A PESOLUTION OF THE CIrLrY COUNCIL OF T1111EE" CITY
OF AIULHEIM GRA'_NITING VikRIANICE NO. 2733.
WHEREAS, after a request for variance by Raymond Spehar,
owner, was received, a public. hearing before the Planning Coyrn.ission
of the City of Anaheim. was held upon due and Proper notice, a result
of which Variance No. 2733 was granted covering the following des-
cribed property:
That portion of allotment in decree of partition of
the Rancho Canon de Santa Ana, recorded in Case No.
1978, of the 17-1--h Judicial District Court of Califor-
nia, a certified copy of which was recorded February
8, 1874, in Book 28, Page 158 of Deed, in the office
of the County Recorder of Los Angeles County, Cali-
fornia, in the City of Anaheim, County of Orange,
California, described as follows:
Parcel 1 as shown on a map recorded in Book 30,
Pages 48 and 49 of Parcel Maps excepting therefrom
the following described Property.
Beginning at the Northeasterly corner of the land
described in the deed to the State of California re-
corded October 30 -Un, 1956 in book 3693, Page 374 of
Official Records of said county and state; thence
along the Easterly and Southerly line of said land
the following courses; South 5* 381 18" West 324.54
feet; thence North 88* 361 11" West 14.92 feet to a
point on the Easterly line of the land described in
a deed to the State of California, recorded October
14th, 1952 in Book 2395, Page 522 of official
Records of said county and state; thence along said
Easterly line South 10 231 00" West 47.64 feet,
thence South 88* 371 00" East 857.17 feet to the
North line of said parcel 1, thence North 1* 231
00" East along said North line 412.10 feet to the
Southerlv line of a strip of land, 100.00 feet wide,
as conveyed to the Riverside,, Santa Ana and Los
Angeles Railway Company, by deed recorded July 7,
1886, in Book 164, 'Page 508 of Deeds, Records of
Los Angeles County California, said 100.00 feet wide
strip being now vested in the Atcheson Topeka and
Santa Fe Railway Co. a corporation, which point is
a point on the curve of said Southerly line, concave
Northerly having a radius of 5779.65 feet, a radial
bearing to said point bears South 10 471 02" East,
thence Westerly along said curve through a central
angle of 0* 191 02" an arc length of 32.00 feet;
thence South 680 321 00" West 787.18 feet to the
point of beginning.

HEIR AS, thereafter, within the time prescribed by law,
an interested party or the City Council, on its own motion, caused
the review of said Planning Commission action at a public hearing
noticed and held as prescribed by law and, as a result thereof,
the City Council does hereby make the following findings:
1. That there are special circumstances applicable to the
property including size, share, topography, location or surround-
ings which do not apply to other property under identical zoning
classification in t�h'e -vicinity.
1 2. That, because of special circumstances shown in (1)
above, strict applicationL
of the zoning code deprives the property
of privileges enjoyed by other property under identical zoning
classification in Cie vicinity.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that a conditional zoning variance be, and the
same is hereby, granted permitting a commercial shopping center on
the property hereinbefore described with waiver of the following
sections of the Anaheim Municipal Code:

That said Variance be granted subject to the following conditions:
1. That this Variance is granted subject to the completion
of Reclassification No. 75-761-2.
2. That subject property shall be developed precisely in
accordance with plans and specifications on file with the City of
Anaheim marked 6diibit Nos. 1, 2 and 3 provided, however, that
plans and specifications for screening of the, roof- maounted equip-
ment shall be submitted to the Planninq DeDartmient for review and
approval prior to the issuance of a building permiit.
The City Council hereby reserves the right to revoke
such variance pernmit for good cause or failure of said owner, his
heirs, successors or assigns to comply with the Anaheim Municipal
Code and regulations and the conditions herein. Said variance is
granted for the term prescribed by the Anaheim Municipal Code Un-
less otherwise specified herein.
