05-05-26_Action with Comments ANAHEIM CITY COUNCIL ACTION AGENDA MAY 5, 2026 ▪ ORDER OF BUSINESS: Public sessions of all regular meetings of the City Council/Successor Agency to the Redevelopment Agency/Housing Authority/Public Financing Authority/Housing and Public Improvements Authority begin at 5:00 P.M. Public hearings begin at 5:30 P.M. unless otherwise noted. Closed sessions begin at 3:00 P.M. or such other time as noted. Closed sessions may be preceded by one or more public workshops. Public comments are limited to three (3) minutes per speaker, unless a different time limit is announced. The City uses speaker cards that must be submitted to the City Clerk in order to address the City Council. Prior to the business portion of the agenda, the City Council and all other related agencies meeting on such date will convene in joint session for the first Public Comment period where speakers will be permitted to speak on specific agenda item(s). This first Public Comment period is limited to 90 minutes or until all agenda item speakers have been heard, whichever is later. Any remaining time shall be provided to non-agenda item speakers until the 90 minute time limitation is exhausted. The second Public Comment period will be opened by the Mayor if any non-agenda item speakers were not called during the first Public Comment period. For public hearings, the Mayor or Chairperson will separately call for testimony at the time of each public hearing. Testimony during public hearings is subject to the following time limits: Project applicant or issue initiator: twenty minutes for initial presentation and ten minutes for rebuttal; Residents within the noticed area of the subject property: ten minutes; All other members of the public: three minutes. Public hearings regarding legislative matters: five minutes. The Mayor or Chairperson may limit the length of comments during public hearings due to the number of persons wishing to speak or if comments become repetitious or irrelevant. Speakers shall refrain from profane language and other disruptive remarks or behavior which disrupts or disturbs the meeting, or risk being removed (AMC 1.12.017). Additionally, members of the public may correspond with the City Council and all other related agencies, on any agenda items or matters within the jurisdiction of such governing bodies, by submitting comments electronically for City Council consideration by sending them to publiccomment@anaheim.net. To ensure distribution to the City Council prior to consideration of the agenda, please submit comments at least 2 hours prior to the scheduled start time of the meeting. Those comments, as well as any comments received after that time, will be distributed to the City Council, posted on the City’s website, and will be made part of the official public record of the meeting. Public Comments Submitted – May 5, 2026 City Council Meeting (limited to 90 minutes, or until all agenda item speakers have been heard; any time remaining shall be provided to non-agenda item speakers) COUNCIL COMMUNICATIONS: Council Member Maahs shared that on Saturday, April 25th, she hosted “Clean Up with a Council Member” at Pioneer Park. She noted it was the inaugural effort of the monthly cleanup. She added that the effort grew out of conversations with local students who shared their interests in cleaner parks and public spaces, which drew from Green Bird Anaheim. She noted that the event would continue as a monthly effort, with the next clean-up scheduled for Saturday, May 23rd at Aloe Greens Park. She shared that closed-toe shoes are required and supplies are available. She noted that a former Anaheim firefighter and current Police volunteer participated. Council Member Maahs shared that on April 26th at Juarez Park, her office created a simple space for neighbors to connect and meet. She added that she shared mental health resources with families in an approachable and natural way. She shared that the event reinforced that public art in public spaces could play a role in mental wellness. She reported that following the event, flowers were shared with local seniors. She thanked Araceli with Victoria’s Garden for her vision and talent, and Martha Rangel for her partnership in bringing the event to life. Council Member Maahs recognized District 5 resident Nate Enriquez. She shared that he is the starting goalkeeper at Mater Dei High School and played a key role in an exceptional season. She highlighted his accomplishments and high level of discipline and focus while balancing schoolwork. She acknowledged his parents for their time and support behind that commitment. She added that she would be requesting a recognition for him. Council Member Maahs congratulated South Junior High School for earning the 2026 Civic Learning Award of Excellence, the highest recognition in California for safe civic education. She noted it is the