A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM GRANTING C014DITIONAL USE PERMIT
NO. 1584.
WHEREAS, the City Planning Commission of the City
of Anaheim did receive an application for a conditional use
permit from Texaco -Anaheim Hills, Inc., owner, to permit a
Model Home Complex on the following described property:
All that certain land situated in the State of
California, County of Orange, City of Anaheim,
described as follows:
Proposed Tract No. 8905, being a subdivision
of the following:
That portion of the lands allotted to Juan Yorba.
and Paula, Peralta de Dom.inguez'.as described in
the final Decree of Partition of the Rancho
Santiago de Santa Ana, as per map of partition
recorded on September 12, 1868, in Book "B",
page 410 of Judgments of the 17th Judicial
District Court, of Los Angeles County, State of
California, described as follows
Beginning at the most Northerly corner of Parcel
1, as shown on a map filed in book 50, page 43 of
Parcel Maps, records of said Orange County;
thence along the boundary of said Parcel Map,
South 831 25' 15" West 258,59 feet, South 70° 511
57" West 338.29 feet and South 610 10' 3711 West
45.00 feet to a point on a non -tangent curve
concave Southwesterly with a radius of 600.00
feet said curve being the centerline of Anaheim
Hills Road as shown on said Parcel Map and said
curve being concentric with that certain curve
cited as being concave Westerly with a radius
of 555.00 feet to a central angle of 601. 05' 181'
in the Westerly boundary of Parcel 1 of deed
recorded May 16, 1972 in book 101.28, page 922 of
Official Records of said Orange County, a radial
to said point bears North 61° 10' 37" East;
thence Northwesterly along said concentric curve
a distance of 74.36 feet through a central angle
of 7° 061 03"; thence parallel and concentric
with said Westerly boundary the following courses:
tangent to said last mentioned curve North 35° 551
26" West 109.84 feet, Northwesterly along a
tangent curve ,concave Northeasterly having a
radius of 595.00 feet a distance of 144.23 feet
through a central angle of 130 531 1911, a tangent
to said curve North 221 021 07" West 48.4.66 feet,
Northerly along a tangent curve concave Easterly
having a radius of 605.00 feet a distance of
371.42 feet through a central angle of 35 101.

concave Westerly having a radius of 621.00 feet
a distance of 236.31 .feet through a central angle
of 210 48' 0911, tangent to said curve North 80

Northerly terminus of that certain course shown
as 'IN 30 421 45" W,762.96 feet" on map filed in
book 91, page 40 of Records of Surveys., records
of said Orange County; thence along the boundary
of said Record of Survey, South 31 421 4511 East
762.96 feet; South 290 381 1211 East 763.99 feet
South 791 471 2911 East 310..42 feet, North 100 131
5611 East 100.03 feet, South 79' 571 1411 East
99.93 feet, South 100 171 18" West 100.56 feet
and South 790 57' 17" East 100,11 feet to the
Northerly boundary of Parcel 2, as shown on a
map filed in book 57, pages 6 and 7 of Parcel
Maps, records of said Orange County; thence along
the boundary of said Parcel Map South 660 331 56"
West 206.57 feet and South 130 44t 57" East 48.13
feet to the point of beginning.
AND WHEREAS, the City Planning Commission did
hold a public hearing at the City Hall in the City of
Anaheim upon said application on December 8, 1975, notices of
which said public hearing were duly given as required by law
and the provisions of Title 18, Chapter 18-76 of the Anaheim
Municipal Code; and
WHEREAS, said Commission, after due inspection,
investigation and studiesmadeby itself and in its behalf and
after due consideration of all evidence and reports offered
at said hearing, did adopt its Resolution No. PC 75-253
granting Conditional Use Permit No. 1584; and
�rTHEREAS, thereafter, within twenty-two (22) days
from the date of the adoption of said resolution, the City
Council did elect, upon its own motion, to review the action
of the City Planning Commission in granting said conditional
use permit and did thereupon fix the 6th day of January, 1976,
as the time and the Council Chamber in the City Hall of the
City of Anaheim as the place for a public hearing upon said
conditional use permit, and notices of such public hearing
were duly given as required by law and the provisions of
Title 18, Chapter 18-76 of the Anaheim Municipal Code; and
WHEREAS, at the time and place fixed for said
public hearing., the City Council did duly hold and conduct
such hearing and did give all persons interested therein an
opportunity.to be heard and did receive evidence and reports;
and

WHEREAS, the City Council finds, after careful
consideration of the recommendations of the City Planning
Commission and all evidence and reports offered at said
hearing, that:
1. The proposed use is properly one for which a
conditional use permit is authorized by the
Anaheim Municipal Code.
2. The proposed use will not adversely affect the
adjoining land uses and the growth and develop-
ment of the area in which it is proposed to be
located.
3* The size and shape of the site proposed for
the use is adequate to allow the full develop-
ment of the proposed use in a manner not
detrimental to the particular area nor to the
peace, health, safety and general welfare.
4. The traffic generated by the proposed use will
not impose an undue burden upon the streets and
highways designed and improved to carry the
traffic in the area.
5. The granting of the conditional use permit under
the conditions imposed will not be detrimental
to the peace, health, safety and general welfare
of the citizens of the City of Anaheim.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that the action of the City Planning
Commission granting said conditional use permit be, and the
same is hereby sustained, and that Conditional Use Permit
No. 1584 be, and the same is hereby, granted permitting a
Model Home Complex on the hereinbefore described property,
subject to the following conditions:
1. That trash storage areas shall be provided in
accordance with approved plans on file with the office of
the Director of Public Works.
2. That fire hydrants shall be installed and
charged as required and determined to be necessary by the
Chief of the Fire Department prior to commencement of struc-
tural framing.
3. That subject property shall be served by under-
ground utilities.
4. That drainage of subject property shall be
disposed of in a manner satisfactory to the City Engineer.
5. That public utility easements shall be granted
as required by the Director of Public Utilities.
6. That this conditional use permit shall remain
in full force and effect for a period of two (2) years from
the date hereof or until all of the homes in Tract No. 8905
are initially sold, whichever occurs first, or such further
time as the Planning Commission and/or City Council may grant.
7. That a bond in an amount and form satisfactory
to the City of Anaheim shall be posted with the City to
guarantee the removal of the models in the event the final map
of Tract No. 8905 is not recorded.
8. That subject property shall be developed
substantially in accordance with plans and specifications on
file with the City of Anaheim marked Exhibits Nos. 1, 2, 3,
4 and 5.
9. That Condition No. 7., above-mentioned, shall be
complied with prior to the commencement of the activity
authorized under this resolution, or prior�to the time that
the building permit is issued,°or within a period of one year
from date hereof, whichever occurs first., or such -further
time as the Planning Commission and/or City Council may grant.
10.` .That fire hydrants shall be installed and
charged�as required and determined to be necessaryby the
Chief of the. Fire DeDartment prior to commencement of
structural framing.

11, That, the petitioner,stiT)ulated-the driveways
were not to be considered as private streets.
12. That the petitioner stipulated no trees would
be removed.
The City Council hereby reserves the right to
revoke such Conditional Use -Permit for good cause or failure
of said owner., its successors or assigns to comply with the
Anaheim Municipal Code and regulations and the conditions
herein.
THE FOREGOING RESOLUTION is approved and signed by
