RESOLUTION NO. 75R -2
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM DENYING VARIANCE NO. 2647.
WHEREAS, after a request for variance by Ida Rannow
and Marion Rannow was received, a public hearing before the
Planning Commission of the City of Anaheim was held upon due and
proper notice as a result of which Variance No. 2647 was denied
covering the following described property:
The North 1/2 of the Northeast 1/4 of the Southeast
1/4 of Section 20 Township 4 Range 10
WHEREAS, thereafter, within the time prescribed by law
an interested party or the City Council on its own motion caused
the review of said Planning Commission action at a public hearing
noticed and held as prescribed by law and as a result thereof the
City Council does hereby make the following findings:
1. There is no substantial property right possessed
by other property in the same vicinity and zone
and denied the subject property.
2. It appears that the subject property can be
adequately developed and used under the present zone.
3. That the proposed use does not comply with the Anaheim
General Plan.
4. That the continued conduct of the use is not pursuant
to the best interests of the Community and violates the
public health, safety, and welfare.
5. That the use has continued to operate for several years
in complete disregard and neglect of City Codes, despite
repeated requests and demands of the City to bring the
structure up to Code requirements.
6. That the parking situation at the establishment poses
a potentially dangerous circumstance as it relates to
vehicular ingress and egress to Euclid Street.
7. That granting of the requested variance would be
materially detrimental to the public welfare and
injurious to the property and improvements in such
vicinity and zone in which said property is located.
8. That the applicant's agent Herman Margulieux advised
the City Council that no further extensions of this use
would be requested.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that said Variance be, and the same is hereby,
denied.