second time the school has received the honor. She shared that she has had the opportunity to work closely with staff and leadership at South, and with students who speak on issues including littering, crossing guards, and mental health. She noted that students are not only the future but also shaping today. Mayor Pro Tem Leon reported that he joined the Anaheim Union High School District for their districtwide Parent Celebration Breakfast. He shared that the event was well attended and a well-deserved moment to recognize the parents who show up for their children and children across the community. He highlighted the community gathering to celebrate and have fun. Mayor Pro Tem Leon highlighted the Cinco de Mayo Festival and recognized the Community Services Department for organizing the event and City staff and community members who attended. Mayor Pro Tem Leon reported that he joined the Team Kids Teen Council at the Orange County Family Justice Center for a clothing donation drive. He noted that the event was student-led. He shared that the students identified a need and displayed initiative to host the event. He thanked Lieutenant Pena and the entire team and the Orange County Family Justice Center for their continued commitment in supporting the community. Mayor Pro Tem Leon thanked Anaheim Public Utilities for stopping by a District 2 neighborhood where residents could pick up Dusk to Dawn lights and connect directly with residents. He thanked staff for being accessible to residents to access resources close to home. He highlighted an attendee in an Anaheim Ducks jersey in recognition of the playoffs. Mayor Pro Tem Leon requested to adjourn the meeting in memory of Father John Monestero from St. Justin Martyr Church. He shared that Father Monestero was part of the community’s everyday lives. He highlighted his service, the meaning behind his masses, and his spirit. He added that his ministry extended beyond the church and into the community. 4 May 5, 2026 Mayor Aitken reported her attendance at the Cal Cities conference in Sacramento to meet with legislators and other delegates from the League of California Cities. She thanked City Clerk Theresa Bass for inviting her to the California Municipal Clerks Association annual conference. She highlighted the vital role of clerks, including administering elections, responding to public records requests, preserving City records, and supporting the organization of City Council agendas. She thanked City Clerk Bass and the City Clerk’s Office for their work. Mayor Aitken reported her attendance at UCI’s city-by-city panel on immigration, sharing cities’ responses to immigration enforcement and the needs created due to those enforcement efforts. She highlighted the City’s work responding to enforcement efforts through Anaheim Contigo and with grants distributed by the Anaheim Community Foundation. Mayor Atiken shared that the State of the City was held the week prior, with several hundred in attendance to raise money for the Anaheim Community Foundation. She shared that Ally Kay, announcer for the Anaheim Ducks, and Tim Kepler attended the event. She thanked the Communications team, led by Chief Communications Officer Mike Lyster for their work in putting the event together. Mayor Aitken shared that she attended the Anaheim Chamber of Commerce’s Annual Angels Luncheon to raise money for different nonprofits to ensure that children from all backgrounds have resources and equipment to play baseball. She thanked the Chamber of Commerce for the invitation. CITY MANAGER’S UPDATE: Interim City Manager Garcia shared that the initial testing of the stadium has been completed and the next phase is to perform an analysis and assessment of those results. The final phase this fall includes use of a structural consultant to complete the final review and provide a final assessment. He announced the upcoming community open houses in June, across all six Districts. The community meetings will start in District 1 on June 3 and end in District 6 on June 18. Interim City Manager Garcia encouraged residents to drop in any time between 5:00 p.m. to 7:00 p.m. to engage with City departments regarding subjects they are interested in. Receive and file minutes of the Anaheim Tourism Improvement District special meeting of February 26, 2026; the Cultural and Heritage Commission meeting of March 19, 2026; the Library Board meeting of February 9, 2026; the Older Adults Commission meeting of March 19, 2026; the Parks and Recreation Commission meeting of March 25, 2026; and the Public Utilities Board meeting of March 25, 2026. 2. Approve Master Agreement Contract No. 106-499104 with Hasa, Inc., in an amount not to exceed $123,765.50 for a one year term with up to four one-year optional renewals for a cumulative amount not to exceed $618,827.50 plus applicable CPI increases and a 15% contingency, for maintenance and repair of City park water features; and authorize the Purchasing Agent, or designee, to execute all necessary contractual documents related to the agreement in accordance with Invitation For Bids #9872. 