A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM GRANTING VARIANCE NO. 2637.
WHEREAS, after a request for variance by Howard
and Victoria Loudon, owners, was received, a public
hearing before the Planning Commission of the City of
Anaheim was held upon due and proper notice as a result
of which Variance No. 2637 was granted, covering the
following described property:
PARCEL 1:
That part of Original Building Lot 4, in the City
of Anaheim as shown on a map of Anaheim, thereof
recorded in book 4, pages 629 and 630, Deeds,
records of Los Angeles County, California,
described as follows:
Beginning at the Southwesterly corner of said Lot
4 and running thence Northerly along the Westerly
line of said Lot, 28 1/2 feet; thence Easterly
and parallel with Sycamore Street 8 1/2 rods to
the Easterly line of said lot; thence Southerly
along said Easterly line 28 1/2 feet to the South-
easterly corner of said lot; thence Westerly
along the Southerly line of said lot and parallel
with said Sycamore Street 8 1/2 rods to the point
of beginning.
Also that part of Original Building Lot 8 as shown
on a map of Anaheim, recorded in book 4, pages
629 and 630, of Deeds, records of Los Angeles
County, California, described as follows:
Beginning at the Northwesterly corner of said Lot
8 and running thence Easterly along the Northerly
line of said Lot 8 and parallel with Sycamore
Street 8 1/2 rods; thence Southerly along the
Easterly line of said Lot 8, 21 1/2 feet; thence
Westerly parallel with said Sycamore Street 8 1/2
rods to the Westerly line of said Lot 8; and thence
Northerly along the Westerly line of said Lot 8,
21 1/2 feet to the point of beginning.
Note: The title to Parcel 1 covered by this
report has been registered under the provisions of
the Land Title Law in the office of the Registrar
of Titles of said County of Orange, and the
certificate of the Registrar, No. 11047, issued
thereon, dated May 2, 1946.
PARCEL 2:
That part of Original Building Lot 8, as shown
on a map of Anaheim, recorded in book 4, pages
629 and 630, of Deeds, records of Los Angeles
County, California, described as follows:

Beginning at a point in the Westerly line of said
Lot 8, 21 1/2 feet South of the Northwest corner
of said Lot 8; thence Southerly along said West-
erly line 50 feet; thence Easterly and parallel
with Sycamore Street 8 1/2 rods to the Easterly
line of said Lot 8; thence Northerly along said
Easterly line 50 feet to a point 21 1/2 feet
Southerly of the Northeasterly corner of said Lot
8; thence Westerly 8 1/2 rods to the point of
beginning.
Note; The title to Parcel 2 covered by this report
has been registered under the provisions of the
Land Title Law in the office of the Registrar of
Titles of said County of Orange, and the certificate
of the Registrar No. 11046, issued thereon, dated
May 2, 1946.
PARCEL 3:
Commencing on the Easterly line of Lemon Street at
a point 60 feet from the. Northeast corner of Lemon
and Adele Streets, running thence Northerly along
the line of Lemon Street 50 feet; thence Easterly
140 feet; thence Southerly 50 feet; thence Wester-
ly 140 feet to beginning, being part of Original
Building Lot 8, in the City of Anaheim, as shown
on a map thereof recorded in book 4, pages 629 and
630, of Deeds, records of Los Angeles County,
California.
PARCEL 4:
That portion of Original Building Lot 4 of Anaheim,
as shown on a map thereof recorded in book 4, pages
629 and 630, Deeds, in the office of the County
Recorder of Los Angeles County, California, described
as follows:
Beginning at a point in the Westerly line of said
Lot 4 distant 28 1/2 feet North of the Southwest
corner of said lot; thence Northerly along said
Westerly line 50 feet; thence Easterly parallel
with Sycamore Street 8 1/2 rods to the Easterly line
of said lot; thence Southerly along said Easterly
line 50 feet to a point 28 1/2 feet Northerly of
the Southeasterly corner of said lot; thence Wester-
ly 8 1/2 rods to the point of beginning.
WHEREAS, thereafter, within the time prescribed by
law an interested party or the City Council on its own motion
caused the review of said Planning Commission action at a
public hearing noticed and held as prescribed by law and as a
result thereof the City Council does hereby make the following
findings:

1. That there are special circumstances applicable to
the property, including size, shape, topography,
location or surroundings, which do not apply to
other property under identical zoning classifica-
tion in the vicinity.
2. That, because of special circumstances shown in
(1) above, strict application of the zoning code
deprives the property of privileges enjoyed by
other property under identical zoning classifica-
tion in the vicinity.
NOW, THEREFORE, BE IT RESOLVED by the City
Council of the City of Anaheim, that a conditional zoning
variance be, and the same is hereby, granted permitting
a 64 unit, four -story apartment complex for the elderly
with waivers of the following sections of the Anaheim
Municipal Code:
SECTION 18.28.
SECTION 18.28.050(5)(a) Maximum building height. (2-
stories permitted; 4- stories
proposed)
SECTION 18.32.050(2)
SECTION 18.28.050(10)(a)2 Minimum off- street parking.
(96 spaces required; 26 spaces
proposed)
SECTION 18.28.050(10)(a)2 Minimum number of covered park-
ing spaces. (13 covered spaces
required; none proposed)
SECTION 18.32.050(3) Maximum coverage. (55% permit-
ted; 57% proposed)
SECTION 18.32.050(4) (a)
That said variance be granted subject to the following
conditions:
1. That fire hydrants shall be installed and
charged as required and determined to be necessary by the
Chief of the Fire Department, prior to commencement of
structural framing.
2. That trash storage areas shall be provided in
accordance with approved plans on file with the office of the
Director of Public Works.

3. That the structure shall be classified as a
Class D -3 occupancy, to provide for fire sprinklers, etc., as
stipulated to by the petitioner.
4. That the owner(s) of subject property shall pay
to the City of Anaheim the appropriate park and recreation in-
lieu fees as determined to be appropriate by the City Council,
said fees to be paid at the time the building permit is issued.
5. That subject property shall be developed
substantially in accordance with plans and specifications on
file with the City of Anaheim marked Exhibits Nos. 1, 2 and 3.
6. That Conditions Nos. 2, 4 and 5, above mentioned,
shall be complied with prior to final building and zoning
inspections.
7. That six additional parking spaces be located
within not more than 300 feet of the apartment complex and
that the property for these spaces be either purchased and
held specifically for this purpose or a long -term lease be
arranged, the conditions of which are to be approved by the
City Attorney and City Council.
8. That Condition No. 7 may be reviewed after two
years of operation of the facility, at the request of the
Petitioner, and will be subject to release on Council approval,
should these six additional spaces be deemed unnecessary at
that time.
BE IT FURTHER RESOLVED that the City Council hereby
reserves the right to revoke such variance permit for good
cause or failure of said owners, their heirs, successors or
assigns to comply with the Anaheim Municipal Code and regulations
and the conditions herein. Said variance is granted for the term
prescribed by the Anaheim Municipal Code unless otherwise speci-
fied herein.
THE FOREGOING RESOLUTION is approved and signed by me
