BIDDER FOR THE FURNISHING F ALL PLANT, LABOR,
SERVICES, MATERIALS AND EO IPMENT AND ALL
UTILITIES AND TRANSPORTATI N, INCLUDING POWER,
FUEL AND WATER, AND PERPO ING ALL WORK NECES-
sARy TO CONSTRUCT AND COMP ETE TIlE FOLLOWING
PUBLIC IMPROVEMENT:

All plant, labor, services, mat rials and equipreent, and
all utilities and transportatio , including power, fuel
and water, and performing all rk necessary to construct
and co.plete in a good and wor nlike manner, in strict
accordance with the specificati ns, plans and drawings
therefor on file in the Office f the City Engineer or
City Clerk of the City of Anahe~rn, the following public
improvement, to wit:
Alley improvement, from approXi=' tely 679 feet
east of Brookhurst Street from nerva Street
to Ball Road, in the City of Ana eim, consisting
of concrete removal; excavation;! construction of
P.C.C. curb and gutter, curb, al ey approach and
sidewalk; construction of an all y with a P.C.C.

and declare that pursuant to the pro isions of Section l770 of
the Labor Code, the City Council of he City of Anaheim had as-
certained the prevailing rate of wag s in the locality in which
this type of labor is to be performe for each craft or type of
workman or mechanic needed to execut. the contract, and which
wage scale is on file in the Officeslof the City Clerk and City
Engineer. .
WHEREAS, the City Clerk ofJthe City of Anaheim did

a good and workmanlike manner, in st~ict accordance with the
specifications, plans and drawings tperefor on file in the Office
of the City Clerk of the City of Anaheim, the public improvement
hereinabove mentioned and described, together with the appurte- .
nances thereto, and as specified in the notice inviting sealed
proposals, and that said proposal of said above-named bidder
should be accepted and a contract aw~rded to said bidder in
accordance therewith; and

WHEREAS, the City Council finds that the above-mentioned
sealed proposal is the lowest respon~ible proposal received and
that the person, firm or corporatio~ submitting said proposal is
a responsible person, firm or corpor~tion and that the proposal
subaitte4 is the best suited and fit~ed for the public improve-
ment to be constructed.
NOW, THEREFORE, BE IT RESqLVED by the City Council of
the City of Anaheim, that the sealed! proposal submitted by

necessary to construct and complete, in ~ qood and workmanlike
m~nner, in strict accordance with the sp~cifications, plans and
d~awin9s therefor on file in the Office Qf the City Clerk of the
City of Anaheim and the notice inviting $ealed proposals, the
public works and improvement hereinabove I more particularly men-
tioned and described, together with the ~ppurtenances thereto,
be, and the same is hereby, accepted, an! that a contract for the
construction and completion of said publ c imnrovement be, and
the .ame is hereby, awarded to the said bove-named bidder.
AND BE IT FURTHER RES0LVED that the successful bidder
or bidders upon each contract awarded as!hereinabove set forth,
snall be, and they are hereby required t~ execute a contract in
the required form with the City of Anaheim upon the terms and
conditions specified in the notice inviting sealed proposals and
the proposal submitted by said successfut bidder or bidders and
in accordance with the plans and specifiqations for said public
improvement hereinabove described, and in accordance with the
terma, conditions and provisions of this resolution, and th~t
said successful bidder or bidders to whom each contract is awarclE,d
shall be required to furnish a surety bond in an amount equal to
one hundred per cent (100\) of the contract price for all labor,
materials and equipment to be furnished and performed, as set
forth in the sealed proposal submitted by said bidder for the
construction of said public improvement, together with the Mmur-
tenanoes thereto or such portion thereof as is covered 'by said
contract, as security for the faithful performance of said oontract,
and a separate surety bond in an amount equal to one. hundred per
cent (100\) of the construction cost of said public improvement
covered by said contract, as security for the payment of all persons
performing labor and furnishinq material for said project.
AND BE IT FURTHER RESOLVED that said succesmtul bidder
or bidders be, and they are hereby required to furnish-t:p the
City of Anaheim in companies satisfactory to the City GtAn~heim,
public liability, property damage, compensation, and other insur-
ance in the amounts and for the purposes set forth and snecified
in the notice inviting sealed proposals, and subject to the
approval of the City Attorney as to form and sufficiency.
AND BE IT FURTHER RESOLVED that the Mayor and the City
Clerk of the City of Anaheim be, and they are hereby, autho~ized
and directed to make, execute and enter into, for and on behalf
of the City of Anaheim, a written contraqt with said successful
bidder or bidders for the furnishing of all plant, labor, materials,
and equipment and performing all work, as hereinab9ve more parti-
calarly described, for the construction, installab~on and comple-
tion of said public improvement hereinabQve described ~p'on the
term. and conditions as specified in the notice invitinq sealed
p~oposals, the detailed design, plans, profiles, drawings and
general specifications and detailed spec~fications and drawings,
and all addenda thereto, and all rnodific4tions incorporated therein
p~ior to the date of the opening of bids, on file in the Office of
tbe City Clerk of the City of Anaheim and in strict accordance
with the terms, conditions and provision~ of this resolution, and
in accordance with all of the contract dQcurnents herein specified.