5 May 5, 2026 3. Award the contract to the lowest responsible bidder, Ramona, Inc., in the amount of $216,276, for the Broadway and Elder Street Sanitary Sewer Improvements Project; authorize the Director of Public Works, to execute the contract and related documents and to take the necessary actions to implement and administer the contract; determine the Project is categorically exempt from the California Environmental Quality Act pursuant to Class 3, Section 15303 (d) (New Construction) of Title 14 of the California Code of Regulations; and authorize and direct the Finance Director to execute the Escrow Agreement pertaining to contract retentions. 4. Award the contract to the lowest responsible bidder, Guy F. Atkinson Construction, LLC, in the amount of $23,743,815, for the Orangewood Avenue Bridge Widening over the Santa Ana River Project; authorize the Director of Public Works to execute the contract and related documents and to take the necessary actions to implement and administer the contract; and authorize and direct the Finance Director to execute the Escrow Agreement pertaining to contract retentions. 5. Approve the Professional Services Agreement, in substantial form, with NCB Incorporated, in an amount not to exceed $250,000 per Work Order Package with a total contract amount not to exceed $500,000 per contract year (cumulative amount not to exceed $2,500,000) plus a 15% contingency for as needed extra services, for a term ending September 3, 2027 with two one-year optional renewals for as-needed grant writing services to support the Design Services Section of the Department of Public Works; authorize the Director of Public Works to execute the agreement and to take any and all actions as are necessary, required, or advisable to implement and administer the agreement; and authorize de minimis changes that do not substantially change the terms and conditions of the Agreement, so long as such changes are determined to be de minimis by the City Attorney’s Office. 6. Approve the Agreement for Sale of Property and Joint Escrow Instructions, in substantial form, with ATN Asset Holding Company, LLC, for the City’s acquisition and use of real property located at 1354 South Anaheim Boulevard, in the acquisition amount of $9,500,000, and authorize the Public Works Director to sign the Certificate of Acceptance of Interest in Real Property attached to the Grant Deed and authorize the City Clerk, in accordance with the aforementioned Agreement, to cause said Certificate of Acceptance of Interest in Real Property to be released to the authorized escrow agent for the recording of the Grant Deed in the Office of the County Recorder of Orange County; approve a Memorandum of Understanding (MOU), in substantial form, with the Anaheim Tourism Improvement District Transportation Committee providing that the Property will be maintained for eligible transportation purposes and requires that, if the Property is not used for such purposes or is sold, the net proceeds from any disposition will be returned to the ATID Transportation Component Fund; authorize and direct the Public Works Director to execute the Agreement, the MOU, and all other related documents and to take such actions as are necessary to implement and administer the Agreement and the MOU, and authorize de minimis changes that do not substantially change the terms and conditions of the Agreement and MOU, so long as the changes are determined to be de minimis by the City Attorney’s Office; find that the above actions are exempt from the California Environmental Quality Act (“CEQA”) pursuant to Sections 15004(b)(2)(A) and 15061(b)(3) of the CEQA Guidelines; and amend the Public Works FY 2025/26 budget by $9,500,000, funded from the ATID Transportation Component Fund. 6 May 5, 2026 7. Approve an agreement with The Vitality Group, LLC, in the estimated annual amount of $124,105 with additional administrative fees, for an employee wellness program, for a three year term, with two one-year optional renewals, and authorize the Human Resources Director, or designee, to execute renewal options, and any other related actions and documents necessary to implement and administer the agreement (services will be fully funded by the City’s health insurance partner, Blue Shield, through a wellness stipend). 8. RESOLUTION NO. 2026-039 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM approving a Labor Management Workers' Compensation Alternative Dispute Resolution Agreement between the Anaheim Police Association and the City of Anaheim. Authorize the Director of Human Resources to execute the Agreement and take any and all actions necessary to implement and administer the Agreement. 9.
