A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM APPROVING THE TERMS AND CONDITIONS
OF AN AGREEMENT FOR THE CANCELLATION OF THE
AGRICULTURAL PRESERVE AGREEMENT IN CONNECTION
WITH PROPERTY OWNED BY JAMES S. GREGG, WITH
REQUEST FOR WAIVER OF FEES AND AUTHORIZING
THE MAYOR AND CITY CLERK TO EXECUTE SAID
AGREEMENT ON BEHALF OF THE CITY OF ANAHEIM.
WHEREAS, James S. Gregg is the fee simple owner of
approximately twenty acres of real property in the County of
Orange; and
WHEREAS, James S. Gregg and the County of Orange en-
tered into an Agreement commonly known as the Douglass -Sunkist
Agricultural Preserve Agreement which is referred to as "Preserve
Agreement" on February 26, 1969, pursuant to the California Land
Conservation Act of 1965, set forth in the California Government
Code commencing with Section 51200; and
WHEREAS, pursuant to Paragraph 10 of the Preserve
Agreement and Sections 51281 through 51285 of the Government
Code, James S. Gregg petitioned the City of Anaheim for cancella-
tion of the Preserve Agreement having heretofore been annexed
to the City of Anaheim; said annexation becoming effective the
26th day of October, 1976; and
WHEREAS, having duly considered James S. Gregg',_s peti-
tion and having complied with all of the procedures required by
law, the City determined, partially in consideration of James S.
Gregg's covenants set forth in said Agreement, that cancellation
of the Preserve Agreement is not inconsistent with the purposes
of the California Land Conservation Act of 1965 and that cancel-
lation of the Preserve Agreement is in the public interest; and
WHEREAS, James S. Gregg's covenants set forth in said
Agreement are in consideration of the City of Anaheim's consent
to the cancellation of the Preserve Agreement; and
WHEREAS, the City Council of the City of Anaheim agrees
to include a provision concerning refund of $15,000.00 in fees
paid.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the terms and conditions of an Agree-
ment for the cancellation of the Agricultural Preserve Agreement
in connection with property owned by James S. Gregg, along with
a request for waiver of fees, be, and they are hereby, approved.
BE IT FURTHER RESOLVED that the Mayor and City Clerk
are authorized to execute said Agreement on behalf of the City
of Anaheim.
THE FOREGOING RESOLUTION is approved and signed by
this 26th day of October , 1976.
