A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF A114AHEIM DETERMINING THE NECESSITY FOR AND
DIRECTING THE ACQUISITION BY EMINENT DOMAIN
OF REAL PROPERTY FOR ROAD, PUBLIC UTILITY
AND SLOPE PURPOSES FOR FAIRMONT BOULEVARD.

WHEREAS, the public convenience and necessity
require the acquisition of certain real property located
within the City of Anaheim for road, public utility and
slope purposes; and
WHEREAS, the City Council of the City of Anaheim
does find and determine that the public interest and
necessity require the acquisition of all that real property
herein described by the City of Anaheim for road, public
utility and slope purposes.
NOW, THEREFORE, BE IT RESOLVED by.the City
Council of the City of Anaheim that the public interest and
necessity require the acquisition of the following
described real property, to wit:

PARCEL ONE
An easement for road and public utility purposes
over, under and across that portion of the land
described as Parcel One in deed recorded May 18,
1954 in Book 2729, page 522, Official Records,
described as follows:
Commencing in the most northwesterly corner of the
land described in the above-mentioned deed; thence
N 710 481 44l1 E, 139.69 feet to the true point of
beginning; thence N 711 491 00" E, 63.43 feet to a
point hereinafter referred to as Point A; thence S
370 061 56" E, 847.48 feet to the beginning of a
curve concave northeasterly and having a radius of
1,170 feet, a radial line bearing S 52° 53' 041' W

BE IT FURTHER RESOLVED that the City Council
of the City of Anaheim does find, and it does hereby
find and determine that the public interest and necessity
require the acquisition of said property by the City of
Anaheim for the aforesaid purposes; and that the taking
of the property hereinabove described is necessary there-
for, and that the uses to which it is to be put are uses
authorized by law, and the taking of said property is
necessary to such uses.
BE IT FURTHER RESOLVED that the City Council of
the City of Anaheim does find and determine that the
public interest and necessity require the proposed project;
that the proposed project Is planned or located in the
manner that will be most compatible with the greatest
public good and the least private injury, and that the
property hereinbefore described is necessary for the pro-
posed project, to wit., Fairmont Boulevard.
BE IT FURTHER RESOLVED that the City Council of
the City of Anaheim does hereby authorize the acquisition
of said property by the City of Anaheim, and does hereby
authorize and direct the City Attorney to commence a
proceeding in eminent domain to acquire said property; and
to that end, the City Attorney is authorized to perform
and carry out all of the necessary steps incident to the
acquisition of the title to said property, including the
right to immediate possession thereof.
