipal Code unless otherwise speci-
fied herein.
THE FOREGOING RESOLUTION is approved and signed by me
this 4th day of February, 1975.
