A RESOLUTION OF THE CITY COUNCIL OF T CITY
OF ANAHEIM GRWNT-INIGr VARIA11ATCE NO. 2802.
W11HEREAS, after a request for variance by Dilperial
Properties, owner; Robert D. Haugaardr Jr -r. agent, was received,
a public hearing before the Planning Cornmmission of the City of
Anaheir. was held upon due and proper notice, a result of which
Variance No. 2802 was granted, covering the following described
property:
That portion of Lot 4 of the Dominguez Estate as
shown on a Licensed Surveyor's Map filed in book 2,
page 'j-5 of Record of Surveys in the office 4 of the
County Recorder of orange County, California,

Beginning at the Southwesterly corner of Tract No.
7470 as shown on a Map recorded in book 326, pages
18, 19 and 20 of L,,liscellaneous Maps, records of
said orange Countyr being a point on the Northwest-
erlv line of the Santa Ana Valley Irrigation Company
as aescribed in deed recorded March 7, 1940 in book

1. That there are special circurnstances applicable to the
property including size, shape, topography, location or s=ro-"1nd-

ings, which do not apply to other -ro-perty under identical zoning
classification in the vicinity
2. 1 t f -hat, because of special circu-nistances shown in (1)
above, strict application of the zoning code deprives Cie property
of privileges enjoyed by other property under identical zoning
classification in the vicinity.
NOW, THEREFOREE, BE IT RESOLVE!) by the City Council Of
the City of AnaheiT_q that a conditional zoning variance be, and
the same is hereby granted, permitting a drive-t"hrough restaurant

hereinbefore described with waivers of the following section of
the Anaheim 'ivjunicipal Code:

That said variance be granted subject to the following conditions:
1. That the property owner(s) shall proport-ionately, on
the basis of acreage, participate in the costs of furnishing and
installing a traffic signal at the intersection of Santa Ana Canyon
Road and Via Cortez, said participation to be 35% of the total cost
($40,000) and a -mounting to $14,000, and said artiount shall be paid
prior to the issuance of building periAt- s
2. That subject property shall be developed substantially
in accordance with -Dlans and specifications on file with the City

-BE IT FURTHER RESOLVED that the City Council hereby
