RESOLUTION NO. 76R- 661
A RESOLUTION OF SHE CITY COUNCIL OF THE CITY
OF ANAHEIM APPROVING THE TERMS AND CONDITIONS
OF AN AGREEMENT FOR THE CANCELLATION OF THE
AGRICULTURAL PRESERVE AGREEMENT IN CONNECTION
WITH PROPERTY OWNED BY JOHN S. FLUOR AND GLORIA
B. FLUOR, WITH REQUEST FOR WAIVER OF FEES AND
AUTHORIZING THE MAYOR AND CITTY CLERK TO E.7lECUTE
SAID AGREEMENT ON BEHALF OF THE CITY OF ANAHEIM
WHEREAS, John S. Fluor and Gloria B. Fluor are the fee
simple owners of aproximately 2.1 acres of real property in the
County of Orange; and
WHEREAS, John S. Fluor and Gloria B. Fluor and the
County of Orange entered into an Agreement commonly known as the
Douglass -Sunkist Agricultural Preserve Agreement which is referred
to as "Preserve Agreement" on February 26, 1969, pursuant to the
California Land Conservation Act of 1965, set forth in the Cali-
fornia Government Code commencing with Section 51200; and
WHEREAS, pursuant to Paragraph 10 of the Preserve
Agreement and Sections 51281 through 51285 of the Government Code,
John S. Fluor and Gloria B. Fluor petitioned the City of Anaheim
for cancellation of the Preserve Agreement having heretofore been
annexed to the City of Anaheim; said annexation becoming effective
the 26th day of October, 1976; and
WHEREAS, having duly considered John S. Fluor and Gloria
B. Fluor's petition and having complied with all of the procedures
required by law, the City determined, partially in consideration
of John S. Fluor and Gloria B. Fluor's covenants set forth in said
Agreement, that cancellation of the Preserve Agreement is not in-
consistent with the purposes of the California Lancs Conservation
Act of 1965 and that cancellation of the Preserve Agreement is in
the public interest; and
WHEREAS, John S. Fluor and Gloria B. Fluor's covenants
set forth in said Agreement are in consideration of the City o -f
Anaheim's consent to the cancellation of the Preserve Agreement;
and
WHEREAS, the City Council of the City of A.ndheira agrees
to include a provision concerning refund of all fees paid.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the terms and conditions of an Agreement
for the cancellation of the Agricultural Preserve Agreement in
connection with property owned by John S. Fluor and Gloria B.
Fluor, along with a request for waiver of fees, be, and they are
hereby, approved.
BE IT PURTHER RESOLVED that the Mayor and City Clerk be,
and they are hereby, authorized to execute said Agreement on be-
half of the City of Anaheim.
THE FOREGOING RESOLUTION is approved and signed me
this 26th day of October 1976.
