RESOLUTION 76R-444
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF A4AHEIM ORDERING THE VACATION OF THAT POR-
TION OF CERTAIN PROPERTY DESCRIBED HEREIiv.
(Alley - 75-14A)
WHEREAS, the City Council of the City of Anaheim has
elected to proceed under the provisions of the Street Vacation
Act of 1941 (Section 8300 et seq., Streets and Highways Code) in
connection with requests for vacation and abandonment of public
streets within the City of Anaheim; and
WHEREAS, the City Council did, by resolution duly posted
and published, give notice of its intention to abandon the follow-
ing described public street, to wit, that certain public alley lo-
cated approximately 120 feet easterly of Harbor Boulevard, extend-
ing southerly from Santa. Ana Street to a point approximately 177
feet southerly thereof (hereinafter Street) more specifically de-
scribed as follows:
That portion of that certain public alley located in the
City of Anaheim, County of Orange, State of California,
lying within that portion of Vineyard Lot G-5, as shown
on a map recorded in Book 4, pages 629 and 630 of Deeds,
records of Los Angeles County, described as follows:
• The easterly 20.00 feet of the westerly 139.46 feet of the
northerly 187.00 feet of Vineyard Lot G-5, as shown on a
map recorded in Book 4, pages 629 and 630 of Deeds, rec-
cords of Los Angeles County.
RESERVING THEREFROM unto the City of Anaheim and unto the
Pacific Telephone Company a public utility easement to
construct, place, operate, inspect, maintain, repair, re-
place and remove such aerial and underground telephone,
telegraph and communication structures as the companies
may from time to time require, consisting of poles, an-
chors, wires, cables, conduits, manholes, markers and
necessary fixtures and appurtenances over, under, along
and across the westerly 10 feet of the northerly 150 feet
of the above described area; and
WHEREAS, on the 27th day of July, 1976, a public hearing
was held to allow interested persons to submit evidence concerning
said proposed abandonment; and
WHEREAS, the City Council of the City of Anaheim does
find from the evidence submitted to it that said Street is unneces-
sary for present or prospective public use; and
WHEREAS, the City Council has further determined that
certain conditions must be met prior to making of an order vacating
and abandoning said Street.

NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Anaheim does determine that said Street should be aban-
doned and vacated subject to the following condition:
That specific development plans for the property
adjacent to the Street be presented to the City
Council for approval.
BE IT FURTHER RESOLVED that should the condition set
forth in the preceding paragraph be fulfilled within three hundred
sixty (360) days of the date of this Resolution, the City Council
will make its order vacating and abandoning said Street.
BE IT FURTHER RESOLVED that should said condition not be
fulfilled within said three hundred sixty (360) days or such further
time as the City Council may grant, then this Resolution shall ter-
minate, and resort shall be had to "a new and separate proceeding.
THE FOREGOING RESOLUTION is approved and signed by me
this 27th day of July, 1976.
