1975-024RESOLUTION NO. 75R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING CONDITIONAL USE PERMIT NO. 1501 WHEREAS, the City Planning Commission of the City of Anaheim did receive an application for a conditional use permit from SEYMOUR ADLER, owner, to permit a restaurant with on -sale liquor on the following described property: That portion of the southeast quarter of the south- east quarter of Section 34, Township 3 South, Range 10 West, in the Rancho San Juan Cajon de Santa Ana, in the City of Anaheim, County of Orange, State of California, as shown on a map recorded in Book 51, Page 7 of Miscellaneous Maps, in the office of the County Recorder of said county, described as follows: Beginning at the northeast corner of the land des- cribed in the deed to Shelia Grayston and others recorded March 1, 1950, in Book 7854, Page 843, Offi- cial Records, said point being in the east line of said section, North 0° 46' 45" West 611.50 feet from the southeast corner of the southeast quarter of said section; thence along the boundary of said land, the following courses and distances: South 89° 42' 00" West 262.00 feet, South 0° 46' 45" East 15.00 feet, South 89° 42' 00" West 5.00 feet, and South 0° 46' 45" 12.90 feet to the northeast corner of the land described in the deed to Robert Crane, trustee, recorded June 6, 1968 in Book 8623 page 135, Official Records; thence along the north line of said trust land and along the north line of land described in the deed to the Arrowhead Towel and Linen Service, Inc., recorded December 23, 1965 in Book 7783 Page 282, Official Records, South 89° 42' 00" West 409.50 feet to the east line of Tract No. 4703 as shown on a map recorded in Book 169 Pages 25 and 26 of said Miscellaneous Maps; thence North 0° 46' 45" West, along said east line, 232.90 feet to the southwest corner of the land described in the deed to Hugo A. Steinmeyer and wife recorded Febru- ary 10, 1961 in Book 5626 Page 292, Official Records; thence North 89° 42' 00" East, along the south line of said last mentioned land 676.50 feet to the east line of said section; thence South 0° 46' 45" East, along said east line 205.00 feet to the point of be- ginning. EXCEPT the East 42 feet in Raymond Avenue. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said application on December 9, 19_111_, notices of which said public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, inves- tigation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing, did adopt its Resolution No.pC 4 �33g _Se granting in part Conditional Use Permit too. a 503 and WHEREAS, thereafter within twenty -two (22) days from the date of the adoption of said resolution, a written appeal was filed with the City Council protesting the action of the City Planning Commission in granting in parisaid conditional use permit and said appeal was set for public hearing on January 21 19 75 at the City Hall, in the City of Anaheim, and notices of such public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hear- ing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports; and WHEREAS, the City Council finds, after careful con- sideration of the recommendations of the City Planning Commis- sion and all evidence and reports offered at said hearing, that: 1. The proposed use is properly one for which a conditional use permit is authorized by the Anaheim Municipal Code. 2. The proposed use will not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located. 3. The size and shape of the site proposed for the use is adequate to allow the full development of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety and general welfare. 4. The traffic generated by the proposed use will not impose an undue burden upon the streets and high- ways designed and improved to carry the traffic in the area. 5. The granting of the conditional use permit under the conditions imposed will not be detrimental to the peace, health, safety and general welfare of the citizens of the City of Anaheim. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commis- sion in granting in part said conditional use permit be, and the same is hereby reversed and that Conditional Use Permit No. 1503 be, and the same is hereby, granted permitting a restaurant with on -sale liquor on the afore described property with a waiver of the following section of the Anaheim Municipal Code: Section 18.08.611 Minimum kitchen area. (25% of gross floor area required; 20% existing) that said Conditional Use Permit be granted subject to the follow- ing conditions: 1. That the owner(s) of subject property shall deed to the City of Anaheim a strip of land 45 feet in width from the centerline of the street along Raymond Avenue for street widen- ing purposes. -2- 2. That street lighting facilities along Raymond Avenue shall be installed as required by the Director of Public Utili- ties and in accordance with standard plans and specifications on file in the office of the Director of Public Utilities; and that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installa- tion of the above mentioned requirements. 3. That sidewalks shall be installed along Raymond Avenue as required by the City Engineer and in accordance with standard plans and specifications on file in the office of the City Engi- neer. 4. That trash storage areas shall be provided in accord- ance with approved plans on file with the office of the Director of Public Works. 5. That fire hydrants shall be installed and charged as required and determined to be necessary by the Chief of the Fire Department prior to commencement of structural framing. 6. That the existing structure shall be brought into full Code compliance including the Uniform Building, Plumbing, Elec- trical, Mechanical, Fire and Health Codes as adopted by the City of Anaheim; and that all work shall be performed with appropri- ate building permits and inspections. 7. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibit No. 1. 8. That Conditions Nos. 1, 2, 3, 4, 6 and 7, above mentioned, shall be complied with prior to final building and zoning inspec- tions, or within a period of 180 days from date hereof, whichever occurs first, or such further time as the Planning Commission may grant. BE IT FURTHER RESOLVED, that the City Council hereby re- serves the right to revoke such Conditional Use Permit for good cause or failure of said owner, his heirs, successors or assigne to comply with the Anaheim Municipal Code and regulations and the conditions therein.
