1976-637RESOLUTION NO. 76R-637 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DENYING VARIANCE NO. 2843. WHEREAS, after a request for variance by W. B. Hart, owner; Bill Phelps, agent, was received, a public hearing; before the Planning Commission of the City of Anaheim was held upon due and proper notice as a result of which Variance No. 2843 was denied, covering the following described property: The East 253.00 feet of that portion of the North 15 acres of the East half of the Southeast quarter of the Southeast quarter of Section 12, Township 4 South, Range 11 West, in the Rancho Los Coyotes, in the City of Anaheim, County of Orange, State of California as per map recorded in Book 51, page 11 of Miscellaneous Maps, in the Office of the County Recorder of said County described as follows: Beginning at a point on the East line of said Section, North 00 13' 47" West 328.29 feet from the Southeast corner of said Section, said point being the Northeast corner of the South 5 acres of said East half as shown on a map filed in Book 37, Page 24 of. Record of Surveys, in the Office of the County Recorder of said County; thence South 89° 40' 43" West 512.54 feet along; the North line of said South 5 acres to the beginning of a non -tangent curve concave Southeasterly and having a ra- dius of 969.50 feet a radial line from said point bearing South 57° 52' 33" East; thence Northeasterly 304.69 feet along said curve to a line tangent; thence North 50° 07' 50" East 336.40 feet along said tangent line to a line parallel with and 53.00 feet westerly from the East line of said Section; thence North 0° 13' 47" West 39.61 feet along said parallel line; thence North 500 07' 50" East 63.82 feet to the East line of said Section; thence South 00 13' 47" East 525.06 .feet to the point of beginning. EXCEPT the South 200.00 feet thereof. ALSO EXCEPT that portion thereof within Magnolia Avenue. WHEREAS, thereafter, within the time prescribed by law, an interested party or the City Council on its own motion caused the review of said Planning Commission action at a public hearing noticed and held as prescribed by law and as a result thereof the City Council does hereby make the following findings: 1. There is no substantial property right possessed by other property in the same vicinity and zone and denied the subject property. 2. It appears that the subject property can be adequately developed and used under the present zone. + -1- NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim, that said zoning variance be, and the same is hereby denied.
