A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM GRANTING CONDITIONAL USE PERMIT
NO. 1571
WHEREAS, the City Planning commission of the City of
Anaheim did receive an application for a conditional use permit
from James P. and Phyllis J. Crawford, owners, to permit an out-
door tennis facility and private club with on -sale liquor on
RS -A-43,000 zoned property described as:
PARCEL 1: The Southwest quarter of the Northeast
quarter of the Northeast quarter of Section 21,
Township 4 South, Range 10 West, in the Rancho San
Juan Cajon de Santa Anal in the City of Anaheim,
as shown on a map recorded in book 51, page 10 of
Miscellaneous Maps, records of Orange County,
California.
AND WHEREAS, the City Planning Commission did hold a
public hearing at the City Hall in the City of Anaheim upon
said application on I October 29 , 19 75, notices of which
said public hearing were duly g1veH as reared by law and the
provisions of Title 18, Chapter 18.76 of the Anaheim Municipal
Code; and
WHEREAS, said Commission, after due inspection, inves-
tigation and studies made by itself and in its behalf and after
due consideration of all evidence and reports offered at said
hearing, did adopt its Resolution No P�;75-218ftries

subject to certain conditions therein set forth 3 and

WHEREAS, thereafter within twenty-two (22) days from
the date of the adoption of said resolution, a written appeal
was filed with the City Council protesting the action of the
City Planning Commission in granting said conditional
use permit and said appeal was set for public hearing on
December 9 , 1975, , at the City Hall, in the City of
Anaheim, and notices of such public hearing were duly given as
required by law and the provisions of Title 18, Chapter 18.76
of the Anaheim Municipal Code; and
WHEREAS, at the time and place fixed for said public
hearing, the City Council did duly hold and conduct such hear-
ing and did give all persons interested therein an opportunity
to be heard and did receive evidence and reports; and
WHEREAS, the City Council finds, after careful con-
sideration of the recommendations of the City Planning Commis-
sion and all evidence and reports offered at said hearing, that:
1. The proposed use is properly one for which a
conditional use permit is authorized by the
Anaheim Municipal Code.
2. The proposed use will not adversely affect the
adjoining land uses and the growth and development
of the area in which it is proposed to be located.
3. The size and shape of the site proposed for the
use is adequate to allow the full development of
the proposed use in a manner not detrimental to
the particular area nor to the peace, health,
safety and general welfare.
4. The traffic generated by the proposed use will not
impose an undue burden upon the streets and high-
ways designed and improved to carry the traffic in
the area.
5. The granting of the conditional use permit under
the conditions imposed will not be detrimental to
the peace, health, safety and general welfare of
the citizens of the City of Anaheim.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the action of the City Planning Commis-
sion in granting said conditional use permit be, and the
same is hereby sustained , and that Conditional Use Permit
No. 1571 be, and the same is hereby, granted permitting
the establishment of an outdoor tennis facility and private club
with on -sale liquor on property hereinbefore described,.zoned
RS -A-43,000, subject to the following conditions:
1. That the owner(s) of subject property shall deed to the
City of Anaheim a strip of land 57 feet in width from the center-
line of the street along Walnut Street.
2. That all engineering requirements of the City of Anaheim
along Walnut Street including preparation of improvement plans and
installation of all improvements such as curbs and gutters, side-
walks, street grc
i-iding and paving, drainage facilities, or other
appurtenant work shall be complied with as required by the City
Engineer and in accordance with standard plans and specifications
on file in the office of the City Engineer; that street lighting
facilities along Walnut Street shall be installed as required by
the Director of Public Utilities and in accordance with standard
plans and specifications on file in the office of the Director of
Public Utilities and that a bond in an amount and form satisfac-
tory to the City of Anaheim shall be posted with -the City to guar-
antee the installation of the above-mentioned requirements.
3. That the owner(s) of subject property shall pay to the
City of Anaheim the sLum of sixty cents per front foot along Wal-
nut Street for tree planting purposes.
4. That trash storage areas shall be provided in accordance
with approved plans on file with the Office of the Director of
Public Works.
5. That fire hydrants shall be installed and charged as re-
quired and determined to be necessary by the Chief of the Fire
Department prior to commencement of structural framing.
6. That subject property shall be served by underground
utilities.
7. That drainage of subject property shall be disposed of
in a manner satisfactory to the City Engineer.
8. That this conditional use permit is granted subject to
the completion of Reclassification No. 66-611-61, now pending.
9. That appropriate water assessment fees as determined by
the Director of Public Utilities shall be paid to the City of
Anaheim prior to the issuance of a building permit.
10. That any exterior lighting shall be down -lighted and
directed away from the adjacent property lines to protect the
residential integrity of the area.
11. That subject property shall be developed substantially
in accordance with plans and specifications on file with the City
of Anaheim marked Exhibit Nos. 1, 2 and 3; provided, however, that
a heavily landscaped earthen berm with height of two and one-half
to three feet shah be provided in the front setback area along
the west property line in front of the proposed five (5) foot high
block wall, said wall to be five (5) feet high as measured from
the highest finished grade level at the base of the wall; and that
specific landscaping plans be reviewed and approved by the City
Planning Commission; as stipulated to by the petitioner.
12. That Condition Nos. 1, 2, 3 and 8, above-mentioned, shall
be complied with prior to the commencement of the activity author-
ized under this resolution, or prior to the time that the building
permit is issued, or within a period of one year from date hereof,
whichever occurs first, or such further time as the Planning Com-
mission and/or City Council may grant.
13. That Condition Nos. 4, 6, 7, 10 and 11, above iientioned,
shall be complied with prior to final building and zoning inspec-
tions.

14. That the hours of operation shall be from 7:00 a.m. to
10:00 P.m. as stipulated to by the petitioner; provided, however,
that upon written request by the petitioner, said hours of opera-
tion shall be reviewed for determination as to whether the hours
of operation should be extended, but action to extend or change
said hours of operation shall be taken only at a duly advertised
public hearing.
15. That this conditional use permit shall be granted for on -
sale beer and wine only and that said activity shall occur only
during the approved hours of operation, as stipulated to by the
petitioner.
