A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM GRANTING VARIANCE NO. 2766.
WHEREAS, after a request for variance by
Texaco -Anaheim Hills, Inc., owner, was received, a public
hearing before the Planning Commisison of the City of
Anaheim was held upon due and proper notice as a result of
which Variance No. 2766 was granted covering the following
described property:
All that certain land situated in the State of
California, County of Orange, City of Anaheim,
described as follows:
Proposed Tract No. 8905, being a subdivision
of the following:
That portion of the lands allotted to Juan Yorba
and Paula Peralta de Dominguez as described in
the Final Decree of Partition of the Rancho
Santiago de Santa Ana, as per map of partition
recorded on September 12, 1868, in Book "B".
page 410 of Judgments of the 17th Judicial
District Court, of Los Angeles County, State of
California, described as follows:
Beginning at the most Northerly corner of Parcel
1, as shown on a map filed in book 50, page 43 of
Parcel Maps, records of said Orange County;
thence along the boundary of said Parcel Map,
South 83° 25' 15" Nest 258.59 feet, South 70° 51'
57" West 338.29 feet and South 610 10' 37" West
45.00 feet to a point on a non -tangent curve
concave Southwesterly with a radius of 600..00
feet said curve being the centerline of Anaheim
Hills Road as shown on said Parcel Map and said
curve being concentric with that certain curve
cited as being concave Westerly with a radius
of 555.00 feet to a central angle of 600 051 18"
in the Westerly boundary of Parcel 1 of deed
recorded May 16, 1972 in book 10128, page 922 of

having a radius of 605.00 feet a distance of
371.42 feet through a central angle of 350 10'

171.97 feet, Northerly along a tangent curve
concave Westerly having a radius of 621.00 feet
a distance of 236.31 feet through a central angle

of said Orange County; thence along the boundary
of said Record of Survey, South 30 42t 45" East
762.96 feet; South 290 381 12 East 763.99 feet

Northerly boundary of Parcel 2, as shown on a
map filed in book 57, pages 6 and 7 of Parcel
Maps, records of said Orange County; thence along
the boundary of said Parcel Map South 66° 33' 5611
West 206.57 feet and South 130 441 5711 East 48.13
feet to the point of beginning.
WHEREAS, thereafter, within the time prescribed by
law an interested party or the City Council on its own motion
caused the review of said Planning Commission action at a
public hearing noticed and held as prescribed by law and as a
result thereof the City Council does hereby make, the following
findings:
1. That there are special circumstances applicable to
the property, including size, shape, topography,
location or surroundings, which do not apply to
other property under identical zoning classifica-
tion in the vicinity.
2. That, because of special circumstances shown in
(1) above, strict application of the zoning code
deprives the property of privileges enjoyed by
other property under identical zoning classifica-
tion in the vicinity.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that a conditional zoning variance be,
and the same is hereby, granted to construct a 25 -unit,
RM -4000 (SC) Subdivision with waivers of the following
sections of the Anaheim Municipal Code:
SECTION 18.31.063.024 - Minimum building setback
abutting one -family residential
zoning. (20 feet required; 2,
5, 11, 18 and 19 feet proposed)

SECTION 18-31-06,5.0ll - Minimum distance between
buildings. (1.0 feet required;
5 feet proposed)
SECTION 18.84.052'.020 - Minimum building setback from
an arterial highway. (50 feet
required; 30, 40 and 45 feet
proposed)
That said variance be granted subject to the following
conditions:
1. That this Variance is granted subject to the
completion of Reclassification No. 75-76-20, now pending.
2. That subject property shall be developed
substantially in accordance with plans and specifications on
file I -with the,City of - Anaheim -marked Exhibits4-Nos.-12 2., 3,
-4 and 5.
3. That the petitioner stipulated the driveways
were not to be considered as private streets.
4.� That the'petitioner stipulated that no trees
would be removed.
The City Council hereby reserves.the right to
revoke such Conditional Use Permit for good cause or failure
of said owner, its successors or assigns to comply with the
Anaheim Municipal Codle,and regulations and the conditions
herein.
THE FOREGOING RESOLUTION is approved and signed by
